How many of you have a Workers Compensation and Social Security Disability benefits case going at the exact same time? Ever get confused as to how the Workers Compensation case will affect your Social Security Disability? How many of you have wondered why Social Security has held up processing your case while waiting for Workers Compensation information??

I checked on a BWC settlement many years ago when I was younger and I just walked away, all the BWC did was humiliate me with their offer since I had such a serious injury. They didn't seem to care one bit about all the surgeries I would likely need in the future with my injury. In my case it ended up that needing more surgeries was a understatement, so I'm very glad I didn't settle with them. I'm guessing, but I think I had more than ten serious surgeries sense I walked away from their settlement offer. In my case it certainly turned out that the entire settlement idea with the BWC was very stupid in two ways. One, the BWC was very stupid for not making a decent fair offer. And two, I was very stupid for even thinking they would do so in the first place. Trust me, if they settle you, you will be the one getting the shaft if you were indeed seriously injures. They bank on the fact that your a total dumb ass that just wants another beer and they treats your like your a total moron. And I assume they might be right about this once in awhile. LOL I have had nineteen surgeries and the BWC has paid for seventeen of them over the years. My case has cost the state close to a million dollars, and they only offered $30,000.00 when I was seeking a settlement. Hell, one average surgery would likely cost them that much? I can't help but wonder how they feel about the ridiculous offer they made today? All these calculations that don't even involve the possibility of a injured worker needing further treatment is just ridiculous. My case is a perfectly good example of why it should be considered? My advise to you is this, keep going to your doctor regularly and keep your claim alive and active if you were seriously injured at all. If you just had a scratch, do whatever you think is right because your likely not going to get much of anything anyway.

I paid for my social security why do i have to pay for my injury that was not my fault by offsetting MY social security that i paid for?

I'm confused. Does this mean that you will not get a judgement for SSDI until you have settled your workers comp claim? Just had a hearing last month for SSDI but W/C is still unsettled and doesn't appear to be close.

Excellent, I settle my social security after 10 years and now I am about to settle my workers compensation case. My lawyer indicated that I have to set aside $25,000 for medical for the Social Security. Workers Compensation says one get only $58 a week for permanent disability rated at 70%. Do they go by ones wages for the workers compensation as well and if I was making $71,000 how do they factor that in.

My husband is thinking about taking an early retirement from GM in order for me his wife to receive medical insurance, but he is currently Recieving WC and is in the process of settling his WC with an MSA , so my question is will his retirement insurance be considered as an secondary insurance the same as Medicare is....

I am having a huge problem wit my workers comp. I had a QME state I had a work related injury. He was later bullied into changing that statement to non industrial stating that I didn't injure myself because I am overweight. Basically I am fat so I didn't hurt myself. I had a slip and fall at work. What can I do?

I need to know about settling comp and closing future medical. I am told a bunch of different things from MediGAP\Adv plans , I am new to medicare, that they wont cover work injuries but if your work injury was accepted as sprain\strain then what happens if you need surgery after WC is settled. ALso if you have a WCMSA and then no longer qualify for SSDI what happens. I stumped the gal at Medicare - she was nice but said she honestly didnt know what happens.

my husband was recieving workerscomp,and then applied for disability at the same time.he was approved they said under there terms he was approved.workercomp terminated him as of april 5 and submitted the paper to disability,then we sent the same paper in may 9 and may 24 workercomp sent in a pay off amount which was nothing bc we didnt sue...now we are waiting for disability to finish the paper work so he can get his full amount.my kids have been caught up in the payment center since feb bc there was none avaliable for them..now that hes been terminated,how long and what is the process for him to get the full amount of benefits...yesterday i called to check on my kids stuff and they said the worker filed for an adjucation,what does that mean.y was it filed on my kids

Im a cpa in Pennsylvania and have a client who received his 1099 from social securtiy for 2011. they show gross social security of 39000 in boxes 3 and 5 and then below show 14000 received and 25000 as workers comp offset. they seem to be reporting to irs his social securtiy at the gross amount of 39k and not the 14k he recieved after offset. Im assuming this is incorrect. he should only have to report on his tax return the 14k social securtiy gave him after workers comp offset correct?

What if the workman comp case is from an injury 2 years prior. My son was hurt at work in May of 2014, he then was struck by a car in August of 2015. He then received a WC settlement of 18,000 for back pay in February of 2016 and a settlement for 20% loss of function in December of 2016. He was approved for SSD in December of 2017 for being disabled due to the car accident. Does it matter that the SSD is for the car accident and nothing to do with the wc case?

Lori Parrales this sounds similar to me. I have been on priodic role fed work comp since 2003 for neck and shoulder injury. I have since developed a severe lung disease and am unable to work at all. I have filed for social security disability october 2018. Status is "Decision being reviewed for accuracy" something like that. So I also have a similar question to yours. Expecting WC to be terminated, but seems unfair that they would offset SSDI based on something entirely different. Did youget an answer to question? Thanks and good luck

Today Sept 6 I went to a wc settlement in NY . I got 275k for me a 41250 for my lawyer. I have to wait 10 days for me to change my mind so then if I do not they have 10 days to pay me . Not sure how this will affect my SSDI. The did say this is for 10 years. So you would take the 275k } by 10 so I am pretty sure it will not affect my ssdi . Now on top of that I get 13k seed money in a medicare set aside account plus 8k every year after that . I did not get in a lump sum as I did I would have to spend it all before medicare would pay for my care . But the way I got it if I spend the 8k in a year Medicare will pay for any more bills from workers comp doctors They are paying me the Medicare set aside for 22 years any money not used for worker comp doctors gets carried over to the next year . And if I die my wife or kids will get whats left.I am 55 so I am crit diabetes with Dominica . They do not know that I may die within the next 5 years with all thats wrong with me

I really wish my SSD attorney was as educated in this matter as you - I should have never applied for SSD - I actually lose money at the end of the year by having SS because all of my WC is offset and I have to pay taxes on it - also if my children were old enough to work this offset money would be taxed twice because all of their benefits are offset and they too get a 1099 at the end of the year even though I receive no SS benefit for them. Is there any way to change this law!

I just received my award letter but only got $31.50 concerning the offset of the workman's comp they think that I'm still receiving and I'm not supposed to get a letter that do I get another award letter or is that it for my payment on the offset please let me know

How does it work for my son he lives with me not his father his father has been recieving workmens comp for about 8 months SSI called me and told me that my sons father is elagable for social security disability, I went and applied for my son, they sent me a letter saying he was approved but they are with holding the money due to his workmens comp, I called them and they said until workmens comp was paid I would not recieve any thing for my son and they cant tell me when the offset will lift.

Hi sir question if you know my example I do have an attorney for workers comp! I was just approved for ssdi they said it was offset so I get 1215 a month I get w/c 4000 a month my attorney said it the w/c will be offset but not sure how much? Do you have an idea how to figure this out? I’m sure my attorney wants to get lump sum but I’m happy with the payment. Thank you for any suggestions you have God bless Peter

Yeah, the attorney should figure that out for you, because you are taking the payment monthly, he don't like that. Don't worry about it. It still will be a blessing to you.

i"am getting workmans compensation for a back injury, I haven't settled my case yet, I have a lawyer, also. Now they want to assign vocational rehabilitation counselor. I'm still seeing the doctor for nerve damage, but the doctor has already gave me a 10% impellment rating. Should I ask the doctor for a different rating since I have nerve damage? Do I need a vocational reha counselor at this time?

You need a EMG test for nerve damage.

This is all new to me. I'm getting work comp pd now and have signed a release and compromise to settle my case. I go to court next month, after being denied twice for ssd ins. I have no attny, and after hearing this i'm confused. I'm hoping they wont pay the settlement until after i hopefully get granted my ss. either way i think i'm screwed, One other question, will the work comp QME disibility report of 28% help in my getting approved for ss?

You need a lawyer PERIOD!!! THEY GET 20% BUT THEY WILL WIN YOUR CASE!! DONT GO AT IT ALONE YOULL REGRET IT! CALL A WORKMANS COMP LAWYER THEIR ARE NO UP FRONT FEES AND THEY ONLY CHARGE YOU IF THEY WIN! PLUS THEY WILL HANDLE YOUR SSDI

The Social Security has mine all messed up. My settlement papers say that mine is to broke down to $506.22 a month for 29.35 years..Today I got a letter that said Im supposed to get something like $30.00 a month from Social Security. I know that's not right because I was getting $535.45 from workers comp out of Mi. And that was supposed to be my 80% of my preinjury income. Also Social Security was giving me $60.00 a month because there was a cost of living increase, so I got that too. Using the figures you used mine cant be right. $535.45 X4 = 2,141.80 + 60.00= 2,201.00(all this is my 80% preinjury income the figure I don't have is what they are using as my Social Security income. My question is can you help me figure this out?

I have a question? if I was injured years ago 5, years + which at home then I was injured at work for another thing should my.lawyer be aware if I choose to.file a.claim??

Ok, this question is difficult to answer. You should speak with your attorney for guidance on other lawsuits that may affect your case.

Contact your WC attorney to ask she/he how the WC would affect your Social Security. Typically WC attorneys can structure your settlement in such a way to take in consideration your SSD but every state is a little different.

Reeves Law Firm, P.A. thanks so much, I'm still going to receive a lump sum for 8,000 but he broke it down in paper as if I'm getting 3.26 a week for 49.5 years. i was just approve for ssdi first try. thanks for you videos my wife got alot of help from them so she could help me with it. thanks again you are a great person many blessings.

Again, I would STRONGLY recommend you contacting your Workers Comp attorney. They can give you better insight in terms of the specifics of your agreement

I do like the way you explain it all but not fair that i paid for social security and they take my social security benefits or even touch it. When i started paying into social security that was not the deal, Sorry to get political here but voting and who you vote for matters so much, John Kasich said right on tv your social security check is gonna get smaller and you will have to get over it, well with President Trump social security went up 39$ this year.

Mr my case is closed but i learned one thing maybe you could keep in mind or more than likely already know I worked all my life and paid for my social security benefits, my finger got cut off at work and yeah they treat you like dirt in a quiet way but then they make you pay for your own injury that was not your fault by off setting social security benefits that i paid for all my life, I PAID FOR THE SOCIAL SECURITY! WHAT GIVES THEM THE RIGHT TO TOUCH IT! I DID NOT WRONG AND LOST MY FINGER, HOW IS THAT FAIR THAT I PAY FOR MY INJURY BY OFFSETTING MY SOCIAL SECURITY? SORRY FOR ALL CAPS JUST HOPE FOR FUTURE PEOPLE TO GET YOUR ATTENTION:))))

Maybe because of the 12.8% fica half we pay for and the other half the employer paid for? Either way they steal back every thing they give after they stole it in the first place and gained 38 years of interest on your money.
