Thank you. I was hurt this past week doing the same thing I always do at work. There's some fishy communication going on between the doctors, worker's comp and myself. I think you helped me decide to seek council. The last thing I want is for my injury to get worse than it already is by returning to work sooner than I was originally directed.

Keep in mind that it is difficult to “find” malice or incompetence in a work comp case I currently have 2 open cases from the same job And there was plenty of fishy things going on.. my lawyer is the best in this area

I have permanent damage to my arm which hurts my career pretty bad but also endless possibilities neurologically. My head was literally split into 2. Skull and everything i died twice and luckily ended up in a coma when they put my head back together. 1 year later i am becoming somewhat human again. Stay positive! I could sit around and be depressed or make the most of what i can.

Wow, what you been through sounds awful.. makes my injury look like nothin'.. but, the sciatica associated with the other injury is awfully painful & I lay on floor vocally expressing my pain & my dog comes lay with me & eventually, I "okay" again but, it is very painful at times & Work Comp don't give a shit & settlements don't consider this.. which is too bad😢

I was an RN for 20yrs was injured at work, 7 surgeries later a permanently total disability. My WC settlement was maybe half of what I made in one year. I lost everything! My career that I loved. I stared college in high school, knew what I wanted to be from a very early age. I had worked for the same company for 17+ years in a highly specialized field. I had zero 0 write ups, never even a warning. I was in management but still loved direct patient care and was out helping my staff when I was injured. Also a mother of 3 young children. I now struggle each month to make ends meet and provide for my kids on disability and continue to suffer daily, awake at 2am because I'm hurting too bad to sleep tonight and most nights. I'm a shell of the mother, sister friend and daughter that I once was. I promise my settlement doesn't touch what I've lost and continue to lose. Idk who the people are out there "getting rich" off of workman's comp case's. I can promise you that they aren't RNs from Oklahoma!!

You are 100% correct Rita. Worker’s Comp. is a compromise. You don’t have to prove that the company did anything wrong but your damages are capped. It is always better not to get hurt especially not to get seriously hurt. Even if you get a substantial settlement or trial result, it’s just not worth it. You may have several jobs in your life and several chances to file a workers comp case or sue somebody, but you only get one body. Your health is the most important thing. God bless you and I hope you and your family are OK.

@@DeSalvoLaw Your absolutely right. You can get heart, liver, kidney, lung, face, uterus transplants but your spine and brain are one use only! I caution every health care work I come in contact with. I truly miss my job, I loved it so much. I continued to try and come back to work asap after each surgery. I got more and more limitations until I was told there was not a position that could accommodate all my limitations nor could I work with my medicine regimen. I have nothing bad to say about the company or ppl I worked work they bent over backwards to try to help me. I was at the point that my mind couldn't imagine at 38. I pay for every single thing I do with pain unimaginable pain. If it wasn't for my amazing 3 kiddos I would have probably given up and in. But for them I try I fail alot and I pray everyday that I can be 1% of the mom I used to be 😪. Thank you for your response and bless you for helping ppl navigate workman's comp it is very hard to navigate did sure!! Have a blessed day ❤️

I am a security officer for a hospital, I was attacked by a mental health patient when he went into a psychotic episode and decided he wanted to kill the ER doctor. I stopped him, but I didn’t realize he had a black belt in martial arts and he elbowed me in my left temple. Damaged my left eye, broke my nose in 5 places, and suffered a concussion. I have been treated like I’m scum of the earth by the workers comp insurance people, I was also told to return to work the following Monday before I had ever even seen medical provider for my injuries, while having a broken nose, two black eyes, and a concussion.

I’ve got a labral tear in my shoulder that happened 5/23/22. I was finally taken out of work bc I do heavy lifting all night 9/6/22. Comp carrier turned surgery down twice that my doc was requesting. Put in a 3 level review of my sergical regulations. Still waiting to this day to approve my surgery. Hopefully soon!

What do you think about a meniscus tear? Most likely getting surgery to have it cleaned up. Been doing PT for a cpl weeks. I make 19 a hour mandatory 8 hours of OT ever other week.

What about sustaining 3 herniated disc In workers comp injury but also a personal injury due to the negligence of a third party individual could that be a high settlement for workers comp?

I am using an iPhone attached to a Movo VXR10 Universal Video Microphone. It give really great audio. But...I lost the connector and have to buy a new one. The audio is noisy without it. I could fix it in psot production, but who wants an extra step if I can avoid it, right?

Missouri workman comp sucks . My husband got severely injured on the job in 2020 here it is 2022 (2 )shoulder surgeries later . One just recently in May and all this time only gotten two workman comp checks . He can’t lift his arm nave 40 degree , can’t wipe his behind has to use his left arm for everything . Now left shoulder having issues . We trace one way 110 miles to his doctor . No gas checks either. Our attorney has pushed just last month for back pay of workman comp checks again . But it took over a year for another surgery to be appoved . In that time he saw two other surgeons who stated his first surgery was a failed surgery so this second surgery took 4 and 1/2 hours to repair and he left with permanently restrictions. He 64 and can’t retire for at least 2 1/2 years so hopefully settlement soon as he will be discharged with Max medical improvement at 48% loss of shoulder . Workman comp offered 13,000 what a joke

I crashed on duty on a police motorcycle. I broke my clavicle, scapula, four ribs, ankle and top of foot. They operated on my clavicle, ankle and foot. One year still off work getting PT and I walk with a limp and have limited range in my arm/shoulder. I hope they don’t medically retire me.

Usually not. Usually it is just based on severity and permanence of the injury and your hourly rate. Actually, how much you make per week.

​@@DeSalvoLawWould like to sit down with you, and discuss your representation of my back injury. They say slight rupture to annual disk, but I am in absolute pain. Often at night (laying down) on any drive over 50 miles or just sitting and transitioning to standing. They've sent me to therapy and therapist says it's my piriformis muscle pressing against the sciatic nerve and causes the pain. I'm always in pain. They can't do injections because I am diabetic and it will shoot my blood sugar sky high risking possible serve conditions. To top all of this out, my company doesn't have a light duty structure, I'm a local truck driver who operates machinery while making deliveries. My company has paid or allowed me to receive the W.C. which I should be getting. Fell backwards out my truck 2/22 and nothing has helped. Bottom line is I am in need of a very good people's Attorney. I have a knee injury from a previous injury at this smashed into my knee in 10/21 which really hasn't been the same since. Banged up and suffering. Now they my company what's to assign or lend me out to another company to work at. Please help 🙏 me. I am in the suburbs of Chicago

I have been out since December of last 2022.. almost 10.months.. neurosurgeon says i need a 3 tier fuse..l3-4 l4-5 l5s1 and talk i might not return and they refuse the surgery just this wwek getting a lawyer.. full time drive. Hurt in job work comp dont want to pay surgery.. if when i have surgery it going be if..if i can return 15 months.. what degree of compensation im looking at

The share holders and the the sister company have decided to close the company and take profit. Leaving everyone to have to find a new job. But my case was expected by the insurance company and am receiving the benefits. But it is bound to have an impact to my case some how if the company permanently closes?

Your case is moving into settlement position. Now, you go back to work and if you are able to work, then pretty soon, your case can be settlede. I always like to wait 2 months with my client back at work to make sure they really can do the work. If so, you should be getting paid soon. So that's good.

Depends on what state you are in and what your medical outcome is. Some people who hav e asingle level fusion in their low back have a great result anbd some can neer return to work. So it isn't just a single number based on medical procedure. You need to know the medical outcome because that drives value in Workers Comp. A lumbar fusion is a serious injury case. I recently got hurt I work, I fell off a wobbly ladder reaching for toilet paper.. I fell on my left wrist and broke it there were no supervisors so I called my boss told her what happened and she said she was going to call her boss, her boss the owner said " tell the girl to say she fell at home and I'll pay her hospital bill... Can they get introuble for even saying that?? Obviously I told the truth . But now I don't even know how to look at that man 😔🥺

I WAS INJURED ON THE JOB. I WAS REAR ENDED ON THE HIGHWAY. THE ORTHOPEDIC SURGEON DECIDED AGAINST OPERATING STATING THAT IT PROBABLY WOULDN'T HELP. HE SENT ME BACK TO WORK WITH PERMANENT RESTRICTIONS.THEY FIRED ME SAYING THAT I DIDN'T RETURN TO WORK AFTER FML.

Hey I have a question, I been pushing carts at a grocery store in Pennsylvania, I was just wondering would would happen about nerve damage or tendinitis, bc last Saturday I was pushing carts until I got a sharp pain in my forearm, I was almost in tears because of the tension towards it, it’s from my finger to elbow and I’m getting check out tomorrow, I’m 17 and not sure what could happen, my forearm is bruised a little and my hand shakes when I move it down but not up, I jus don’t know if I could get work comp for this or not.

Man, if I could be 17 again… my suggestion, without being too harsh on you young man…is to consider toughening up a bit! I know this could indeed be a legitimate injury, but at your age, it should be just a minor problem. Go to the gym, eat right and nurse the injury properly, but unlikely it’s a serious problem you can’t recover from. When I was 17, I worked produce, bagged groceries, rounded up carts if asked to help, any time of year, rain, snow, hot sun. I later worked for a moving company and then joined the Navy…worker’s comp my fricken eye!!! Toughen up a bit, you’ve got a long life ahead and sure don’t want to be weak. Sorry to hear of your cart mishap though, try to be more careful going forward.

Ignore naysayers. If you felt a sharp pain, get to a doctor. If it is a strain, then it is nothing major. If it is something more serious you will be DAMED GLAD you followed up right away. Delaying treatment is the #1 case killer, and I talk to people every month who delayed medical care and it killed or really hurt their case. Insurance companies LOVE IT when people delay, because then, they argue "why did he walk around in pain for 3 months if he got hurt at work" and that allows them to win cases they should have to pay on. I have lots of ways to fix the damages, which is why I say "Talk to a lawyer right away! And never delay medical care!"

It can. It means you’re prone to injury if you have a problem with that body part due to a work related injury. It makes it more likely that you will get hurt and have nerve involvement. Not a good find medically but a good finding when we are trying to prove an injury

They are basically firing you because they can’t accommodate you. Under Illinois law you would be entitled to benefits. We would have to determine whether you can do any other work and perhaps turn the case into a wage differential case. Best thing to do is call me at 312-500-4500

I live in Illinois, 07/2020 I had a job accident, I needed to have surgery in one of my R knee 2020 and in December 2020 I had another surgery of my L shoulder after PT on 08/21 and after en MRI and me feeling still pain and weakness I found out still had Rotate cuff, so I went for 2nd surgery 02/25/22, after months of PT still feel pain,weakness and can't lift my arm more than my shoulder level. Resolt= RC again, now they said shoulder replacement surgery 3rth one, with I'm not sure😞😞

Hi sir I being in workers comp for 3 years already the first year on injections for a herniated disc and lots of therapy for my back. Shoulder and wrist. After the year of injections my doctor recommended surgery on my back and my shoulder workers comp approved a small surgery on my back to remove whatever was leaking from the disc and after that surgery I was still on pain. Then the Dr. Recommended back surgery fusion L5-S1 I get that surgery done back in December 2021 now 6 months after the surgery I'm still in pain and workers comp never approved a surgery for my shoulder that the dr. Recommended and requested from workers comp I'm still in therapy for my back pain. Do you think I have a good case?

At 16 I was in a very bad accident at work in Washington state covered by L and i. I have had 5 hip surgeries, and now going to have to get both hips replaced. I broke my elbow had to get surgery and remove a piece of bone. I have 2 bulged discs in my neck, 2 in my middle back, and 1 in my low back which is causing flattening to the spinal cord which I’ll be getting surgery on. And then a minor tear in my left meniscus. This happened when I was 16, I’m now turning 21 and still not done with all this. Any idea of what the end result may look like settlement wise or any other things I might qualify for? No one ever talks to me about it so not sure what to expect. Thanks for your time.

I’m sure it sounds like you have a lawyer. You have an absolute right to know what’s going on in the case and all that. Seriously. You’re an adult now. No one should hold anything back from you. Arrange for a face-to-face or zoom meeting with your attorneys. Write down all of your questions on a piece of paper before the meeting so you don’t forget anything. Bring the piece of paper with you and make sure they answer all of your questions.

I know they can’t say what the end will exactly look like but you would think they could look at similar claims and at least give me an estimate. But I’m no lawyer. I work at Walmart DC and I hurt my wrist/thumb tendon doing regular work following the protocols they gave us for lifting which caused my injury. It’s been 4 weeks I can’t open my hand. They send me to doc but doc did NO examination just prescribed pills which didn’t help. Now they have me on lightwork pushing brooms but that requires both hands as well which doesn’t help the injury but makes it worse.

They are covered and the key is cogintive testing to establish the injury. A good lawyer can retain an expert who will run tests to substantiate the problems to protect the value of the case.

I was terminated while on WORKER COMP. We are settling but I'm confused on how long they should have been paying for SDI. Should it have been up to the term date or the settlement date? I was sent home from work 10/2019 and forced onto medical leave. It expired which led to termination 07/2021. I had 0 income after 12 months of SDI from 2020-2021 then they started to pay workers comp benefits. But a whole year without any monies from anywhere and pleading for help with living expenses. I feel they should have penalties as well. Am I wrong? Im in CA.

Depends on the case, but you usually end up with more with a lawyer. Especially if you get a good one. Lol. If you have a case that’s unwinnable that can get dismissed.automatically a lawyer may or may not be able to help you. There are no promises in life.

In similar cases of mine, you've worked on, about how much does workers compensation settlement offer???I would like an idea of a fair settlement amount, dr stated, "further treatment may be needed and recommmended exercises" up to 35 lbs weight restrictions, but sometimes I feel some pain when open a heavy door like at a hospital, if a 1,200 page book in the size of 81/2 by 11 inch weighing 5lb. So, here’s my question: I work in law enforcement for 23yrs & I’m 45yrs old. Last year april 20th I was sucker-punched by an arrestee I was fingerprinting. This sucker-punch broke my upper jaw, knocked out my front tooth, knocked the teeth next to my front out of Alignment, split my upper lip in half to the point where I had to get over 20 stitches in my upper lip. My jaw was also broken. After I was hit my body went in to shock instantly. My front tooth fell in to my Covid mask & then I put it in to the garbage can. I then went after the offender & judo tossed him across the floor. I held him down while my partner called for help. I broke my the “radial head” of my elbow as I was fighting him. The offender was able to get to his feet & he still attacked me even though he was covered in my blood. My partner watched me fight this guy for about 1min & 30 seconds after I was hit. My partner is a coward. He stood by & held a roll of toilet tissue as this guy tried to kill me. I have the video of the incident & my extremely graphic injuries. I’ve been diagnosed with ptsd & I just found out I need surgery on my back. I need anterior C3-4 cervical discectomy & fusion for the front of my neck & posterior cervical C3-7 back of the neck laminectomy & fusion surgery. I’ve been doing physical therapy for almost a year & nothing has help me. I just got the diagnosis on my back about 3days ago. I’m looking to have surgery in about a month in a half. What do you think my case is worth? I’m in chicago. My doctor told me I have over 300pgs of documented injuries. Thanks in advance. Also, I’m on Workmancomp & now I’m trying to get disability from the city. I’m currently dealing with Gallagher Bassett. My lawyer has given me no idea on the type of settlement I may receive. Chicago police have a different system, not Worker’s Comp.. Chicago police officers are exempt from the standard Worker’s Comp. system. Best thing to do is to call me 312-500-4500

I’m currently dealing with Gallagher Bassett myself and they’ve been running me through the ringer with 2nd opinions and prolonging my case. I just seen my doctor for my final evaluation and he says I’m at 15% permanent partial disability and now my workmen’s comp worker is saying that is extraordinary high and want to send me in for ANOTHER 2nd opinion!! It’s ridiculous!! 15% is EXTRAORDINARILY high are you serious?! I had shoulder surgery and I’m not 100%, still have issues with heavy lifting, after continued use, 15-30 minutes depending on what I’m doing, I still have sharp pain and aches and fatigue and have to rest it. I did physical therapy and a 6 week work conditioning program which did help improve my shoulder immensely but again I’m not at 100%. This injury occurred in August of 21 and it’s now November of 22. I don’t what to do at this point and I feel like these 2nd opinion Dr’s are biased and work in the interests of the workmen’s comp.

I tore my rotator cuff back in January and haven't worked since. I'm getting bi weekly payments, my surgery was postponed due to having severe diabetes. When my A1c is low enough the surgeon will operate. Is this worth a settlement since it's been going on for 7 months ? $21.50 hour at 40 hrs per week

That’s a good case but if you work for the railroad that’s Federal workers ‘ comp. Very few lawyers do federal workers ‘ comp. They’ve created a system where they’ve made it so that no lawyers want to help injured federal workers.

I have a question could it be possible for me to sue my company. I work in the tire industry as a tire tech . I Currently have a dislocated knee from having a 400lb tire that fell against my knee and fell on top of my leg. I am currently physically disabled ( I can’t physically stand up and do anything for myself) .It was cause by a salesman who was operating a hydraulic crane to lift the tire ( clearly he lacked proper training and knowledge on how to work the equipment) he did not know how to correctly control the crane and cause the crane to launch forward at me causing the incident . Would it be even possible for this to be considered a case ? Please respond thank you

If you are in the USA, most States have laws which require you to file a Workers Comp claim, not a law suit. Id say that if you are disbaled, it makes sense to get a free conulst from a lawyer right away.

How severe is a concision case? I just turned 20 I was hurt at a job site on the 3rd of January. Getting struck by a telecommunication utility pole. and was rushed to the hospital 1hr later after my injury that day. My employer put me on workers comp. Federal employees are covered under federal workers comp. It is a completely separate system from state run programs. Virtually all other employees are covered by state workers comp. Federal workers comp is very bureaucratic and lawyers are not involved in the process. It is hard to find a lawyer, who will help you or will fight for you.

Hey I work in Louisiana at a university and I’m an engineer I was on a ladder trying to reset and fix a unit that was inoperable,my job doesn’t supply us with proper ppe so I had to use what I had but long story short I fell off the ladder and tore my labrum on 9-13-22 and I just had surgery 3-29-23 and on top of all this I have another full time job that was my main job where I receive my benefits from for myself and my family how does this work 0:02

My case has lasted 5 yrs this may...with neck,back,shoulders, development of scoliosis ,nerve damage etc. My Dr. Says 70% impairment (insurance agreed to 68%). However due to my low wage on the job offered me 25k. Is it normal for a claim to result in low settlements with severe long term damage?

The whole thing is based on your average weekly wage. But with serious permanent injuries, there are things like wage differenital awards, total permanet rating and open medical that might help. Dependws on your situation and what State you got hurt in. Call if you have questions 312-500-4500.

Good afternoon I been fighting my case for four years I’ve had 7 surgery’s to my foot nerve damage and unfortunately doctors said they would recommend I get an ankle amputation my back was also damaged too they don’t want to take responsibility for my back my work comp payments stopped over a year ago they offered 25k starving me out my lawyer never answers calls I know I am getting jerked it’s so mentally and physically frustrating! Ok I drive trucks. I was unloading my truck at a landfill then on the site I slipped and fell trying to reach the door handle to get into my truck on the muddy scale. Fell on tailbone head shoulder and back. Ok long story short this happened may 21/ 2021 I was getting workers comp starting around the end of June 2021 then they stopped me oct 20/21 due to a crocked doctor so now my case still going on they tried to offer me 75k already and I refuse it but I need surgery MRI clearly found my lumbar spine L3-4 L5-S1 and my C-6 and C-7 needs fusions so tell me why the hell going on. The medical director done approved everything already I'm just waiting on the insurance company now. I need my benefits

A lot of times the best help a lawyer can give you is early on in your case to make sure all your ducks are in a row. I’ll put it to you this way: if you’re playing in the Super Bowl, do you want Tom Brady throwing touchdown passes for you for the entire game, or are you gonna put them on the bench and just bring them in in the fourth quarter or it might be too late to win the game?

Different States do it different ways. In Illinois, it is based on the body part and percent of disability for that body part. Each body part corresponds to a number of weeks, so if you are determined to have a disability which corresponds to 60 weeks, and your reimbursement rate for PPD is $1,000, then that would be $60,000.00

Hi. Long story short my husband had a 25lb industrial light fall approximately 30 feet hitting the top of his head. The cable broke and he was just in the wrong place at the wrong time. He did everything he was supposed to do. Was wearing the proper equipment ect. He sustained a buldging disc in his neck and also to the left of his L4 and right of his L5 S1. So 3 different spots total. He is scheduled to get cortisone shots in all places to see if that helps his pain. He also has pain shooting down leg and also middle fingers on both hands are numb. When he got hit he also possibly suffered a mild concussion because other coworkers stated he was not making any since when talking/explaining what had happened. Do we have a high dollar case by chance? And if so, do you possibly have a ballpark estimate by your experience and similar cases? Thanks for your time. God bless.

The more permanent and serious, the injuries, the bigger the case. The more money you make per week, the bigger the case. I would say your husband stands a chance of having a substantial case. The bigger the case, the more you’re gonna want a lawyer to make sure you get everything you need. All the medical treatment. A lot of times the insurance company tries to cut the injured worker off and send them back to work too early. You don’t want that to happen. You need a doctor who’s on your side and a lawyer who’s on your side. @Law Office Of Scott D. DeSalvo, LLC I appreciate the reply and the advice. He has not missed too much work due to him having a supervisor position that allows him to take it kind of easy. But instead of giving an MRI immediately they sent him through PT before anything else and now I'm afraid he has permanent nerve damage. 😞 Does him continuing to go to work ruin any chances of anything? Also, we did get a personal lawyer. So im glad we did that by the sounds of things.

Can a IME doctor examine any other body parts on you other than the ones that you had injured? For instance I injured my shoulder and knee , had surgery On both , had a IME and the doctor examined my neck and shoulder. What are your thoughts

Yes, they can examine you beyond the single part of the body in Illinois. Many times, shoulder pain comes from apinched nerve in the neck, for example. This is called referred or radiating pain and they want to examine and test the neck and shoulder to see where the source of the pain really is.

I just settled for 5,000 and after everyone else got there cut I was left with 2,500, My lawyer gave me the option go to trail, but said it will make more sense just to take the $2500, it was the only allowed for a left hip sprain I feel he could have did way better what do you think?

Yeah man. Without all the facts and the details it’s hard to really say what’s up with that. If you can live with it and you’re ready to MoveOn then maybe that’s best for a hip sprain. A lot of lawyers look for the easy way out. The easy payday.

Can an employer fire you if you collect workers comp? When you fill out a workers comp form it asks you for your attorney info..if you don’t have an attorney yet, can you go ahead & fill out the form anyway & then when you find an attorney, give them the info?

I did a video on this, but here's ther short answer: it is against Federal Law for them to retaliate against you for filing a Workers Comp case. HOWEVER...(There's always abut...) they can fire you for other reasons or made up resons unless you are in a Union or have a written contract. Some State laws on that are better for employees than others. In 'right to work' States, they can fire you for any reason and no reason. SOunds bad but they rarely fire people for filing a WORKERS COMP these days. Yes, you can file a case without a lawyer and yes, it is ok to tell them you do not have a lawyer yet. But this info may make them want to take advantage of you. IT IS ALMOST ALWAYS BETTER TO HAVE A LAWYER. Or at least to get a free consult with one.
