@@Wrestlingdad150 : That's not the way a criminal prosecution works. The prosecutor makes the decision on whether to dismiss criminal charges (in a civil case, yes she could drop her own case). I did find this.... but it is generally only agreed to by the DA because the case is deemed not winnable (that doesn't mean he did or did not do it.. just probably can't prove it". This excerpt is from KOCO News 5 ABC news back when it happened... "The protective order was filed in Payne County on July 5. In it, the woman Ferarri is accused of assaulting details what she said happened over the Fourth of July weekend. Ferrari’s lawyer told KOCO 5 that all the allegations are false. In the order, the woman wrote she was at a friend’s house when Ferrari showed up at the home (July 2nd). She wrote that he drove her home and told him to drop her off. She also wrote that he insisted he come inside to make sure she was safe. In the order, she wrote that she told Ferrari to sleep on the sofa but claims he instead followed her into the bedroom, began taking his clothes off and got into bed with her. In her request for a protective order, the woman wrote, "If the EPO wasn’t granted, it would make me feel defenseless." The woman reported what she said took place to Stillwater police on July 2. They confirm Ferrari is a suspect in a sexual assault allegation. Police said they are still gathering information and the case will be given to the Payne County District Attorney." If what he did wasn't consensual, it's definitely a crime. If it was consensual, then it is not a crime. Our criminal courts have the standard of beyond a reasonable doubt before we find someone guilty. However, that standard is not the same for most schools to expel someone. It is also not the same for civil cases of assault, battery, false imprisonment (preponderance of the evidence standard). It is also not the same standard for individuals to come to the conclusion that someone is a dirtbag. I personally don't know him or her, so I haven't drawn a personal conclusion without hearing more evidence. I find this case interesting, so I'll probably continue to follow any information that is released. Whoever turns out to be the victim here, there life will be forever changed, and I hope they are able to eventually recover from this.
