Finding these videos very informative and helpful. Thanks for making them. I'm sure it helps your clients better understand the situation they are in and what might happen along the way. Knowing what to expect and being able to plan ahead is very helpful and helps calm anxiety that clients likely have. Plus it means clients can find answers about simple questions without having to call your office incessantly. Other attorneys might think about doing this sort of thing bc I imagine it pays off for you, not only helping clients but helping bring business as well.

I was on Deferred Adjudication for a Class A misdemeanor of Domestic Assault when I was 17 for one year in TX. I completed my probation without a problem no violations. I'm now 40yo and it's still on my record. What happened and how do I get it removed and sealed? I obviously don't have the records from back then. I only from out about this a few years ago from a job search background check.

Judges can give you deferred adjudication for certain criminal cases. Your only risk is that the judge may not do it and you run the risk of being convicted. Let me know if we can help!

So I got placed on deffered adjudication probation for 4 years and ill be finnaly off here next month after 4 long years and I'm eligible for a expungment do I still have to wait a waiting period time to expunge it after I'm completely off probation?

I was on probation for aggravated assault with a deadly weapon i got 2 MTR's for dirty UA's finally finished probation 2 years ago will I be able to get a apartment or do I need to get my case sealed?

It depends on what charge you were on deferred for - you should not have to wait unless it was domestic violence related. Hope this helps

@@davidleonard7696 not an attorney but I have researched a lot of stuff so I will offer what I know. As the atty here already said, you don't have a waiting period. However, if you really want to know you're good to go, just go to a place like academy and tell them you're interested in purchasing a gun. They will first have you fill out some forms and then run your name thru a system which will tell them you're ok. There is no charge for them to do that and at least then you know you're clear to move forward.

Not an attorney but I would imagine if your case has been dismissed as a result of completing everything and didn't result in a conviction, you should be good UNLESS by law there is some sort of waiting period (I'm not a gun dealer either). When you go to purchase a firearm they do a background check of sorts. Please don't ask anyone else to buy one for you as that is illegal. I bought a gun a few mo back at Academy and I bet those guys at the counter might have an idea. I can try to ask a friend of mine that is VERY knowledgeable on gun laws (and also works selling firearms). If I find out I will come back to update.

I’m finishing my deferred probation now for Agg Assault W/Deadly Weapon (literally got in a fight with my roommate). Will I be able to change careers with ease now? I’ve been a mechanic for years but want to move to a white collar job and the record has been an obvious set back. I know violent crimes can’t be expunged.

I got 2yr deffered, me and my Army buddy got into a fight 2018. I Just applied for Fed ex and it popped up, Going through the motions now to see will they still let me get on. If not I'll pay the money to get it expunged.

I was indicted over a year ago. Nothing has come of my case. It’s a 3rd degree felony. First offense. I’m a veteran and a paramedic. I’m on pre trial probation through the court with my bond have passed all my UAs and not been in trouble at all since my arrest . What is the likelihood of getting offered deferred for my first felony? It’s a non violent crime. My paid lawyer seems annoyed with me so we haven’t been able to talk much.

Hey. Thank for the great info. However I do have a couple questions. I got deferred probation for a theft of firearm. Felony. But The first one is when getting off of deferred probation is there any documentation to show that you have been released? My PO said that I didn’t need to sign or do anything regarding the release of my probation. We had my last probation meeting and that was it. She never called or emailed me again after our last meeting. & my second question is, im currently trying to apply to jobs. Do I need to select “yes” when it says have you been convicted of a felony within 5-10 years?? Thank you. Hope I hear back!

no. The case will be dismissed and then you will have to wait 5 years and you can file for a non-disclosure to seal your record

Yes, if you take a deferred adjudication, the military will still be able to see the original arrest on your criminal record. Hope this information is helpful to you.

@@Tj-556 if you completed a deferred adjudication probation you could apply for a non-disclosure and that would seal your record. The military might still be able to see the arrest but should not hold that against you.

I’m reporting for my first time at in a week with a urine analysis. I have thc in my system but have stopped for about a week. How likely is it that I will get locked up for my first dirty UA?

Unless you admit to drug use, they will have to send it out for lab testing to confirm it. That will ensure you will not be arrested when you report. After the lab result comes back, they will likely make you do a weekend in jail or modify your outpatient treatment, or put you on outpatient treatment.

Hey man hope you’re doing well with ur Probation. I failed multiple UAs because I’m a bigger guy and my PO knew that it was harder for me to clear my system. She put me in drug classes and did whatever she could to extend the time for me to get a clean UA. BIT I made sure she knew that I was trying my hardest to get it outta my stem. But you have to commit to it. No smoking or doing drugs EVER while on probation. (She was a blessing and not everyone’s PO will take such steps to provide a better way for you to get clean.) this is my experience. But they shouldn’t take you straight to jail because you failed. COMMUNICATE EVERYTHING REGARDING YOUR SOBRIETY WITH UR PO. ( IN MY EXPERIENCE)

@@ltbaby1998 not really. I had a job for the first year of my probation and then Covid happened and she never followed up after that and I was doing under the table stuff during Covid but she never asked me about it. my situation is kinda wonky. Like I said in my other comment I got BLESSED asf.

Not usually. But remember, they are always keeping score. If you mess up enough times, they use all of it against you in court.

@@Slayer_Habit was it a felony or misdemeanor? To my understanding, a misdemeanor like this shouldn't prevent you at all and a felony like this might not either, assuming your charge was dismissed upon successful completion of everything. You don't have to have your record sealed for purposes of purchasing a gun. However, you might think to do that to prevent employers or landlords from seeing the arrest/charge and being legally able to deny its existence when you fill out forms (its called an Order of Nondisclosure). As far as your other question, police and state licensing agencies will ALWAYS be able to see the charge/arrest from the past. Just fyi- the only way to completely have it removed is if the charge was dismissed by the state before it went to trial OR you are found not guilty. In that case, you would get it "expunged". Since this is NOT your case for either of those outcomes, the best and only option to "remove" things as much as possible is to get an Order of Nondisclosure. If you search online you can find "how to's" and all the forms and instructions to do it and file w the state. However, I will say the instructions seem a bit confusing (I've never done it myself). There is a fee involved to file w the court, I believe it's a couple hundred or more. If you want it done right and efficiently, having an attorney do it is your best option but of course that will cost you. Any criminal law atty should be able to do that, just call around. I am NOT an attorney and this is for cases in the state of Texas, so if you're in another state you'll have to see how they do it bc states each have their own laws and this only applies to situations that happened in Texas. Hope that helps.
