I'm 36, 100% VA disabled, SSDI denied me even after they knew I had blown another disc in my lower back almost went paralyzed and had to have an emergency surgery because I listened to professionals who said I could 100% work, it's funny how experts at the court hearing apparently know your situation, the physical and mental aspect you deal with everyday
I think they want to act like parents dealing with their adult children. The old, “they know what’s best for ya” mentality. They don’t think a person as young as 36 should be out of work and on disability. This is a result of the faulty American system. You’re supposed to work 30-40 years (no matter what) then retire broken up and die. It’s not realistic in fact, it’s cruel, if not evil.

While it can be difficult to file a claim with the VA, your first stop should be with your Veteran Service Organization (VSO), such as the VFW. They have specialists who can cut through the red tape and help you present your disabilities in the best way. And it is free.

I represented myself to obtain my 100% VA disability and won my case! Dealing with Social Security was a complete nightmare! I applied twice and was flat out denied twice! I had an awesome attorney who won my SSDI case the 1st time around!!!!
Thank you; I’ve jumped through the VA hoops, & was recently rated total & permanent disabled by the VA with a rating of 100%; since it took over 20 years from discharge to reach this point…I’m thinking the application process for SSD would be just as challenging. From your commentary…it seems like it wouldn’t be that difficult.
Congrats Mark. It only took me 11yrs (90% 10yrs) and a lawyer to receive my 100% P&T. I appealed with the exact same medical records. I'm 320% with numerous items deferred,

Nobody will ever really know what we feel except our brothers and sisters in the military. It took me collectively almost 10 years to get full comp… all I can say is stick with it. By then it’s worth it, whether it’s these guys or your local vet center…get your rep and let them work for you, it’s free. All you have to do is go to all your claims appointments, wherever they may be outside your resident city…you have to make that effort. At the most you will sign some paperwork for your rep and come up with documents if they can’t get them through the va for some reason.. It must be different for those who don’t retire honorably (kicked out) or are medically discharged… I don’t know about that 🤷🏻♀️don’t give up…female Sgt talking….gl🙏🏽🙋🏻♀️👍🏽
lies, after 11 1 1/2 years, i was awarded 90% combined at retirement. the first month i did not get a military active duty check i was getting retirement and 90% va disability. 2 years later i was changed to 100% p&t and my wife put me on ssdi. i never filled out any disability paperwork. i was on ssdi in 3 months after the exam. it was all done for and to me and i did not have a choice because i was being kicked out and they made me have these benefits. they made mee take their medications and treatment. they forced me into their mental wards. i never did anything. it was automatic and i never paid anyone for help.

If i'm 100% P&T from the VA how easy would it be to take my paperwork to the Social Security Administration and they grant me with Social Security Disability? I heard people doing it. How easy is it. Or is it a long process like the VA?
SSDI is more difficult to get. You have to prove you can’t work because of functional limitations. With them you’re not disabled just because of you injuries, but based on how they limit you.
I just retired February 2020 after 26 years of service and was rated P & T by the VA. I wanted to go back to work but my physical issues would make it impossible for me to ho back to the workforce environment unless they cater to all my needs( PTSD, depression, Bilat knee problem with total knee replacement, L and C spine disks issues, sciatica, migraine, bilat hand surgeries, incontinence and more...). I am only 50 now. My question is am i eligible to apply for SSDI now and if yes when or is there a waiting period after retirement?
I got approved for ssdi in March of 2019 but got denied va benefits in September 2018. I got frustrated and didn't even appeal. Guess I'll get a lawyer too.....
@@isaiaslopez8974 ohh yeah man, apply for the easiest ones to get first ( tinnitus, depression, anxiety, migraines) once you get any of those approve you can build on it from there. I went from 0%, then got 10%, now 90%, in less than 2 years. I should be at 100 by end of this year. When you get deny for stuff; look for “ favorable findings “ those are your friends( stuff that help improve your case on an appeal)
I was told by the Social Security Department that it was useless to apply bc VA would deduct the same amount Social Security Disability would pay. Do any of you know this is true?
Is the Va able to deny a Unemployability claim (@ 70 % for PTSD, 70% for Anxiety, 70% Depression and 10% for an amputation to distal portion of left index finger = Va fuzzy math for total 70%). They are denying claim because I at the time of filing for SSD in 2003, I hadn’t disclosed my Military MST to anyone later when I applied for VA benefits my denial of unemployability they said no because I hadn’t listed in on my SSD claim
You are only 70% for mental health as you can only have one compensable mental health rating. PTSD/Anxiety/Depression are all mental heath ratings therefore they are combined.. How do they impact your ability to secure and maintain employment? That is the key to being approved for IU.
I was in the coast guard and I had some mental issues. Age shouldn't be a reason to not have SSDI benefits. When SS denied my application for SSDI, my last resort was to send SS the very same personal statements I sent to the VA regarding my military/combat-related PTSD, TBI and physical conditions, including supporting letters from some family members. In the end, the judge (via SS's written response) who looked further into my SSDI case even apologized due to how SS mishandled my case. So get a SS rep. Always have a rep, be it for the VA or SS.
@@mortikia07Next four? I don't get it. I applied once, got denied a few times until I sent them my VA personal statements as last resort. My case was approved after a few months. I guess, it's individual cases.

I currently receive ssdi and my 100% temporary disability from the VA just expired. They pushed me back to 30%. What's the next step to increase it and where do I go to get it started? I also have other ailments to add to the current knee replacement I had such as a total hip replacement and a double lung transplant that were both misdiagnosed by the VA. thanks
I used DAV for claims. I let them do all the work. Worked out for me finally 100%. Granted some DAV offices are better than others. The one in Massachusetts is one of the best. I'm comparing it to my other military friends in other states. I'd appeal something and usually less than a year I'd have an answer; unlike my friends it takes 5 or more years.

NSC Pension is means tested. Unless you SS amount is greater you will see no gain. You may want to see how your SS increases with retirement age. SS will also give you Medicare at 65.

@@beekaye1496 Ignore that idiot. I believe you can. 100% P&T allows you to still work. That 37k a year keeps you from drowning but you are by no means rich. I'd try to get 100% SSDI as well and I'd still want a part time job so I don't feel like a mooch. I want to be useful again.

So, I know I am a little late. But at the 8 minute mark, there is a statement that the VA disability and the SSDI stack up and it is untaxable. I collect from SSDI and the VA and my SS benefits is most definitely taxed. Is there a way for it to be non-taxable?
Kevin Ashley, thanks for your comment! Our area of expertise is in veterans benefits, not SSDI unfortunately. We recommend you reach out to your local Social Security office or an attorney who handles SSDI cases.
It's taxed if you are self-employed and earning (not passively) more than that is allowable. This program is for the very indigent. My SSDI and VA are tax-free hence, after the first year of filing (2017), I received a letter regarding the facts stated herein. In closing, I need not file federal and state tax forms any longer again, as long as I do not earn outside income! So, work for cash only.
