This was an AMAZING video mock to watch because it demonstrates the real life situation we go through when having to do through a deposition. I felt very positive after watching this and taking notes for similar questions and preparing myself for what they could ask me which was a lot of very similar questions you asked!
Excellent video Ms. Naomi. My deposition was via zoom and I try to be kind to people. The attorney taking the deposition was very nice. I himmed and hawd a couple of times trying to think of the answer and she said "take your time, we are no hurry here." I believe the deposition was about an hour. I always answered "Yes ma'am, yes sir," when asked a yes or no question. At present I received a letter stating that the insurance company will contact me with a final PD# after deposing the QME doctor. I hope and pray this eight year journey will end soon. Thank you so much for this video! My deposition is this week, and from watching this, I am so thankful that I have a lawyer, especially since my case involves at least 2 surgeries. If I would have been that lady, I would have been totally lost on that picture of her holding that kid, even though she's struggling with the kid being injured. Nice mock depo BTW!
Thanks Scott! Something you may not appreciate from watching the mock depo is the editing had to be cut that way for purposes of attention retention. Okay good video, but why was there a deposition in this case when, she wasn't denied and was receiving heath care and indemnity payments? And who requested it.
I watch your video a thousand times just to prepare myself for my deposition but the defense attorney keeps canceling my lawyer told me that they're not reliable whatever that means only workers comp I wonder if I'll even get a deposition I already finish my physical therapy after my surgery there's nothing on the schedule besides a qme coming up
Hi Edward, That sucks. It can be very frustrating if the defense keeps canceling. Especially because if it were the other way, the defense would be going to the judge to compel your attendance at the depo. The thing is that they are not required to do a depo at all so I don't think you can compel them. It usually will take place prior to your QME though. So maybe they still will do it. Good luck, Naomi

But undercover surveillance absolutely happens and a person in a vehicle can take photos of your public activities. Thanks for the question Anthony, Not every case will have one. For litigated cases i.e. where an injured workers have an attorney, I would say about 85% of cases have one at some point. The percentage is much lower for injuries without an attorney. Depositions can happen at any point. Normally they take place in CA work comp during the 90 day decision period or prior to your initial QME evaluation. But they can also happen later or again if you amend your claim to add more parts or if it has been some time since your first deposition or if they had just never called it and you are going to be going to trial. Hi Oscar, Thank you for your question. No, not every case will have a depo. Most cases are unlitigated ie just you and adjuster and the injury heals and you go back to work. Usually no depo. But if your injury is not that easy or you have trouble and get an attorney, good chance you'll get a depo. Probably about 90% of litigated cases have depos. Hope this helps, Naomi
