No jury should ever convict on this evidence. All they had was a bunch of women who had aggressive sex with him and kept coming back for more. The guy shooting himself was all the reasonable doubt you need, should have never gone to trial .

It’s a really complex case. “Marianne is so intelligent, she wouldn’t have drowned.” But if she was so intelligent she wouldn’t be dating him and doing this amount of drugs and alcohol.

She wasn’t careless, she was a responsible woman. Really? She was sleeping with a known drug addict at his home, mixing different drugs all while drinking alcohol. Moral of the story, be responsible and carful who are associated with, and don’t do drugs!

I googled the case. Marcus Lillard had called two people that night asking what to do for an unconscious person. He was trying to treat her, himself to avoid being sent back to prison on a drug trafficking charge that he was out on parole for. So she’s with a person who can’t call 911 for her because he doesn’t want to go back to prison. It might be smart to do a background check on the people you hang around with.

She's a sister in grief and denial. No one wants to think of their educated, smart sister, choosing to take drugs and alcohol with an enlarged heart and get into a hot tub. Deaths in hot tubs have happened due to any combinations of those.

Her sister claiming that she was smart and wasn't careless and couldn't possibly have died thst way didn't make a whole lot of sense. Especially when she admitted that her sister was questioning being in a relationship with a man who did drugs and got violent when he was on them. That right there sounds careless to me. And drinking a glass of wine and taking MDMA are 2 different things. One is going to have a more significant impact on your motor skills.

Yep. I have watched the film before reading comments and that’s my opinion too. She wasn’t killed. The combination of drugs and her medical condition combined with the hot tub. Clark felt guilty because it was “on his watch”, he was probably also influenced by the drugs (coming down after mdma) and his past traumas and the way he processed events. I felt so sorry for him. The fact that the other guy is a narcissist, there’s no doubt, but in this case, I don’t think he did it.

The best lesson to take from cases like this is to be careful who you surround yourself with. ESPECIALLY if you’re going to engage in risky &/ or illegal behavior. If you’re dealing with an ex con who’s on parole, there’s a high likelihood that if something happens to you, they won’t call 911 asap.

The Son, the young Man who cautioned the dead Lady about his Father shows very good character and the most sound judgement of the lot. I respect him for his courage to warn her. Too bad she did not head his warning, she lacked his good judgment. She made many poor choices even if she was "bug smart".

Yes, she keeps saying “my mister was too smart to…”. Well, the sister apparently was not smart enough to have a grown up man by her side, drink with moderation, avoid heavy drugs, and more than all avoid mixing alcohol+drugs+hot. Lets also say that entomology is not such a fancy and prestigious discipline eh. And having a PhD is normal for scientists. The family exaggerated a bit her success story, perhaps.

I kept thinking 🤔 a PhD but married and divorced 3 times ... Doesn't seem like she had enough smarts to understand relationships, let alone marriage. Her pick-a-man radar was busted. Not to take away the tragic death. That's horrible. Just pointing out something that struck me as odd. Like a personality flaw.

It was a weak case. I'm not even convinced that this lady was even murdered at all. The best they could have tried him on was failure to contact authorities in a timely manner.

That is the scariest statement in this whole story, because it is far too common. "I had my mind made up and nothing they were going to tell me was going to convince me that Marcus didn't do it". Jurors admitting they don't even care what the evidence says. Thank God she eventually listened. What happens in cases where the evidence isn't overwhelming? Or it's not as clear? An innocent person goes to prison.

They're all horrible. But Marcus is lying. He didn't forget anything that night. He spent that 2hrs strong arming Clark into not calling an ambulance. Clark felt guilty for letting that lady die.

All three were tripping balls and only God knows what happened. Those drugs are strong and depending on how much they took they could have been talking to animals and trees.

I dropped acid in a skyscraper a few weeks and as I put the tab on my tongue I sang out loud to others in the group (also on acid) "Taking acid in a skyscraper 🎵🎶" and at the end of the night everyone was fine in fact we were flying, happy days 😅

Exactly! My ex-husband drowned in a hot tub and he was a university professor. His doctor said when you have alot of alcohol in your blood your blood pressure bottoms out making you unconscious. Smart people still have substance abuse problems.

I actually do agree with the jurors. There was way too much doubt in this case. I actually do believe that Marcus didn’t even know what happened because he was so high on Coke 😕 They all were, and it would have been really hard to find out what really happened 🤷🏻‍♀️

Honestly, that was my first thought - it wasn’t a homicide. No one did it.. absolutely could of been from the ecstasy (which dehydrates you significantly) and being in the hot tub, drinking and THEN having a health concern/heart issue as well. Also, waiting too long to call 911.. maybe they could have saved her, maybe not. We will never know. It was a unfortunate combination of bad choices and circumstances. ✌🏼

Legit I kindda hate the sister. She says over and over that her sister was so intelligent she would never drown in a hot tub. Like what? Only stupid people drown in hot tubs? Or drown at all? Her sister was so intelligent she was married and divorced 3 times before the age of 30 and did drugs in the woods with hippies. That's how intelligent her sister actually was.

i dunno who, if anyone, killed her but from what was provided in this story, there's more than reasonable doubt that it was marcus and not clark or a combo of drugs, alcohol, and a heart condition ... in other words they did not prove beyond a reasonable doubt that marcus did it

The jury got this right. Whether Marcus killed this woman or not we will never know but the law states in order to convict it must be "beyond a reasonable doubt". The moment Clark walked back into his home and blew his head off is the exact moment "reasonable doubt" was established and by that action alone, the jury must acquit. The law is the law.

Also the written suicide note of Clark said he's sorry she died on his watch. He didn't say he murdered her nor did he say she was murdered on his watch. That said, Marcus is definitely unlikable but the jury got this right.

The law is the law…. Agreed That’s how people catch assault or gun charges .. bond out/ PTA Then a week later cut a few citizens on the train… Country needs to tighten its belt with repeat offenders. Even 1st timers squeeze them so hard they’ll have to think before they act and if not… Few years might help

Why is committing suicide a sign he killed her? He could have felt guilty he didn't call 911 sooner and a myriad of other reasons. The police were questioning them like they both did it almost immediately and that's enough to push some people over the edge

I consent to being lightly choked and if I feel like it's too much, I tap out. The fact those women allowed themselves to be choked out and wanna complain about it now, is ridiculous and opportunistic. They wanted to be involved in a criminal case and needed to play victim in my opinion. If they gave a statement where they asked him to stop and the man stopped, then I don't believe he was being malicious or violent.

If I heard this was an intelligent woman one more time I would throw up in my mouth a little bit. It is one thing to be to doing heavy narcotics in your twenties (not smart, but everyone has there own self discovery), it is another to be in your mid 40s doing these drugs with a self centered narcissist. Being able to catalog insects does not make one intelligent. I think the verdict was correct, all they had were women that had aggressive sex with him who kept coming back for more. The guy blowing his head off was enough reasonable doubt, surprised they even brought this to trial.

I agree with the jurors. A man killed himself when police arrived and started asking questions for goodness sake! This guy may not be a model citizen whatsoever but I am thankful that unbiased jurors went only by the evidence presented. That being said, her death is tragic and I’m very sorry for her family.

Here's the thing, he was definitely remorseful of something and he stated it. He was sorry she died in his watch. He wasn't sorry he killed her, he also didn't say she was murdered on my watch. The third party medical examiner also stated strangulation wasn't sure. And there are other possible causes of death. He also said he wouldn't call it a homicide. I think there are reasonable doubts all around.

@@catsinpajamas Can you honestly say that Marcus is the murderer? The jurors were presented with all the evidence yet it only took them 30+ minutes to decide he's not guilty. That shows you there is no conclusive evidence that says he murdered her or if she was even murdered. You also know that a third party medical examiner paid for by 48 hours (not the defendant, so this is an unbiased medical examiner) cannot conclusively say that she was strangled? And that she has a pre-existing heart condition. Uppers (ecstasy) and downers (alcohol) cannot be mixed as it will stress out your heart and she took both and she has a pre-existing heart condition. So unless you have evidence that the jury didn't see, I don't know how you can say with absolute certainty that he was a murderer.

I always find it weird that people who have no problem eating a carved up cow cringe at the thought of an insect. Insects are eaten all around the world every day. You eat them too and you just don't know it. I hate to break this to you, but products like peanut butter have an "allowable limit" on contamination by insects and other matter. You don't think there are millions of people out there checking billions of peanuts before they go into a masher, right? There's lizards, rats, mice, bugs, all kinds of stuff goes into the food you eat and you have no idea.

I feel bad for the sister and family's loss, but I have a graduate degree and almost choked on a pancake that got lodged in my throat while stone cold sober in the middle of my office building. And I've seen just enough recreational drug use among (good/smart/kind) friends that I wouldn't rely on them to save my life in a hot tub. Being brainy doesn't translate to perfect behavior or the ability to avoid dumb accidents or dumb people. Clearly Marcus isn't a great guy, but I can't say I disagree with the jury in this. I think there were too many possibilities creating doubt around a tragic accident to convict Marcus just because he survived. You know the prosecution would have done the same thing to Clark if it was the other way around regardless of evidence.

Seriously who will take an ecstasy then jump into hot water? Consumed an MDMA itself (without any other drugs or alcohol) needs a cool even cold temperature otherwise your heart will beating too fast. As MD let me explain a little bit, MDMA dilates blood vessels combined with hot bathtube the blood vessels will dilate even more, put the body on a severe dehydration state - which results the heart will desperately pumping blood so hard as a compensation to fullfilled demands of each organs. Severe Tachycardia could end with Cardiac Arrest, esp. when the victim already has Cardiomegaly. Well, that's why the guy (Marcus) jumped out and went to the forest, instinctly he needs to cool down to maintain his heart rate. This case looks like an accident for me.

Whenever you hear descriptors like, “charming, charismatic, etc” it usually means they are narcissistic con artists. Unfortunately, if the person is super attentive, fun-loving, lays on the charm, and wants to move fast in the relationship, you need to be careful. *Anyone* can be fooled by these types, it just depends on how skilled they are at adapting. But if you have had trauma or neglect in your background, be extra careful with establishing boundaries. If you have issues with boundaries and self love, stay away from these types all together.

I agree with u. We will never know exactly what happened to Marianne that night. However, her sister completely took any responsibility of the events that night away from her sister. No matter how smart someone is they can still make poor choices and lapses of judgement. That night she made plenty of poor choices that could’ve cost her life. Drugs r a deadly game to play with especially when u don’t even know about a hidden health condition. For Clark to commit suicide truly threw so much doubt on everything as well. An innocent person doesn’t just blow their brains out in the middle of a questionable situation that they could help solve with answers only they could give.

If they convinced him that she was murdered and he knew he didn't do it, then there's only one other person he could believe did it. I think he either (1) knew Marcus did something to her or (2) thought she died accidentally, but in either event he simply could not live with himself knowing that this happened on his watch. Marianne's death wasn't the sole reason for his suicide, but it was the straw that broke the camel's back. I truly believe that if he was responsible he would've confessed in his letter instead of letting his surviving friend (Marcus) suffer the consequences.

I’m glad the jury came together. So often it’s automatically pointed at the partner, but this literally has zero evidence. They weren’t even onto the whole strangling thing until others called in about it. Plus they all mentioned it was only during sex, not like when fighting ect…. Most e pills during that time period were dosed extremely high. For someone who doesn't dabble in that kind of stuff often and who is also drinking and in a hot tub, that could definitely be fatal. It would also explain why she didn't want Marcus to leave because she was probably overdosing. Often times, one pill can contain enough MDMA for 3 people. Even experienced users usually break their pills in half. She probably overdosed and Clark did what he did because he knew what it looked like and he knew he wouldn't be able to handle people thinking he had something to do with it.

Maybe she od'd before the hot tub & never said "Marcus don't leave". We only have Marcus saying she said that. They freaked out, put her in the tub & took 2 hours to make up a story. I don't remember if the autopsy said she had water in her lungs or not.

Less worried about dosage with MDMA than laced with fentanyl these days. Not sure what time period you are talking about. Her death was 2019.

@@HKim0072 Since about 2015, pills regularly contain 2 to 3 times the normal dose of MDMA. It's still like that today. And yes, the whole fentanyl thing makes it even more dangerous.

@@ginacampbell8766 They can't even prove conclusively that she was strangled. Do take note that an unbiased medical examiner said that strangulation was inconclusive. This unbiased medical examiner was not paid for by the defendant but rather paid for by 48 hours. So he had no motive to come up with findings that point one way or the other. And his findings say he would never call it a homicide.

He is a scumbag but I don’t think he killed here either. I’m sorry for her family but this bright successful woman was living a chaotic lifestyle, drinking in excess and drugs. She probably fell asleep in the hot tub or her enlarged heart had something to do with it.

Marianne's sister sounds snarky. Perhaps it's pain over the death of her sister. Sad that they were all using drugs. Professor Shockley wasn't better than her boyfriend (both drug abusers). She was also post-3rd marriage. They were both prone to some very bad choices. However, I am human, and not judging her. Nobody gets it all right. I certainly don't. I hate that she died tragically. My condolences.

Anytime drug abuse enters the equation, risk goes way up for a bad outcome. I respect your comment very much! It was very good.

There was plenty of reasonable doubt, so the jurors were correct to acquit, imo. After listening to this story, I myself had no clue how she died. The fact that Clark went and offed himself when police started asking questions was very odd & unusual and muddled the case even more. Even if he was depressed and suicidal, why do it at that exact moment? Did he do it because of a guilty conscience? Did she die as result of underlying illness, excebarated by drug use? Or did Marcus Lillard strangle her? I really could not answer after listening to this case. That letter the sister claimed to have read, pure hearsay. I am surprised she was allowed to testify about it. She seemed like she really hated the guy so who's to say she wasn't making things up? It is exactly in cases like these that a not guilty verdict is warranted, even if the defendant is not a model citizen.

I feel like the ecstasy led to him feeling that extreme guilt. Whether Clark was guilty or not, that drug can make you feel those emotions deeply. Especially, upon the realization that someone has died… I’m sure that would be the reason why he decided to just take his life.

@@foodiesteph Having never taken that drug or any drugs at all, it's hard to fathom, but plausible I guess. I've heard multiple cases in which drugs, esp meth, makes people do the most bizarre homicidal or suicidal things, ie the Taylor Schabusiness case out of Wisconsin. Absolutely horrific.

I don’t think Clark killed her but I think the guilt and trauma of her death, plus the fact that at age 69 if he went away for the drug dealing and failure to render aid he would’ve most likely died in prison, drove him to end his life on his own terms rather than getting sent to prison

Clark confirmed that Marcus had gone into the woods when he said, “When he came out of the woods..” I actually believe the crazy story about him wanting to recreate the shaman thing. Combine that with Clark refusing orders (told four times) to stay out of the crime scene and, most of all, the suicide, I believe he (Clark) killed Marianne. Being worried because a death happened at your house and that he’d given her an Ecstasy tab just doesn’t cut it as a reason to blow one’s head off. I can picture a scenario of Marcus going in the woods, Clark gets in the hot tub with Marianne, makes a pass at her, she refuses and he flips and strangles her, also being concerned she would tell Marcus.

Sounds about right... I wish they had gone into more details about any bruising, petechiae or marks on her neck though. I only saw where they said that one bone wasn't crushed. Wouldn't there be other significant signs of choking? If boyfriend was into sex choking "and he took it too far" wouldn't there be a LOT of significant signs from being choked a lot?

I'll tell u what, after a couple of drinks, my girlfriend & I took mdma, back I the 90's, when It was pure... we would get into my hot tub, & since heat brings on the extacy high, we couldn't even climb out of the hot tub! We actually did it twice, & both times, we had to be lifted out, due to dehydration & overheating, from the mdma/alcohol mix... just my experience on that... it made me feel like when he grabbed her out, she might have been in that state, but dropped her, which after 2 hrs of two extremely high men in a confused state, & one, who refuses to call the cops, worked on her. I feel like the older man most likely Wanted to call the cops, the other guy even says that, but says No... I think that's what he feels guilty for, in my mind...

Great comments by everyone. This case clearly shows that any of us could be charged with a crime at any time even when there is no physical evidence whatsoever. There was clearly a reasonable doubt when the only other witness blows his head off with a shotgun while the officers are at the scene. Why the judge allowed witnesses to testify about the sexual choking is beyond me, the prosecution could not even confirm there was sex involved that night. The juror mentions that the guy who killed himself was not on trial that day...well, he sort of was if there is a possibility he might have been involved in her death. I am truly thought the jury was going to convict. Glad they didn't, this case was one of the weakest homicides I've seen in a while. Small town injustice at its finest.

This is unfortunate for me. I see no motive. After the old man gave them the "good thing" and then he leaned on the edge of the pool, the woman decided to get into the hot tub, her boyfriend decided to recreate a scene with his head down and passed out in the bushes. Just for those 1-2 hours. She goes into cardiac arrest during this time, or something bad with the mix of drug and alcohol. Returning from the bushes, he sees what happened (and the old man may have already known and written the letter). The old man has decided what to "do" with himself seeing the unfortunate result of the drug. The fact is that they were all very high and it ended fatally for two of them. In my opinion.

Family is in denial. If Marrianne is so intelligent why was she drinking n taking drugs. Why was she dating a guy like Marcus? Why she went to hot tub when she should know its not safe in that mental condition? She was living recklessly just like Marcus was. Sister comes up with some letter which didn't even exist. The family did their level best to blame Marcus but sister own actions led her to dangerous path. N it turned out tragically.

There’s a lot of questions unanswered in this sad case of the death of Marianne Shockley, but one of the biggest ones is how the jury could only deliberate for 38 minutes. There’s no possible way they could’ve gone over all the evidence in the trial in that short amount of time.
