What is Deferred Adjudication

Deferred adjudication is a special type of probation. The judge finds that there is enough evidence to find you guilty, but doesn't find you guilty. The good side of deferred adjudication is that if you successfully complete it, your case gets dismissed and in many cases you can have your record sealed. The bad part is that, in Texas, if you violate any terms of your deferred adjudication, the state can ask the judge to find you guilty and sentence you to the maximum punishment available for the charge.
Deferred adjudication is usually a good deal if you're going to take your probation seriously because it can keep your case from following you around for the rest of your life.

Is it worth taking deferred adjudication on a family violence case? My attorney said an affirmative finding of family violence didn’t really matter. So far I haven’t had trouble getting jobs that only look for convictions.

I caught a misdeneanor dwi in texas but i have a past felony dui in california, will Texas enhance my misdemeanor dwi to a felony because of my past dui in California ? Texas offered me 2yrs probation with Deferred Ajudication

Texas can use a dwi/dui in another state to enhance to DWI 2nd. They should have told you whether you’re being charged with a 1st or 2nd DWI. They may not have seen the old DWI. If you get another DWI, it can still be enhanced to a felony if this one doesn’t get dismissed and the CA case wasn’t dismissed.

Yes, but you’ll need to obtain a moral waiver. The military is one of those government entities that can see all records including deferred adjudication, juvenile, sealed, and expunged ones. The thing about deferred adjudication is that it looks so much better on records than a conviction, so your chances of having the moral waiver approved isn’t unlikely.
