What is funny is that he didn't have 5/10 minutes to check through your driving history 😔 yet he had 15/20 minutes to agree with your reasonings and still fine you !? Then tell you that you can leave when you are ready 😮 how does that work !?
I’d appeal the fine, but I’d also be thinking about taking breaks at different places other than services. Also everywhere you stop to deliver…ask to use toilets before you go anywhere. 👍
Appeal it Hayley this has been a problem for years I've been a driver some 30 years and had similar conversations with police. There has never been enough safe overnight parking or day parking for lorries and they keep closing lay bys and trucks tops and still expect us to keep to the law of the road. £50 can be the difference between heating or eating for a week these days and we'll worth fighting for. If you do hope you took the registration of the truck in front of you you can use that as a barging chip they had obviously done the same as you driven around the park found no spaces so parked in a safe place.
And I will add that they will reject the appeal but will give you a chance to appeal the rejection which if you lodge it they will not contest it because it costs them more money than the fine! Yes, appeal and then appeal the rejection! Good luck!
I can guarantee if you had gone over on your driving time, DVSA would definitely disagree with what the officer said and you would get an infringement. Sounds like you have more knowledge of the rules than what he does. Stay safe out there
I was stopped by the DVSA and I had about 3 or 4 infringements on my tacho. I was only given a warning for 1 of them. So I would say they "can" be lenient. Coming from an international lorry driver from Ireland.
Good story Hayley. As a retired Traffic Officer, I am going to make some enquires. For now I would say, do nothing regarding that £50 penalty ticket. Same offence as Stopping on the Hard Shoulder but safer as it was the nonslip from the services. You may hear nothing more about it. If he was going to give you a ticket , the Officer would surely have tickets with him whilst on patrol. Why post it when you are there, having a conversation? I shall get back to you on here.
Hayley, I contacted a friend on your behalf. There is no £50 penalty we know of. Trouble is the motorway is controlled by the 'Special Roads Regulations' and hard shoulder parking is endorsable with 3 points with the code MW10.. Also Reg7(i) of The Motorway Traffic(England & Wales)Regs 1982. Rule 271 of Highway Code. The officer may have submitted a report back at the station or he may not have done anything. In your position , i would do nothing and sit back. You may have to wait 6 months until there is no possibility of further action. Please let us know in another blog what happens. Best wishes
Hi Haley I have left a couple of comments before relating to specific vlogs however this is just a general comment. I am commenting here because being of the older generation I don’t know how to message you otherwise. I was a bit late to the party actually. One of your videos popped up out of the blue as they do on you tube and I really enjoyed it and then took a look at your story which you should be very proud of. It was such a massive decision but one which appears to be working out for you because of your commitment and determination. Anyway I decided to go back to the beginning and watch your vlogs in order. I am up to number 20 now. I am glad I did and this is why. I have had my HGV licence since 1984 long before you were born 🙈🙈. I have just spent over 20 years driving tankers including ADR work. I am 62 and like you decided to sort my life/ work balance out. I recently quit my full time job and signed on with an agency to give me more flexibility with the days I wish to work. As you know you tell them weekly which days you are available. They know in advance and I can work 5 days 4 days whatever and everyone is happy. Now here’s the thing, my first agency job is on Class one curtain siders. Did a bit of it years ago but not much. I found your videos on opening the curtains and using ratchet straps really helpful. It proves the point that you mentioned. No matter how long you have been in this job wether it be six months or 40 years you cannot know or be an expert in every aspect of HGV driving. I would say to anybody in this job no matter how long you’ve been doing it if you aren’t sure just ask somebody. Once you’ve done it wrong it’s too late to ask. Someone once said to me that the silliest question you ask is the one you don’t ask if that makes sense. If you don’t ask it how can you know what to do. I want to echo what you said in one of your early videos on what you love about the job. You said you love the community and the family feel of the HGV life. Well your spot on because we all like to help each other and share our knowledge. If you’ve been somewhere and help with directions or done a particular task that you can advise somebody on most drivers are only to willing to help. There is always one prick in a rose bush but there you go. Don’t be afraid of sounding stupid. You won’t. The best thing is to ask and keep asking. Thanks for the tips Haley. You have believe it or not taught an old dog new tricks and I know that is the purpose of a lot of your videos. As I said I am really enjoying the videos and will let you know when I have watched them all if I ever get there 😃. Take care and I hope you keep enjoying the job and encouraging others like you do.
Hayley, i am a retired police officer and currently doing class1 work with chilled goods to RDC's. my advice is this. You have NOT committed a parking offence. so, if that is what you are charged or summoned with appeal it. You have however, straddled or crossed a solid white line and arguably that is an offence but defendable in your circumstances. if charged with that, i would appeal as the markings are worn and not actually solid. It is possible you get summoned or charged with causing an unnecessary obstruction. and iMO that is the offence that holds the most water here. Again i would appeal it as going over your hours is a far bigger sin as it were. imagine if you were involved in something that was most unpleasant and requiring lots of paper work, and it transpired you had exceeded your hours.......... the best thing you can do is appeal and consider making a formal complaint against this officer for malcious prosecution and as evidence yu can provide male drivers that have not been done where you have.

''area marked with chevrons bordered by solid white lines'' ''you MUST not enter except in an emergency'' Laws MT(E&W)R regs 5, 9, 10 & 16, MT(S)R regs 4, 8, 9 & 14, RTA sect 36 & TSRGD 10(1) He says it is defendable in her circumstances, but in reality it isn't because she is allowed to drive on and find a SAFE place to park even if this means going over her driving time. She has made a mistake and should just accept it and move on. The police officer has actually been lenient because it is actually an endorsable offence that carries 3 points.
Hiya Hayley. Love the vlogs as they come in. Reminds me of when I was coming home from Blackpool on the M6 motorway a few years ago. Hayley, you've just gotta be the best reminder about being careful on the road since the old PIF (Public Information Films) that started out at cinemas in the 1940s and came to our TV screens from the mid 50s. Hi Hayley, great video, as usual! You have received all the advice you need, but I would be in the dont appeal camp, especially if there consequences in losing. Black and white, you were breaking the law - it is utterly ridiculous and unfair what happened but you cant get away from the law was broken. You have been so helpful to me - next time I will carry on, take a printout and annotate it with reason for the infringement (which I would hate, but needs must) - because at least their is a theoretical mechanism in place to report a specific infringement,recognised in law. How that would stand up if queried by vosa I cant say but I think so long as it wasnt frequently occurring it would be accepted. You had absolutely no choice, devil and deep blue sea. Thank you for all your advice and humour - brilliant. And yes, I watched this mostly on a 30 break with 4 minutes driving time left and me begging the customer to allow me to stay on his yard, which, bless him, he did.

That fine thing has really wound me up !!! why is it today it's all about catching and fining normal people that try their hardest to stay within the law while the true criminals that don't care seem to carry on and get away with things. I don't understand the way authority thinks today. There's enough hate and hardship in this world without people in positions of authority using that 'power' to wield over their fellow workers that are trying to do a hard days work and stay within the law. This story has really annoyed me. No wonder there is so much hate and upset in this world. It's not about keeping the system running and ensuring the system works the best it can its all about taking any opportunity to get one over another and fine them and ruin there day !!!!! He could have just as effectively explained the law and what he felt you should have done. Absolutely no need to ruin your day and fine you when energy prices have just soared on top of everything else. Really sorry to hear this Hayley.

I'd have carried on to somewhere safer and then done a printout to keep . Also contacted the office by text ( when it's safe ) so that any confirmation text is then kept as to why you had to do it and then write all that on the infringement letter when they ask you to sign . ( can't you tell I've done it ) . If you're not a serial offender then all that documentation usually demonstrates that you did everything you could to park safely and 10 mins over the driving time is usually accepted.

This reminds me of the time I was out of driving time in heavy snow on the M20 in Kent so I pulled in to Maidstone Services only to find there was no parking spaces for my truck but there were empty spaces for coach parking but I was told if I park in the coach spaces I would get clamped and a £250 fine so I decided to carry on to Aylesford where I found somewhere to park and I did a printout to explain the circumstances of my action, thank goodness for night heaters

Hi Hayley, One of my m8s who's ex army is a driver and is constantly saying how poor the services and facilities are for lorry drivers in this country, for this police officer to tell you to break the law and go over time on your tacho is farcical. With your companies tracker evidence and the officer even admitting there were no spaces in the services I think you'd have a good case against paying the fine. Safe driving.
I would definiteley appeal that fine Hayley. What a jobs worth of an officer. If you have to go over your time with that situation again you can just do a print out and put on there that there was nowhere safe to park and that you had to continue to a safe area. One copy for you and one copy for the company and keep it with you for 28 days just in case you do get stopped by the DVSA.
I would try to have the option of 2 services to stop at in time, just gives you that buffer. In this situation, i would of carried on and done a printout. We all get infringements, it's just if you do get them rarely, then the DVSA will see you as a sensible driver and should turn a blind eye to it
So to summarize. You've struck up a friendship with a rapper no one has heard of. You found £2 and spent it on scratch cards. You bumped into someone you thought you knew, but didn't. A potential argument with a Hungarian truck driver turned into a pleasant conversation. A possible meet up with Trucker Jenko didn't happen because he was fast asleep and you ended your week by taking a very expensive piss. If you ever consider going into after dinner speaking, it might be wise to work on your material.
In the Netherlands you can go over your driving time to find a safe spot to park up if the services are full. It is by law regulated that you must park somewhere safe even if it means you go over your drivingtime. Just printout the tacho and wright the law article number and no safe parking space on it. It was explained to me on a tacho training by an officer of like the Dutch DVSA (ILT). Keep the printout with you for 28+1 days and you should be okay

Bad luck on getting the fine and yes I've been forced to pull up in some strange places but needs must on occasions and a couple of times I have had to stop at the very start or the very end of a hard shoulder by a roundabout. Popped over to see Michaels channel and he has some decent content so subbed him and said you'd sent me. All the best.
Hayley, I'd appeal it, record and document the process and next time appeal that to. BTW click in the passenger seat belt when not in use to shut that noise up.
Hayley I agree with the others who say you should appeal if you have the time.! I think if you relate the details the way you have on the video when the authority listen to the statement made by the officer they may overturn the the decision of the police officer. Best wishes Tim
100 percent appeal it you will win some police spend there day looking for someone to fine I was pulled up in a check one day the officer went to the passenger side so I had to take off my seat belt to go let him in he got in the truck checked everything which was all in order then tried to give me a ticket for not wearing a seat belt I appealed it and won stay safe out there
Hi Hayley can I suggest for cases like this you get yourself a body cam or a dash cam so at least you have a record of the conversations. It will keep you safer as a woman on your own. You will also have a personal record of any conversations with the police. The police these days are a law unto themselves and as a person that travels the length of the Uk too ( not a truck driver but large van driver ) it may one day serve to prove any discrepancy for you also if stopped by the police again record the officers warrant number they HAVE to provide it if asked and there name. For your own safety film it and keep a separate SD card to put it on. Appeal the fine ABSOLUTELY stay safe out there x I also subscribe to Jenko and Luck C ☺️

And the police wonder why they don't get support when you have coppers like that representing them .. You have tried to pull into the services and found no room and then pulled onto the slip road hard shoulder, I thought he could of said move on but you seem to have struck unlucky with a knob head.
You can go over your driving time to find a SAFE place to park, you just need to do a printout and write the reason on it, perfectly acceptable, the key words are ''no safe place to park'' You just cant make a habit of it , like say every week without fail.
I would've told the officer that the engine overheated and you had to pull over to let it cool down. Open the bonnet and splash some water on the floor and park wherever you like.
This is part of CPC test question. Question Simon had intended taking his break at the Orwell Truck Stop, but because of the traffic hold up, he will not get that far. Having been delayed for 45 minutes, by how much can he increase his driving period to get to a place to park? Answer Only to get to the nearest place to park safely for himself, the vehicle or the load: Yes Article 12 of EC 561/2006 allows the driver to reach a suitable stopping place to ensure the safety “of persons, of the vehicle or its load”. Seems quite a few need to read the actual motorway regulations, where you were stopped is part if the carriageway. Individuals opinions of safe or not is irrelevant, as is whether it is a hard shoulder or not. Clearly the officer did not understand this or he could have explained it a lot more clearly that the offence is stopping. Your only hope is he has used the wrong regulation if you are dealt with by ticket or summons, or if not hope your explanation leads to a conditional discharge. Pleading not guilty and being found guilty is likely to lead to a higher fine. This is not legal advice, see a solicitor. It is always possible you could receive a warning letter. The regulation, for those interested … Restriction on stopping 7.-(1) Subject to the following provisions of this Regulation, no vehicle shall stop or remain at rest on a carriageway. (2) Where it is necessary for a vehicle which is being driven on a carriageway to be stopped while it is on a motorway- (a)by reason of a breakdown or mechanical defect or lack of fuel, oil or water, required for the vehicle; or (b)by reason of any accident, illness or other emergency; or (c)to permit any person carried in or on the vehicle to recover or move any object which has fallen onto a motorway; or (d)to permit any person carried in or on the vehicle to give help which is required by any other person in any of the circumstances specified in the foregoing provisions of this paragraph, the vehicle shall, as soon and in so far as is reasonably practicable, be driven or moved off the carriageway on to, and may stop and remain at rest on, any hard shoulder which is contiguous to that carriageway. (3) (a) A vehicle which is at rest on a hard shoulder shall so far as is reasonably practicable be allowed to remain ·at rest on that hard shoulder in such a position only that no part of it or of the load carried thereby shall obstruct or be a cause of danger to vehicles using the carriageway. Sorry to hear about your experience with the police. It seems they aren’t able to use discretion any more. Many years ago I remember getting pulled in my car late at night going a little faster than I should have been, I apologised and was let off with a stern warning. Clearly from your experience that wouldn’t happen today. By the letter of the law you shouldn’t have parked there, but where else could you go without going over your hours 🤷♂️
The odd minor infringement for a few minutes is usually OK with a printout and explanation on the rear. I’ve had 2 in the last 7 years, just had to sign for them back at base and try my best not to make a habit of it.
Appeal that fine. Sounds like that copper was just dishing out fines to get his bonus. He shouldn't tell you to keep driving over your time that's wrong. Good luck.
If u over the break tine and no we’re to stop print the taco time out put a ring around the time and place no safe parking for my break that’s how it works keep safe
Hi Hayley... I've been driving a truck off and on since leaving the forces in 98.. My advice would be to pay up I know on a ethical stance what the copper did was totally unfair and uncalled for.. But once you have taken a day off from work (loss of pay) court fees if you lose.. Only time I would fight it is if they were putting points on your licence then it worth the fight... I've recently tried to fight against a case myself wish I'd never of bothered.. Even though there's a problem within the haulage industry for drivers it'll always be a money thing, drivers are easy targets.. This is why I get hacked off after a bit of driving a truck, running over your time is nothing but it's better not to do it of course.. Save yourself the hassle just pay the £50 through gritted teeth 🤣😡
This puts me off driving trucks. That's why I take photos.of everything I do when hooking up. So I have photographic evidence, timed and dated too. But I'm sure the police and Vosa wouldn't take notice? 🙄
Odd you did not get a TOR at the time, it’s a case of see what comes, assuming u passed the blue motorway board, you will have fallen under motorway regs so an appeal may not get anywhere. The only think to do is crack on to next safe spot and write on printout reason for exceeding 4.5 hrs. Compared to Europe the service station parking is a joke! Let’s hope next week is a more chilled affair!
I sympathise with you. When i started my current job (my first proper class 2 job) i had a few drops around south and southwest london then one at catford then the next was ashford. so off i set for ashford with over 1h30 driving time planing to stop on the m20 services. first one is full so i go on to the one at maidstone. thats full cant even get into the lorry park its so jammed up. so back on the m20 to go to the next junction thinking it wont be that far... (turns out its at least 20 miles) half way there tacho light comes on saying i have 15 mins left and i realise i had misread the tacho. got to asford international truck stop with minuetes to spare but they wouldnt let me in. so parked up on the side of the road along with 5 other lorries. Im 18 mins into my 30 min break and security come and tell me i cant stop there. I explain the situation and tell them i aint moving unless they call the old bill to sign my tacho saying i can go back onto the public road. They tell me there is a dvsa station at the bottomof the road with lorry parking and i have to go there so off i go and of course they wont let me park its for thier lorries. so im over my time and desperatly driving around the industrial estate looking for somewhere that isnt double yellows. eventualy i find a place get 15 mins into my 30 min break blow me same security gaurd tells me i have to move. By this point im getting hot under the collar and not being my usual calm self so he tells me to follow him and he will take me somewhere that i can park so finaly i managed to have my 30 min break wuth 25 min of extra driving over the time and odd breaks inbetween. to top it off 3 weeks later im stopped at a spot check. try explaining to a copper why i was near my driving limit but kept moving after haveing short breaks.
It's shit that you got a fine for this, I personally would of done the same rather than going over my drive time, I work nights and I've parked on motorway slip roads myself as do many other drivers I've never been bothered by any enforcement maybe they are more lenient during the night when it's quiet or I'm just lucky up to now 🤷♂️

I used to drive from Edinburgh to Manchester and return every night and the amount of foreign trucks parked up on hard shoulders and emergency lay bys they dont care about fines they just piss off back home and bugger the fines. Id appeal the fine as the police were trying to encourage you drive over your they're supposed uphold the law not encourage you to break it

With hindsight you could have said, "Thank goodness you are here, I have just had an air problem and had to stop quickly, could you escort me off the motorway"
Definitely appeal it, that officer was just one of those functionary's with a clipboard he was always always going to give you a fine. One more thing and this is vital info....what happened with the scratch cards.....any wins? 😂
I stop there when my option are limited I get this crap all the time I got multiple fines and I appeal against and it gets dropped you are a professional HGV driver make use of it don't give in to bad cops just like that the DVSA is in your side. Appeal it!
Hi Hayley that cop sounded awful…power gone to his head absolute jobsworth telling you 2 brake 1 law so to not break another ridiculous I would definitely appeal it and also Google Porta potti maybe you can have one of those in your Daf it’s basically a camping toilet…. draw the curtains do your business crack on with the day and keep on trucking

I would have thought he would have written out a ticket, he didn't so I will be shocked if you get a letter in the post If i come across traffic police will ask, the sad thing is everyone is going paperless example supermarkets do you want a receipt
i would appeal the fine would have got into more trouble if you had gone over your driving time and been in a accident or something --tells you --you can't park here but leave when your ready ---anyway good video drive safe
