The US Supreme Court is poised to allow abortions in medical emergencies in Idaho, according to a copy of the opinion that was briefly posted on the court’s website. The decision would reinstate a lower court order that had ensured hospitals in the state could perform emergency abortions to protect the health of the mother. The briefly posted version indicated the majority will dismiss an appeal by Idaho without resolving the core issues in the case.

It’s hard to imagine a Supreme Court clerk, a member of one of the most hyper-ambitious subguilds within the entire legal profession, would risk everything on such a leak. If a clerk was involved (and I have no idea if that’s the case) it would have been with the knowledge of their Justice.

@@sevom89walker86 There was a similarly leaked document in the Dobbs case, also on abortion, a couple of years ago. The probability of there being two such leaks by different activist clerks in such a short period of time is vanishingly small. You get to be a Supreme Court clerk by being very bright, ambitious, and subservient. Not by showing what an effective activist or whistleblower you can be.

How exactly would you “accidentally” post a highly sensitive document? You’d have to be on a platform that would allow you to upload and share the document to people outside the scope of who can view it. Uploading is intentional and posting is intentional. So there’s at least two intentional steps that were required for this to happen.

@@matthewmoore7447 the platform was the Supreme Court website. While I’m 100% sure some websites can have differences, the process isn’t going to be insanely different other than a security factor, which would make accidental uploads even harder in this case. Yes it is possible for it to be an accident, but the likelihood is low in my opinion because it happened on the roe ruling, not that long ago. I would think since that leaked caused such an uproar, the protocol for uploading opinions, rulings, etc would have changed or been modified in order for it to not happen again.

Not this admin. This Supreme Court. The Executive Branch and the Judicial Branch are different. Then there's the Legislative Branch, which is Congress. While (as part of the system of system of Checks and Balances) the Executive Branch nominates judges to the Supreme Court and the Legislative Branch confirms them, all judges are STILL expected to be impartial and professional, no matter who held elected office when they were nominated and confirmed.
