His dwindling supporters will support him whether the judge jails him or not. I think the undecideds (why oh why?) will be put off, and turn against him. However......the single most important thing is not to give him any cause to appeal for a mistrial, so Judge Merchan's caution is wise. However unfair it seems that he's not being penalised for breaking the terms of the gag order, he is a unique case...a US ex-president has never been in this position before. He is uniquely deplorable.

@@dbartz89 It's not, but the 2nd reason defined in Section 3 of the 14th Amendment that everyone is ignoring, is. It's actually an update to the 1st Amendment as result of the Civil War, it puts a limit on it. "or given aid or comfort to the enemies thereof." No laws have to be broken, just SUPPORTING them in any way disqualifies them. It applies to any current or former member of our Government or our Military that swore an Oath to Serve and Protect the United States, it's Constitution and violated it. How can they POSSIBLY be trusted to not do it again?

All were misdemeanors with the statutes of limitations tolled, also they are federal laws in a state court and the feds had already decided not to charge AND the original prosecutor in the case, pomerantz, just took the 5th when asked if he had committed any crimes against Trump. With respect Ari….. while being “nice” is understandable, the legal system is supposed to be isolated from politics (isn’t it?) That Trump is running for political office should be wholly separate from anything he might be guilty of as an American citizen….shouldn’t it be??? Said differently, Trump as a candidate is solely responsible for presenting himself as a viable candidate. Judges should not let anyone’s political aspirations infect legal deliberations and decisions. PS Fox’s Jesse Watters is probably the dumbest person on tv. Bottom line….. I disagree!!! He's already in technical breach. Last week he was found to have committed 9 breaches of the judicial order, and at that point any of the other judges of trials where he's out on bail could jail him. However, I don't know if there's any precedent where people out on bail have actually been jailed in such circumstance (no criminal record, not violent crimes, etc.). In Merchan's shoes I think I would have made clear at the very beginning that violating the order had a high chance of landing him in jail, allowing him potentially to be jailed for 2 hours or something this week without being seen as too sudden.
