No I can almost guarantee it wouldn't be changing, unless the Government was benefiting in some way at our expense. They've ALWAYS given with one hand whilst taking with the other.

I would be no different money wise but still not moving till forced. What a lot of people don’t realise is their is stronger laws under old ESA. Overpayments for example can’t be recovered due to error but can under UC.

Some of us have conditions that are not suitable for fit notes like autism and learning difficulties so have claim under mental health. ESA is not suitable for many conditions and should be rethought.

Hi Stuart, I just wanted to tell you my tribunal is 21st of this month. I have most of your advice wrote down so I’m hoping this helps.I also have an advocate who is excellent. I’m dreading it and would just love it to be over. The DWP lied a lot about the phone interview, but I had my daughter tape it. I know I can’t use the tape but,I just want to say one thing here. The injustice of what the DWP are doing to people is disgusting. I have been going through this for a eighteen months now. To be honest I really don’t care if I’m awarded PIP or not at this stage. I said when I was turned down that I would take this to the end. Now that is my reason for doing this. I was told by the DUP that your meds seem to be helpful, why not take a higher dose. This is immoral and greatly lacking in justice. Thank you for your videos and all the help you have given to so many people like me.

@@StuartMcGoo Hi Stuart, lovely to hear from you. Yes it went even better than I could imagine. I got the enhanced rates on the mobility and also the enhanced rate on the daily living. Your videos are more helpful to people like me than you will ever know. They did give me the decision an hour or so after the tribunal. Thanks again.

I’ve been told because I’ve moved I automatically have to apply for UC. I was getting ESA (Support element) I get pip too. I’ve found out I’m going to be £40 a week worse off switching from ESA to UC

I'm disabled and unable to work due to long term illness and I was claiming the old ESA until the Summer of 2020. I was quite happy with the old benefit system but I fell foul of a nasty little trick the DWP has installed to herd people like me into UC. I moved into a small bungalow and reapplied for council tax benefit and also housing benefit. I was then informed that housing benefit was now only given as a component of Universal credit and I needed to apply for UC to get my rent paid. Of course this left me with no choice but to apply for UC. With ESA I was in the support group but as soon as UC had got it's mucky little claws into me, I was moved into the work-related group so they could bully me into finding voluntary work (which I'm not capable of doing whether I'm paid or not)

Did you appeal the decision to be moved into the WRA Group? Unless you were due for reassessment you should have been kept on the same rate and in the support group as it says so in the rules. That would have been an easy appeal. If you were due reassessment you should appeal on the grounds that the assessment was wrong. If the window for appeal has passed then you would need to do so at your next reassessment. I'm not sure you should have been pushed into claiming UC as LAs still have a responsibility to administer HB and CTS, though it may not be the case in all areas. Did you have an advisor or anyone supporting you with this?

@@StuartMcGoo I had no advisor and didn't appeal as after talking to my district council's benefit department, I was assured that I had to apply for UC to get the housing benefit I needed. I now know just how sneaky the DWP are after they gave me a PIP phone assessment during lockdown. They only heard what they wanted to hear, put words into my mouth, asked leading questions and mostly confused and intimidated me into answering questions hurriedly without thinking. I wasn't surprised when I received a letter saying they were stopping my PIP which led to me becoming suicidal over losing around £500 pcm. The assessor had given me 0 points for everything when I had enough points before to qualify for both components of PIP. It was like they were saying that I had made a miraculous recovery (which was news to me). The final nail came when the assessor was adamant that because I could drive a motability vehicle, then she made an assumption that I could walk 200 metres and so I didn't qualify for the mobility component of PIP. I asked for a mandatory reconsideration but that was a waste of time.. I went to the CAB and started the tribunal process. The DWP phoned me and put me on the spot with an offer to reinstate my daily living component but at the lesser standard rate if I halted the tribunal. With hindsight, I should have gone to a tribunal as it is obvious the DWP knew I had them over a barrel. I know my terrible PIP experience is a separate issue but I don't trust them to do anything right and know they only really care about saving money by taking benefit payments away from claimants and are prepared to scam people to gain money.

This has just happened to me. I gone through a relationship break up so had to go rent my own flat. I was currently getting esa in the support group and pip. I was told im order to apply for housing benifit i need to shut my esa claim down and make a claim for unversial credit. Yet esa and pip had told me i dont need ro be seen until July 2024 But now unversial credit is asking me to get a sick note and telling me i will have to go to job center to see them I can't believe this is happening to me. Has anyone got advice please

I'm on ESA old style,council won't pay my rent, universal credit transitional provisions amendments regulations 22,says I'm protected am I?I've been paying rent as if I was getting housing benefit,I done a exchange from London borough of Barking and Dagenham to Sheffield city council.cam they make me change over?

I'm on new style esa and have no problems at all I get more money each month and with my pip and housing benefit I am getting the same amount has having a job that pays 24,000 per year I suffer with anti social personality disorder I don't have any interviews and when I do they behind glass the only reason I see people not wanting to transfer over to New style is the monthly payment scheme and the lack of being able to manage their money

By not being in full health I suffer with anti social personality disorder 🙃 but if your on old style esa you should transfer over when apply for universal credit if your work coach is any good,

hi I hope some advice finally today I received my PIP as follows Daily Living stander 61.85 Weekly I did an operation on my leg after month I had two operations I called them today. I told you my condition changed because I did an operation. He said the there are some form I have to fill it send it back said he will send them but they are dangerous May they give me more maybe less maybe nothing

Hi Stuart, thankyou for what you do on this channel. Moving from any legacy benefit to UC could be a problem for anyone who has no savings to draw on, during the transition. I'm assuming it could take about four weeks, even if everything was in order...unless things are different nowadays?

It partially depends on which week you chose to begin the process, but if people are on a fortnightly payment cycle then they should only have an extra week with no payment if it is done at the right time. So if your calculation period (a month) starts on the 1st the best time to begin the process would be then, if it starts on a different day of the month, that would be the best time to start.

I asked my work advisor can I claim ESA cos I got ADHD and I'm on UC and she said ESA is gonna be changed to UC

Yes ESA is now managed through Universal Credit. It works in a very similar way to the old style ESA in terms of assessment though.

Please if this interests anyone. I sent evidence to support a backdating payment regarding universal credit. It was received and signed for vis the royal mail. My case worker at U.C says he hadn't received it. I'm very upset. I tried to make s complaint via phone and both people were foreign that I spoke to and one hung up on me when he put me over to the complaints department

My daughter is 19yr old she finished college july 2021 , she was accepted for uc, attended a few interviews, work trails but was not hired, her father became ill and was awarded full pip + long term incapacity She applied for carers allowance and provides 35hrs wk care for him but her uc was cut to £86 per month Carers £278 per month, does this sound rite ?

Yes that does sound correct, one can only receive one "income" benefit at a time - whilst this may seem unfari it does mean she will not be expected to look for full-time employment while caring. She also has some rights as a carer, if you have a local carer's support charity it may be worth getting in touch with them for further information about her rights.

Below min wage and she does things , a lot of qualified nurses couldn't stomach, Family carers need more funds , my daughter should be going out , having fun, meeting lads She has no medical qualifications on paper, but knows a lot more now thru her care of her dad , sadly she would have liked a job in the hair/beauty industry, and i tell her she would make a great nurse! She told me , Never! There's no back up when i call the dr , my dads gonna die and nobody cares !!! We live in scotland , and we cant get past receptionists prioritising appointments Fkn sickening I worry about my wee girl and her mental heath

Deadline is 2024 for everyone to be moved over according to DWP.

@@rajberi1234 no that’s all claims legacy benefits won’t exist after 2024 according to government. It was supposed to be 2023.

I have another question I had my ESA assessment over the phone this week,I had been sending in evidence for the last couple of months and I had made notes about my medical condition the interview went well I think but you can't never tell, if I didn't have enough points do you get told after the appointment or do we wait for the decision letter?

You will need to wait for the decision letter to find out, though ESA is different to PIP in terms of how it is assessed and what information they give to you regarding points.

Please can you give me advice. I am currently on esa in the support group and pip. I've just left a relationship and have to make a new claim foe unversial credit they told me. So i phoned unversial credit and there asking for sick notes. But esa and pip has said i dont need to be seen until 2024. But now unversial credit treating me as if i am not ill Is this correct. Someone else told me because i am in support group i should have to be seen by unversial credit

Hi, if you have already been through the ESA assessment your claim should be transferred under the "transitional protection" rules. You should write to your Job Coach in your Universal Credit Journal with the sentence "I have already been placed in the Support Group on my old-style Employment Support Allowance claim and under the rules of transitional protection I understand I do not need to submit a fit note or go through another Work Capability Assessment until (insert your review date here), could you please correct this for me? Many thanks" - feel free to copy and paste this, but make sure to add the date of your review where I have indicated to do so in brackets. It might also be worth taking a photo of your ESA award letter and send that to them also.

If you are living in the property or those assets are not available to you then you may be able to claim UC but it would entirely depend on your income assessment. You can get an idea before applying by using this website. benefits-calculator.turn2us.org.uk/
