V39- Possession w/o Completion Certificate legal or illegal? S.17 RERA

One should not accept the offer of possession given by the builder without the project having Occupation (OC) and Completion Certificate (CC). One must seek CC, OC and assurance or undertaking from the builder to execute Registry post payment of all money. Refer to Section 17 and 19(10) of the RERA Act 2010 and Section 4(5) and 12 of the U.P. Apartment Act.
Registration of the Apartment is necessary before giving physical possession.
If Flat is accepted by an allotted without registry, OC and CC then he may have so many problems:
1. There shall be an issue in the transfer of the Apartment in future to another person.
2. There may be no loan against the project.
3. Insurance companies may reject your Insurance claim if in case you suffer bodily injuries in an under-construction project or loss to any property.
4. Car Insurance company may refuse repairs if in case there is any loss to the car within a project w/o OC and CC.

I am not accepting the FITOUT possession offerred by the builder. I have sent many emails asking for the OC to be received by the builder never replies to my emails. What should I do?

Builder is asking us to register while the whole project is not ready, as only 2 towers are ready of 30 plus towers. These 2 towers do not even have power or water.

Sir my fiance's brother bought a flat in his name and the property is under construction, and the OC has not received it. I want to add my fiance’s name or his mother's name can I add his name on the property before I receive oc? Could you please help me. Thanks

1:04 let me say it in the correct words as per the reality in India: A person can enter, take possession, live in an apartment without an OC, they just need to bribe the local politician, the police, the judiciary etc. Builder will commit a crime of not providing an OC and live freely till the end of his life because he knows he can bribe all three above...E.G: Supertech.

Sir ji, My father has purchased flat in 2002 and my flat no is 13 B but on CC they have mentioned only 13 number flat and we have 13 A & 13 B flat in the same building but no 13 number flat ... So is there is any way we can update CC ?

If commencement certificate lapsed and not renewed by builder. How it will affect to OC. Builder say 80% work done and OC will come in 3 months. Is it good to invest in such property. Bank also provide loan and without checking this document was not renewed by builder. How safe for buyers? From Maharashtra

Sir we signed allotment letter in September. We agreed to bought landlord's share from builder. But now registration process is getting delayed. And builder giving reason "this is legal validations and it might take time". Also we came to know that OC also just been recieved 2-3 days back. And also owner called us to come there places. But we are bit worried.( Might be landowner thinking to earn GST as OC received now) We are not sure, what would be good for us and how to go with now. And what are the points to keep in mind. How we gets aware for the wrong things that might happen

Sir in my case I have purchased a plot in a society devolper by a builder.They are offering me possession but not ready to get the property registered in my name and threatening me to impose penality from the offering date of possession.What papers should I demand from them before taking possession. (applicable in case of PLOT )

Stupid reasoning! Judgement of SC says possessor with sale agreement is OK to continue possession.

Yes. Refer to section 5(3) and 12 of UP Apartment Act and section 17 of Real Estate Act.

Answer is 'No' you can't stop a builder in India from committing crimes because he bribes the police, politicians and judiciary in that area. Very simple...corrupt law, corrupt politicians, corrupt country. If you get caught in a problem, you are stuck for life...Govts. will come, take bribes and go.

RERA is the most corrupt organizations of all in India. Then is the department that performs the OC check... they will never clear the OC of a building till their pockets are filled.
