How embarrassing that this man put on a suit and came to Los Angeles over a $1 cigar. The defendants had proof of the date which the incident occurred, and a valid police report to back up their claims. The plaintiff did not pay the full price for the cigar and he walked out of the store with the merchandise - that is stealing, and the store owner had every right to post his picture for his criminal behavior.

Yeah you can easily see the date on videos. You go to "properties" on the video and it tells you the date, time and the size of the file. Even phones from 2015/2016 would have that.

Most people who mistakenly short change a store and get called out for it are a little upset but they either pay or leave the product so his reaction tells a lot.

It’s very irrational to argue over a $1 cigar. He was definitely yelling at the man. I’m wondering if he spit on him while yelling as opposed to purposely hocking up spit. I suspect they reported him because they don’t want him in the store. He intimidated the owner’s family. They were trying to discourage him from coming there. But he is humiliated by his picture being up in his own neighborhood. He should have just apologized and made a gesture to repair the relationship.
Although I agree arguing with a store over 50 cents is retarded and karenish, him putting up a shoplifter picture is more than humilliating. It puts him at risk on the neighborhood.
Just a guess here : the witness was going to explain how the store owners kept changing prices on various items in the store, so that one week the cigar may be $0.99 and the next week it’s 3 for $1.00 !

This is simple, I walk in a store, check price of merchandise, doesn’t appeal to me, I just walk out and go somewhere else! No argument, no confrontation, no small claim court.
Because according to him he saw the picture in September, he said it had been there for 9 months. I think he is implying he didn't visit the store after the altercation in December until September of next year and that's when he saw that picture. And where as I think the plaintiff did act stupidly, the store owner was very vicious for putting up a picture of a frequent customer saying "Shoplifter" over a few cents, if he tried to leave with the cigar without paying the full price, they should have stopped him and not let him leave with the cigar, plaintiff may have been a male Karen but so we're the shopowners. The plaintiff may have been drunk that night or whatever, I don't know. But he certainly isn't that stupid coming to the national television because it did repair his "shoplifter" image a bit, atleast he was able to tell his side of the story. They lost a frequent customer over a few cents, but they also destroyed his reputation over a few cents, that's not the moral thing to do.

It's well known that small corner stores charge more than big supermarkets - I always say you're not so much paying for the product, your paying *for them to have it*. That's literally the business model. When I ran out of toothpaste at 11:00 PM on a Sunday, guess what, I'm paying an extra dollar or two (still cheaper than the dentist).

i have a customer like that. Said we were disgusting because we didn't have the product we wanted (COVID supply shortage). He still comes back and i brought it up to him and he doubled down on it. Wrinkly old man though so let it slide
I'd say the incident happened in March. He is wearing a t-shirt. I don't know where this took place; it may be Florida for all I know. But it's more likely than not that he is lying. The one fact no side disputes is that there was an incindent where he was annoyed so much by the price of the cigar that he was yelling. I work in retail and I have encountered that type of behaviour. Him throwing what he thinks is a fair price rings so true.
When I was a teenager I remember being in a McDonald's and the guy in front of me ordered a Big Mac, large fries, large shake and when it was time to pay, he just threw 30 cents on the counter and walked away. This was in the 80s.
Personally, I think its ridiculous that two grown-ass men are FIGHTING over a $1 cigar. This isn't some specialty store....its a dollar store. In my town, they have those on every block, almost. If you don't like how you are being treated at this particular store, I am QUITE sure there are about 50 others in your town, where you can purchase your cigars. It might not be as convenient to go to one of those, but at least you won't have to be irate and argumentative with the employee over a 67 cent differentiation on the price of a cigar. Its not about the amount of money! its a bout someone coming into your place and thinking they can do as the please! Let them walk into your house and steal something worth a quarter and see how you feel!
The obvious conclusion to me is that this man was going through personal problems and was angry already on the day with the cigar incident, he vented his frustrations about whatever else was going on when he went off about the price of the cigar. Now because he made a fool of himself he feels he has to stick to his guns and defend himself. And he’s channeling all of his frustration into this rather than trying to fix whatever made him so angry to begin with.
These are the type of people (the plaintiff) I hate encountering in retail. They would outright argue with the staff about the price if they find it expensive and even accused the staff of cheating the customers. They should have thought first that the staff is 100% not the one setting the price for the items it's the corporate or the owner. That's business if you dont agree on the price go elsewhere no one's forcing anyone to buy anything. In this situation since it's the owner serving him he could have just asked him to give him discount since he is a frequent customer or didnt buy at all.

As a person that has been a cashier/gas station clerk, waitress, and bartender...I can tell you, that this is the kind of guy that feels like Everytime he is expected to pay money for goods/services, he makes a huge stink (in the hopes that it'll be 'easier' to just let him have his way than to fight against his nonsensical behavior.) People like the plaintiff are the Lego under the foot of Everyone working in a position of service. He probably acted that way because he thought the cashier was illegal and wouldn't say anything or call the police. In addition, he's probably mad because they own a business in his neighborhood and don't look like him.
2 reasons, one of them is a theory. First is more views/clicks. 1 long video provides half the potential of views compared to 2 videos, which provides twice the views. Views equals money. 2nd one is the theory. I find myself more likely to click on a short video than a long one on average. Good example is the SCP genre of videos I watch. If I see two videos of interest. And one is 8 minutes, but the other is 20 minutes. I click the 8 minute first. I may not even remember the 2nd video once the first video is done. Same for "Today I Learned" or whatever it's called. If he posts a 20 minute video. Most time I will say to myself that I will watch it when I'm ready to dedicate 20 minutes to a video. Never watch it, but then watch his 9 minute video 30 mins after it comes out. So I think marketing has noticed this trend. Much more likely to get views on a 4 minute clip than a 10 minute clip. If it's interesting enough. You'll click on part 2 and give them twice, triple, etc. What a singular whole video would. I'm alright with it though. I wouldn't watch this show or it's current equivalent if it wasn't posted on RU-vid. And they used to just give random 3 minute clips with no beginning, end, or chronological order. So every clip left you going, where's the rest?! Now you just look for part 2.
They have the right to refuse his business, as they should. They also have the right to post his picture and way he is unwelcome as long as their is no libel issue. Further more and best is they get a restraining order against the man. Next time he comes in he gets arrested, if he keeps pushing they sue him for harassment and/or get him arrested.

Suing in *September* for image damages, for a picture hung in a single store from March or worse December prior - means that he suffered no impingement on his life.

Neither of them had any real evidence to back up their claims, so you have to just use your common sense on who you believe. I 100% believe the defendants in this case.
Even if he was telling the truth, he was clearly looking for a payout. There is no loss of reputation or finances so he didn't even have a case to begin with. Doesn't there usually need to be some kind of monetary loss for a defamation case? Otherwise we would all be in court wasting our time playing he said she said. I think this case was over the second we all saw the photo where you can barely tell it's him.
If this happened in December, as the plaintiff claims, why is he in a short sleeve T-Shirt? This happened in March as the defendant claims, plus the police report was filed in March. Judge Judy to the plaintiff's witness: "...what do you want...you weren't there...sit down..." LMAO

This guy reminds me of a customer we had to deal with while I was working as a cashier at dollar general. We asked him to leave because he made an aggressive remark to our manager after we told him he cannot drink the soda before paying for it. He became argumentative and police were called. He threatened my manger with, “ what tim you get off of work, I got something for your a**….” Police told him to leave and not come back and he still would.
We had a guy arguing about how a 75 cents piece of chocolate was overpriced. He tried to steal some. Working in customer service you quickly learn that someone doesn't need to look like a bum to have bum mentality lol.
