It was said repeatedly; I don’t know what’s so hard to understand…college campuses have “codes of conduct” that are often much more strict than constitutional law. There are PLENTY of behaviors that are perfectly legal but not permitted on a college campus. If schools only enforced policies according to the law; every time a student got expelled, they would get arrested. This is not a confusing concept. Sunny knows this.

That is why universities in the South don’t have university sanctioned white supremacist groups despite their being many who wouldn’t hesitate to join among their student populations. So even if Sunny wanted to make this about the constitution, she would hit a brick wall when reminded of the fact the Supreme Court allows the government to impose guidelines and restrictions to universities who accept federal funds. She needs to read Title VI which says “No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.”

Universities have a code of conduct and have used them to take action when students say racist remarks. As a German, I need to explain a few things: first of all, there are daily protests against the actions of the Israely government in Gaza in many German cities, protected by german police, they are not forbidden. That's a myth, please inform yourself better. Videos of these protest can be found easily on RU-vid or Instagram, for example. What is outlawed in Germany, everywhere and at these protests, is hatespeech. Against jews, against muslims, against people pf color, against LGBTQ, against minorities in general. People who would say in Germany what Harvard students have publicly said would be arrested and would find themselves swiftly in front of a judge. And rightfully so. Germany has learned, from its history, that voilence starts with language, and that threats, hate and hateful speech, lead to worse things. Which is why that language, verbalized or in symbolic form like swastikas, is a crime in Germany. That might not be the American way, but it is one of the reasons, that many young Israelis, who don't like their Trumpian government, move to Berlin, not Washington.

As a former attorney, I absolutely concur. This was incredibly hard to watch. It seemed as if no one had any desire or interest in understanding the general law. Yes, so, technically, private universities can restrict free speech in ways that a public university may not, doing so would eliminate federal funds which are the lifeblood of universities, so practically speaking, they are sufficiently coerced to not abridge the first amendment rights.

This has been well documented and is expressed explicitly in the policies of many campuses. This is not about some technicality of the law that an attorney has special insight into but about the spirit of the law and if the rules are being differentially applied. This was a prime example of what happens when emotion overrides logic. It’s clear that Alyssa’s emotions on this subject over rode her even being able to hear the logic that Sunny was explaining. The fact Alyssa basically said that the college’s code of conduct should be able to go beyond the US constitution is enough to show she was letting her emotions override her talking points, because we have listened to her in many other topics put her logic first - mainly being when she is talking out against fellow republicans who get caught up in the Jan 6 Insurrection rhetoric.
Except that's not what Alyssa said. It's how Sunny (wrongly) interpreted Alyssa's argument. Alyssa is completely right when it comes to the University Codes of Conduct. Expelling or taking disciplinary action against a student who calls on genocide on campus does not violate the First Amendment because the First Amendment puts limits on the ability of the government to limit speech, not on businesses or other institutions. Alyssa never asked the colleges to go against the constitution. Sunny herself was defending the "Freedom of Association" and saying "It's consequences not cancel culture" when people were getting fired from their jobs for saying the smallest 'offensive' things... I guess she changes the way she interprets the law depending on the political argument she wants to make :(
