I am the parent of two disabled teens, they both have both physical and mental health difficulties, and we have had two very different experiences with claiming PIP. With the older one, I completed the form on their behalf and supported them at the face to face assessment and were awarded first time without issue. My youngest I successfully claimed DLA on their behalf (middle rate care and higher rate mobility) when they first started really struggling and then last year I They turned 16 and so I completed the PIP form on their behalf to move to PIP. My youngest’s conditions are more complex than the older and their physical health much worse. Their mental health difficulties are still awaiting full diagnosis also. I supported them at the assessment in April (which they attended in their powered wheelchair since they can’t walk at all without aids and due to the stress of attending the assessment they could not have coped with the physical pain of trying to walk as well. Was awarded enhanced daily living (perfect, since their conditions have worsened and their needs increased since we claimed DLA), but nothing for mobility! So according to this assessor, they have gone from being virtually unable to walk when we claimed DLA, with worsening symptoms but now have no problems with mobility? I write to request a Mandatory Reconsideration, detailing and proving the outright lies in the assessor’s report (she claimed that several of my conditions were undiagnosed but they are diagnosed and she already had the evidence of this, which I copied again). She also claimed that because I am not prescribed any hugely strong painkillers or anxiety specific medications that I cannot be as bad as I claim. MR came back with no change whatsoever in the points. So I have just put in an appeal and gathering even more evidence while we wait to hear from the tribunal service.

@TS, thanks for the powerful information . I have multiple health issues and am on continuous prescription more than ten years now. I have a long time pain from a previous accident which is severe during cold weather, mental issues and diabetes. Because of my ill health, I work part time in health care. Have a feeling that my situation should be considered if the system was fair, but I feel like trying PIP is gonna be a time waste. Just creating another stress.

Would I lose my disability premiums that are paid with my job seekers allowance if I chose to move over to Universal Credit and If migrated across would a transitional payment cover disability payments?

Do you need to fill in a PIP assessment every 3 years? Our daughter receives PIP, and applied for it in February 2021. She was awarded it. However I am interested to find out if we need to go through that process again, and whether we will get the same assessor is another question. The reason for this question is that her health has not changed, in fact it has gotten worse since the last assessment.

Hi. I have a question, what happens when a person is unable to attend a face to face assessment because of health reasons, and the Independent Assessment team are unable to arrange a domiciliary visit, because the claiments diagnosis states that he/she is a "danger to themselves or others."

That should be taken up with 3rd party provider (eg Capita) as to why they wont visit, making sure that you have provided the evidence of the diagnosis directly to the 3rd party. Make a note of the reason they give. The DWP should also be informed of this if the 3rd party provider still refuse to make a home visit and the evidence provided to them also. If they still refuse and you dont end up having a visit and this affects the "decision" then you ask for mandatory reconsideration stating this, and then appeal if that doesnt work. Many decsions have been overturned at appeal for this reason, as long as you have the evidence.

@@StuartMcGoo this case has been overturned at the Independent Tribunal Court. The DWP stated in its submission to the Tribunal that they now accepted the reasons for the claiments failure to attend a face to face assessment. The DWP also stated to the Court that the claiments DLA had been reinstated and outstanding money had been paid, which they have not. Further telephone enquiries on behalf of the claiment with the DWP as to the outstanding money and a letter confirming the reinstatement of DLA, were answered verbally by the DWP, they effectually said that they had a further 18 days to reinstate/repay the claiments DLA. The Tribunal Service have been made aware of this and as far as the claiment is aware the appeal is still open. "Something is rotten in the state of Denmark methinks." 🇩🇰😶

@@Bigchurchmusic yes this is for the court to sort out really but they work at their own speed sadly. I would say this is news worthy if they havent already been to the papers. Apply as much pressure as possible from all angles. And yes the whole system is rotten, corrupt and not fit for purpose.

What if you are living with family temporarily therefore it is not your own environment. How would that affect an at home assessment?

Hi, its is not guaranteed that an assessment will be done at home, presently many are done over the phone and in some areas they do the assessment at job centres, but if they do choose to a home assessment it will be done wherever you are residing at the time.

it should make no difference to your claim where the assessment is carried out, as in they shouldn't treat your claim any differently or assess you any differently.

@@StuartMcGoo I called up to check where my form was after waiting 3 weeks. Turns out they decided I was not eligible for it as I have not been in the country for 2 of the last 3 years. But nobody told me. Also I was under the impression it was not a definite no. So I think I have to wait 2 years to apply.

@@peculiarpanther5434 Hi Heather, yes the residency rules for PIP have become more stringent but you should be able to apply once your residency status meets the minimum requirements. Unfortunately I am not up to speed on the current requirements for residency (even if you have a British passport) at the Home Office so you would need to check through gov.uk (if you haven't already). I will look into further guidance on this and see if I can find out anything further.
