The new amendment of the foreign sourced income tax in Thailand will impact any source of income from 01/01/2024 onwards. All tax residents will be impacted. I review the impact in this video thanks to KPMG and Mazars tax advisor documents.

My plan for retirement has gone from spending the majority of the year in Thailand to ensuring that I never reach 180 days a year. This will likely mean heading Vietnam or Malaysia for another 3 to 4 months before I return to the states. It's a bit annoying.

A hell of a lot of people regretting paying all that wasted money on the elite visa now and regret trusting Thailand, FDA will dry up causing serious economic problems

I have non O visa, retirement extension. I don't have a pension. I have a large stock of gold bullion in London and periodically sell a few kgs. Then send funds to Thailand. I don't pay capital gains in UK because I'm non resident. I guess I'm now well shafted...... Thankfully I've not invested in Thailand, I just spend and accept it's spent. If governments had fiscal discipline we would have inflation and higher gold prices. Taxing gold simply highlights the financial abuse of currency holders.

Maybe you could fly back to England once or twice per year, for a short holiday to visit family etc, and carry this gold back to Thailand in the form of a necklace etc, (and NOT be taxed on it) then sell it in Thailand for baht, instead of making the money transfer and being taxed on it?

In Australia, selling gold for a profit is not considered a capital gain for tax purposes.

If I were to retire next year and wish to purchase a condo, costs around 2M bht, so wiring this amount via banks I have to pay tax of 35% ... if yes Oh dear ... as 2M bht is may hard working pension which is already taxed and now being taxed again in Thailand? I might as well stay where I am now or look for another country rather than considering Thailand. Thanks for sharing Marc.

That's not true, though. Savings is not the same thing as income. If you earned the money in a year you weren't a Thai tax resident, then there's no issue at all. Also: it would be a pain in the ass to have to file a tax return in yet another country, but even if you theoretically would have taxable income (say from an overseas company) there's a good chance that you'll end up covered by a taxation treaty so that paying tax in the one country gives you a dollar-for-dollar/ Baht-for-Baht credit against the tax paid in the other country. The panic some expats feel is blown way out of proportion.

Real Estate prices in Thailand are at all time highs. I understand, when Chinese buy Condos here for money laundering, but why would you, if you can basically rent wherever you want for a more reasonable price?

@@asterisk911I don’t think that you are entirely correct with what you are saying. If people spend 180 or more days in Thailand per calendar year, they will be subject to Thai tax laws, so whatever money you receive into a Thai bank account in your name, you WILL be subject to tax on that money, weather it’s “savings” or earnings, at a rate up to 35%. You WILL have to provide proof to the Thai tax department as to exactly where that money came from and what overseas taxes were paid on it, then Thailand WILL subject you to, UP TO 35% tax in total on that money. So if you can prove that you were taxed on that money, in England at 25%, then Thailand WILL tax you UP TO 35% (in total), ie, an additional 10% tax gift to the Thai govt, on that money, so you WILL have to submit two tax returns in total, one for each country.

If married or have family, a Thai contact have them open an account and give you the debit card.

So here is an issue that I don't see anyone stating. Say someone says they have dual taxation and they won't be taxed for the income both in the USA and in Thailand. In this scenario what has always occured in other countries with dual taxation is that they tax you on the income (social security for example) and then tell you to go and get the money back from the country you file taxes in. A lot of expats on pensions will probably now have to do taxes in Thailand and pay for the income tax on their pension/social security, and then when they file their taxes in the country they come from the taxes they paid in Thailand will be deducted from the taxes they have to pay there.

the answer to all these questions is easy : let's get out of here within the next 180 days. You should never stay in a place where you are not welcome. I am here since more than ten years, with several properties and vehicles, I just put everything for sale ...

The details have been released. What's in question are the gray areas that are always in Thai policies. Thais love to keep out specific details in case they need to change things.

You are not qualified to speak on this issue. These amendments may or may not occur and it is pure speculation to assume that they would even be enforced. As with all things Thai they could change at any time

Actually, it’s an interpretation by someone in the revenue dept who in return put out an order. But this order is not a reform to the tax laws and will likely be challenged in court long before it’s ever implemented. So anyone worried about this and taking Tax advice from the 80,000 RU-vidrs who are capitalizing on this without having a law degree, are crazy.
