Double Jeopardy laws are usually set in place to protect someone from being hounded for a crime for which they have been proven innocent. In theory this is a good thing, but over the years there have been several cases where they have allowed a dangerous person to walk free having fooled the legal system. One man who did this was Brian Donald Hume, who not only got away with murder but then made money by selling his confession to the highest bidder knowing he couldn't be touched. When this money ran out however, he soon returned to his criminal ways...

No. Each murder would be a separate crime and charged that way. It has to do with evidence, expense, stress on survivors, money.

Being found "NOT GUILTY" doesn't mean you are innocent. It just means the prosecution didn't sufficiently prove guilt.

I’ve seen inventive ways in the US to get around the double jeopardy prohibition after new evidence improves a case after a not guilty verdict. In one a fellow was acquitted in state court for murder. He was later convicted of the federal crime of conspiracy to cross state lines in order to commit domestic violence. He got a life sentence and of course there’s no parole in the federal system. In another, a former soldier was acquitted of murder in a state court. He was then recalled to the army (as was the army’s prerogative for some reason), court martialed, found guilty and sentenced.

the military has eight-year enlistments, so that recall was them exercising their right to recall you to serve the rest of your contract… and it’s frequently used in civil rights cases where the state courts either acquit or refuse to indict. it’s also abused by persecuting someone for political gains by claiming their actions were civil rights violations when it wasn’t

My daughter is a forensic tech for a large metro area. She regularly "wears" the skin of fingers from cadavers in order to retrieve accurate prints.

Thank Paul, for highlighting this case. I think I remember seeing that confession in the Sunday Pictorial. Thank goodness we changed the double jeopardy law, it has seen murderers convicted after they first got freed.

@@SweetChicagoGator I don't think that word means means what @misst5835 thinks it means. _This is Spinal Tap_ is an example of a mockumentary -- an entirely fiction-based satire of rock documentaries like _The Last Waltz_ and _The Grateful Dead Movie._ What @misst5835 is calling "mockumentaries" are the part-fact, part-speculative fluff pieces fobbed off as genuine scholarship by the History Channel. I agree they suck rocks, but they're not mockumentaries. Maybe they meant docudramas.

They should allow a retrial for new evidence here in the US. There are too many acquittals with no body and when the body is finally found it is too late due to double jeopardy.

The purpose of double jeopardy is to compel the State to make its case against the accused as solid as possible. The assumption is that the State has what are in relative terms unlimited resources with which to build a solid case for prosecutoon, as opposed to an accussed's (relatively) limited resources. Without souble jeopardy restrictions, the potential for the State to abuse its prosecutorial powers is unlimited.

Double jeopardy laws were changed in the UK in 2003, acquittals for serious crimes can be retried when new and compelling evidence is uncovered after the original trial. Plus the accused does not have limited resources, they have the same as the crowns.

It's also so an innocent person doesn't spent their entire lives being tried and re-tried for the same crime over and over again. Without some kind of limiting factor like that, defendants could just be tried over and over again endlessly, ruining their lives until they're finally convicted. It's definitely in the best interests to have limits on the power of the legal system, although exceptions for strong new evidence make sense.

I guess he ended up the way he deseved. He wasn't punished legally, but he didn't have much of a life and died, very much alone. It's not as good as if he'd gotten convicted, but it seems fair enough. Of course I am saying that not related to his victim.

Another reason for not maintaining the double jeopardy law is that of proven jury tampering. This one is no so important where a country has replaced the consensus decision with that of a majority decision (say a ten or eleven vote) to decide guilt or innocence. It is easier to intimidate/bribe one juror than two or three. Where tampering is proven the trial is clearly corrupted and therefore should be invalidated.

the US has double jeopardy, but it also has what the UK doesn’t have: a second way of trying for the same crimes. the federal system of government allows for the states and federal government to have overlap, it’s mostly used for civil rights prosecutions but it’s still a way around the state courts clearing the person

This is the best pay off I’ve seen between Law Enforcement Agencies. You do not have the right connection made. I’d like to get a connection made in the D.A.’s office. Any imperfections will be found. They will have to be made perfect. Don’t confess ever. Two and two is not four.

Absolutely.Under no circumstances.Should they be able to capitalize on a murder that they themselves have admitted to doing but was acquitted. And if they should go ahead and wrote the book or whatever all that money should go to the survivor's family.

2003, Billy Dunlop and the murder of Julie Hogg. It was her mother who campaigned for the change after he had admitted in the papers of the murder ( if I'm correct).

I reckon Donald Hume’s father was likely Reginald House the man his mother Bessie later married. They were living in the same area of Dorset during 1919. Donald could have quite easily been considered her husband Percy Hume’s child as she was married to him until his death in a London Hospice aged 33 only two months before Donald’s birth. The Registrar would have been none the wiser. Margaret (Peggy) Hume was born in 1916 so presumably Percy’s, but Betty was born a year after Donald as Betty House. In the 1921 census baby Betty was living with Reginald House and “wife” Bessie with Peggy Hume down as a “visitor” in the house with her maternal grandmother, aunt, and cousin. Not clear where Donald was. Bessie and Reginald did not actually marry until 1925. He was 4/5 years younger than her. All quite strange not to mention cruel. Why treat the children differently, hiding her “shame” from Percy’s family? I can’t think their situation would have been widely known in the community for her to be accepted as a country schoolteacher in those days.

It gets me that he would fly into England to commit the robberies, then fly out. I get that he’s giving the middle finger to the law but it had to eat into his profits. No wonder he kept running out of money.

Does double jeopady apply if purjury has been committed. Like saying "Not guilty" instead of guilty?

The authorities decided not to go for perjury because he could always say he made up the news stories to get money. Confessions don't really count, legally, if done outside of the law. People lie to get attention and money. If they couldn't get a jury to convict with the heaps of evidence they had, a perjury conviction was far fetched. Too bad DNA evidence wasn't a tool, back then.

Sorry l must have missed it, but how on earth they knew the bank note was the murder victim's?!? How can they trace ownership? Also, was it not just a torso been found! Where did the fingerprints came from?! 🤔

This is a fair account of the case, but Hume actually left Broadmoor in 1988 and the second bank he robbed in Brentford was not in the same location as the first. The other question, unexplored here is the question of Cynthia Hume.
