She cannot file 485. She needs to file 601 Waiver and then leave the country for consular processing. The easiest way for her would’ve been VAWA or Form I-360

Hello ma'am. I am a student of j1 SWT. In my DS2019 form, it says that the 2-year rule is not applied, but they wrote that the rule applies when printing a visa on the passport. Im married for 15 years 2 kids and they refuse my visa to get in back to the usa 🇺🇸 i cannot understand if i got approved on my i 601 A in side the us I did lose my family my business there now im stock in brazil 🇧🇷 no job to help my kids they ask me for help everyday i cannot do anything

@marcosmendonca2728 Estao dizendo que demora 22.5 meses Mas quando fui na minha intrevista I officers consular me fez 2 perguntas e refused my visa e me deu ums Carta dizendo que eu nao soube responder a pergunta agora minha familia nao tem que Comer estao passando dificudade Perdi uma inpresa de mais de 1 milhao de dolar tive que vender para min manter aqui no brazil estou no brazil 8 meses sem ver minha familia meu caso foi todo certo morando ai fui aprovado no form I 601 A

Eu ja tenho meu adivogado ai de Atlanta trabalhando no meu caso mas com certeza ela nao esta fazendo o trabalho direito porque ela tinha que saber deste I 601 waiver dentro do usa voutei ao brazil com esperanca de receber meu visto e meu greencard quando chengondo em solo americano Agora estou no meu pais de origen nem falar direito o portugues nao falo morei em usa 20 anos Presiso de ajudar se voce souber de ouguem responsavel obrigado

@@MarceloPires-kb8qp , pelo que estou entendendo, o advogado que está cuidando do seu caso não tem muito entendimento em casos que precisam de um perdão para legalizar. E provavelmente não te orientou adequadamente para sua entrevista no consulado. O pior de tudo são seus negócios , sua vida e sua família estarem prejudicadas por ainda não ter conseguido retornar. Talvez seria interessante consultar um outro advogado de imigração especializado em waiver para te ajudar. É sempre bom ter outra opinião. Sei de dois escritórios especialistas em waivers para processo de legalização. Um nos Estados Unidos e outro no Brasil. Talvez vale a pena pelo menos conversar.
