Biden to waive penalties for undocumented spouses of U.S. citizens
President Biden will announce plans to clear the way for hundreds of thousands of undocumented immigrants married to U.S. citizens to apply for legal residency.
About 500,000 undocumented spouses and 50,000 undocumented stepchildren of U.S. citizens are expected to be eligible to apply, according to a copy of the plan released by the White House and the Department of Homeland Security. To be eligible, immigrants must have lived in the United States for at least a decade as of Monday, have been married by that date, and meet other requirements. Their immigrant children must be under 21 to qualify, officials said.

I think has to file when USCIS announces the effective date of new program otherwise early applications will be automatically denied . Thats what says on USCIS website

This initiative is a key step toward fulfilling President Biden’s commitment to enhancing the immigration system. Here are the key details: Publication in the Federal Register: DHS will publish a notice in the Federal Register detailing the new Parole in Place process. This publication is necessary before the application process can officially begin and will include comprehensive information on eligibility requirements, the application process, and associated fees. Final Eligibility Requirements: Be present in the United States without admission or parole. Have been continuously present in the United States for at least 10 years as of June 17, 2024. Have a legally valid marriage to a U.S. citizen as of June 17, 2024. Have no disqualifying criminal convictions. Do not pose a threat to national security or public safety. Merit a favorable exercise of discretion. If granted parole, these individuals will be able to apply for lawful permanent residence without having to leave the United States for consular processing. Application Process: USCIS will begin accepting applications later this summer. It is important to note that USCIS will reject any filings received before the official start date. The application process will involve filing a specific form with USCIS, providing supporting documentation, and paying a required fee. Further details on the exact form and fee will be provided in the forthcoming Federal Register notice. Upon receipt of a properly filed parole request, USCIS will determine on a case-by-case basis whether to grant parole based on significant public benefit or urgent humanitarian reasons. DHS estimates that around 500,000 noncitizen spouses of U.S. citizens could be eligible for this process, with an average residence period in the United States of 23 years. Additionally, approximately 50,000 noncitizen children of these spouses may also be eligible for parole under this process.
