Greetings. I am law student. I think the UCC does not apply to family law, as art. 2 explains, transaction of the sales of goods. If two brothers were to be doing business together, they would be treated as business men.

Not sure what you mean but you might be referring to when a party assigns its performance obligations under a contract to someone else. The question you might be asking is whether the other party to the contract can get assurances that the assignee will perform without prejudice to their rights against the assignor.

J, it is a law that applies to certain types of transactions. It might help to think about it this way: if you are driving on a highway, the speed limit on that highway applies to you. If you are not driving on a local road, a different speed limit will apply. Similarly, the UCC applies to certain types of business transactions. For example, the UCC will likely apply to a transaction for the sale of goods. However, the UCC will probably not apply to a sale of land.

No, the UCC is unrelated to the law of the sea (if I understand your question correctly). It's just a business law that different states in the United States enacted and the laws are generally similar from state to state. Nope. UCC is not an "international commercial code". And I assume most of the remainder of what you wrote was intended as a joke, sadly some people fall to these hoaxes. Here is an example of one state's version of the UCC: www.nysenate.gov/legislation/laws/UCC Other state's versions are similar. If you are looking for an international law that applies to the sale of goods you may be thinking of the CISG: Convention on the International Sale of Goods.

No. The US is not under admiral law. The US did pass laws in 1871 to protect the rights of freed slaves. These laws infuriated (and continue to infuriate) people who wish to subjugate people of different skin color. That law is unrelated to the UCC, which is simply a model law. The first state to enact the UCC was Pennsylvania in 1953. The UCC has nothing to do with laws that were passed to protect freed slaves decades earlier. All of these law are available online and in your library.

Not the UCC but the closest equivalent which affects numerous countries, including many European states (but not the UK) is the UN Convention on the International Sale of Goods (CISG). The CISG is an international treaty and also a body of contract law. Countries that sign the CISG agree that their courts will apply the CISG to contracts for the international sale of goods. For example, if we have a contract for the sale of goods between a business entity in a European country and a business entity in the United States, the CISG would apply provided both countries signed the CISG. The business entities could agree that a different body of contract law should apply but the default rule would be that the CISG governs the contract. The CISG is similar to the UCC in that it tries to provide a uniform law when parties in different jurisdictions enter into contracts to sell goods.

+HerrPorinski No sorry I didn't explain correctly. The UCC is only a US law (domestic). The CISG is an international treaty that applies CISG contract law. But the UK did not ratify the CISG.

+HerrPorinski Well, the UK has its own laws. If I understand your question correctly for domestic law you would just need to look at English contract law (and Irish or Scottish contract law because I believe there are some differences from English contract law but I'm not sure).

CON, the UCC is state law. States have their own versions of the UCC, although by definition each version is identical or nearly identical. For example, you can find New York's version of the UCC here: codes.findlaw.com/ny/uniform-commercial-code/. The UCC is not a national law, rather, it is a model law that almost every state has adopted in whole or in part. For the same reason you will not find your state laws on drunk driving in the Constitution, you won't find your state's version of the UCC in the Constitution, either.
