Some cases should get pushed to trial. Most cases should get worked up, maximize the case strength and value, and then, if the Defense is reasonable, resolve. But there is a third category of cases most lawyers will never tell you about but you need to hear this.
Lawyers may not always disclose the full strategy behind handling challenging workers comp cases to their clients. Even in cases where the injury is minor, lawyers may still opt to pursue compensation for their clients, despite the relatively low monetary value. Rather than immediately resorting to trial, lawyers often prefer to present evidence to the opposing party to encourage settlement negotiations.
Pushing a case to trial can lead to a defensive posture from the opposing side, potentially resulting in prolonged proceedings and uncertain outcomes. Delaying resolution in certain cases, especially those with smaller monetary values or technical defenses, can sometimes prompt the insurance company to reconsider and offer a settlement at a later stage.

I do not understand how a injured workers rights are taken away when they are injured on the job. I was told that it is against the law for anyone to wave you of your rights . But workers comp as that right. That’s purely a cooked perverked law. 😡

They defend the cases by denying that the accident happened or claiming that your injuries came from some other incident, or that you are exaggerating, your injuries, or that you’re not hurt at all or that you’re not hurt as seriously as you say. They have no problems paying doctors thousands of dollars to write reports saying those things. all to save the insurance companies money. That’s why you need a lawyer who knows the law and works hard to get you your benefits after any kind of injury. 312-500-4500.

If i may ask a question Why do temp companies not have to give any benefits Or even pay when someone who is injured And never give paid days off And don’t care or take care of you when something is d ng r ios at the jib site And etc…. Ive worked for several And what I’ve seen is they don’t give you enough work when so that they don’t they can say you are not a full time worker Yet they say you are their employee and cant even take a side job from any of the companies that you worked through them for And always trying to hire new employees often through a feigned promotion for new workers from older current workers when they say there isnt enough work for the workers who actually work They put the heat on you if you try to not take a jo that is not afe And why is it they are recently in the news about putting underage migrant workers at risk or even worse to cover the corporations

@@Flokiboys Depends on the type of case and your jurisdiction. But here, I bring a Motion to get their attention so they know they have to respond. Call your lawyer and ask him ro explain it to you. After all, they are gonna get paid on your case at some point, make them earn it!

My case got well seasoned. 2 years of going to doctors. And turning down offers. In the end it paid off about to get 4x as much money just waiting. I look at like chess. Just waiting and knowing in the end you'll win. Just cant rush the process snd have to deal with whatever move the opponent or insurnace plays. Hang in there and trust the process!

I've been waiting 6 years, and my lawyers are terrible at communicating with me or following up when the tell me they will. 6 years and they're telling me their asking for what seems like 1/4 or less than what would be expected.

That's nice of you to help people. I cant file workers comp but wish I knew about it. I didn't know how bad it was until the pain got overbearing my mouth hurts. I been injured for 17months my first lawyer hardly responded to any of my emails on my 14 month I fired her .I had no change since my initial injury even though I had a witness and a truck camera .I finally got the approval for surgery it’s been a battle I’m hoping I get something to take care of me for awhile cause it’s life changing!

I have been on workman’s comp since Oct of 2019.July of 2021 I had a total knee replacement on my right leg.I have low back pain and I need some medical attention on my leg knee. I have an IME on Dec 6. My lawyer is asking me to settle for just my knee replacement and my pay. My first lawyer only wrote up the claim that I injured only my right knee. I hired a second lawyer the first of this year.The back doctor and the orthopedic doctor will not give my lawyer the documentation they need to get me help. Should I settle or go for medical help using my own insurance. I would like to go to the Bar to see if my first Lawyer misrepresented me. My injury happened when I was loading my Box truck. I fell between the loading dock and the truck. The truck has diamond plate lift gate my left leg went to the ground and my right leg stayed on a 3 ft x 3 ft bridge plate.Comp is saying that those are not part of claim.Please advise if possible Thank you

My lawyer just one hour ago he told me to search for a job at worforce That they REQUIRED. Hut I am on permanent Disability by SSD. Wtf He was about settle the case, now he asking me search for a job? This is wrong Definitely my lawyer misleading my case instead to get settlement and done wrap this all shit out. If i get better I will search on my own. Not to pushing me Crazy They want obviously, so this is corrupted, he wants me to lose my SSD benefits! Probably Your advice. If you are good Take it over. My finger was Smashed and degloved and other finger was broken and now have wrist problems... dominant hand...this past fall... on a Hydraulic trash truck As I was training a new employee on a roll off truck... He wasn't even drug check as he was involved in the accident I was life flown to out of state hospital . To save my hand they amputated half of my finger. Now 3months late finally starting physical therapy... WC put me to temp control work light duty before therapy ... month and a half ago...wtf? Wish you were in Iowa

Thanks for your information. I had a slip and fall accident at a bank while delivering checks to the bank for my employer. I broke my wrist (ulna and radius), so I went to be the nearest ER. A few days later, I went into surgery, and now I'm getting physical therapy but I'm concern that my wrist will never be the same but at the same time I don't want to sue them because I think when we settled this injury and the partial disability will come up and hopefully then they can give me a reasonable offer. So far, my employer's insurance has paid for my sick leave and loss wages and medical bills. So we're on good terms. Plus I like my job so eventually I want to go back to work. Is the attorney necessary?

It is based on your Average Weekly Wage. You are supposed to get paid 2/3 of your salary while off work with dr note. Then at the end of the case, you get a lump sum of money based on Avewrage Weekly Wage and how permanent your injry is. How about a hearing loss . I had an injury at work with an air compressor, and it blew a high-pressure and loud noise into my right ear . Plus hired another attorney since the company tried giving me a final written warning without any verbal or written warnings prior . So I refuse to sign and pretty sure they're retaliating and harassing me since I put a claim on the company.

I live in Chalmette, La. my attorney provided the Worker's comp attorney personal and attorney-client privilege information and then made a mistake and forwarded me every email. Before he knew he had made such an error, he dropped me as a client. I didn't want to receive the settlement he had agreed upon. I received a call from the defense Worker's Comp attorney the following day admitting my attorney gave him information that's the only reason he was aware of it. Immediately afterward he then asked if was I interested in receiving the settlement they agreed upon. With stipulations applied and now I didn't have to worry about attorney fees. Please direct me in the way I can receive immediate help.

Hi Addonis: Sorry to hear that happened. If you already settled your case without a lawyer, what help are you looking for? If the lawyer's msitake did not result in a bad outcome or lost money, then his mistake caused not enough damages to sue for legal malpractice.

In any injury a case, you can receive immediate help by calling and hiring a lawyer. Call me if you have questions or want to talk 312-500-4500 Unless papers are signed you are usually not required to go through with a settlement you don’t want. Your situation might be different. The settlement your lawyer negotiated might be fair under the law or it might not be fair. That’s why you need to talk to a lawyer to reevaluate everything about the case to put a value on it. They can’t be done over the phone. It requires ordering all the medical records understanding the local law all that stuff. It requires legal work to make sure your rights are protected and your recovery is fair.

Well, you need an attorney. It is likely if your husband‘s case has been going on this long, you are represented by an attorney. You really need to talk to your attorney, make him or her aware of the situation and discuss strategies. There is often other evidence other than your husband‘s testimony they can use to prove the case. Even after a compensable consequence case, like in a auto accident on his way for a medical appointment for an Industrial Wall Falling on him injury. IC Attorney withholds suspended medical appointment records from the WC Judge. And stating injuries to IW Neck and Back, is now caused by the personal injury Auto Accident and not the Original Industrial Wall falling Accident. The IC attorney knew it was also a work comp injury. But trying so hard to get a C&R signed. Who can you trust? Smells of bad faith to me. Two neck and one low back operation and continued fusion from C3 to T2-T3 to be scheduled.

I think you mean whether they have to hold your job open under FMLA. If your work status changes from light stuy to full disability, yes, they have to pay you your TTD. Aloha! Do you have license in hawaii ? We have no works compensation attorneys here seems like ! Only 1 WC per town so what happened to me first appointment at WC doctor was 2 months later ER hospital 🏥 gave me only 3 days off work note I had to work with my torn ligaments for 2 months before I was able to see my the WC doctor than staid home 2 weeks and on Christmas management asked how I’m doing I didn’t want to lose job to be home on most busiest days In Christmas manager said bring doctor release note stupid me did it worked 2 days they fired me exactly on Christmas Day the December 25th !!! I made another appointment with WC doctor again it took 2 months for an appointment and WC insurance didn’t pay me for the 2 months until I saw the doctor to get the note even the doctor understood i was injured 4 months already so he gave me note from the 2 months prior and the WC insurance declined that ! Any physical therapy or MRI no response finally after 8 months got MRI confirmed its torn ligaments so 8 months ago had to be much worse because now I’m home no work but before employer made me work 2 plus months with injury where this stands . I feel there is a lot of done wrong because they know there is no attorney who takes WC in Hawaii also it’s billionaires club they have the best attorneys. Thank you for any help!

Nvm all the attorneys in hawaii no one wants to help.. i did all i could alone without any law school called the labor board, wrote governor, called the works comp several times a day . Got paid 4 months back !!! Even all attorneys said I wouldn’t get back pay.. I solved my problem on my own same as my citizenship paid $3000 to attorney he did nothing just was a mil man before he called i got all ready in envelope to mail .. it’s same with doctors here in USA they just book you to fill up their schedule they don’t care how you feel !! I had pain in stomach fever 6 days went to doctors he said im ok didn’t even look at my stomach !!! Where the world is going .. most attorneys I called they declined me because didn’t get surgery yet so not enough money for them 🙄

An insurance company can TELL you that your case is over or they are closing their file or things liek that. But, only the Court can really dismiss your case. Sounds like you do not have a lawyer, and you should, if they are playing these games with you. Call me if you need help 312-500-4500.

Because the minute you’re released to work and your workers comp case is over they can fire you for any reason in most states. Did rather not have a seriously injured worker around.

The first thing you have to do is hire a good lawyer, familiar with the law in your state. No, none of this is simple enough to definitively answer in every case in a RU-vid video or a comment section. If you’re struggling in your case, I highly recommend you talk to an experienced lawyer in in your area with a history of winning.

I had a trip and fall in Feb. The company only wanted me to see their "Doctors" by doing this they also didn't tell the state work comp. They never had me sign my work comp rights or panel doctor document. I demanded that work comp get informed because I was seeing a chiropractor and needed everything documented. I ended up seeing a doctor not on the panel, the company insurance (Sentry) asked me why, I told them I wanted the best doctor, not one that was signing me off without reason. Their ortho said he thought I had nerve damage in my back but refused to send me for testing and returned me to work. .. my ortho (who is a back specialist, the company sent me to a lower limb specialist). sent me for testing I pulled? injured my SI joint. I have had 2 injections and I'm on the mend, but the company EMT told the new EMT that the goal was always to keep things in house, so nothing gets reported to work comp or OSHA. The EMT's are to do everything to make sure employees do not go to the local hospital. ( I was told this directly) The goal is also no loss time incidents. They have covered up 3rd degree burns, broken bones, you name it. The company nurse made the decision to cancel the ambulance on a man with compartment syndrome. The best thing I can say is when a company claims they are 100% about safety and their employees, it means they will cover up injuries and refuse to fix unsafe conditions and in the end fire you for reporting the issues.

My lawyer agreed to a settlement agreement workmans comp in Ca. with the wokman comp insurer. for lump sum on Jan 11th been 4 plus month and still havent recieved it. I dont understand the delay. I talked to the lawyer 5 weeks ago on April 11th. and he said 2 to 3 weeks. Been 5 weeks and still nothing. Is this normal. I thought once you agreed to settlement agreement shortly after the insurance company pays out what they agreed upon. Or is the delay in writing up the settlement agreement. I'm SO confused and stressed.

There are dozens of reasons for a settlement hold up. The only one who can tell you what the delay is, your is your current lawyer. Your current lawyer is getting paid by you. He or she is making money off your case. Call them back and ask for a clear explanation. There’s no excuse for somebody who’s getting paid out of your case to keep you in the dark. If the guy is getting paid, make him give you answers.

True, They lie too and your job lies too and get away with it!😢 Had 3 surgeries already and needed 2 more surgeries haven't worked over 4 months I have restrictions accommodations that were given to me to return back to work cause me more pain I was taking pain meds on the job that wasn't helping because I was doing half a pill at a time that I was supposed to be taking at work anyway it was hard for me to complete a 4-Hour shift I couldn't even complete a full week do the severe pain and what they had me doing cause more pain and I wasn't even doing the accommodations that I was told I was going to be doing in a meeting that we had I truly believe they know I wasn't going to be able to do that accommodation my restrictions cuz one of the headaches even said she didn't think I was going to be able to do the accommodations what day offered I really wish I could talk to you and ask some questions

Why would any ethical lawyer take on a case on application? Considering that disability attorneys work for a percentage of the back pay settlement, it would seem to me there would be ZERO incentive for the attorney to settle the case quickly. Wise up people.... do the initial application yourself, and if you get approved you won't have to share your back pay settlement!!! Only call in an attorney after youve been denied at least once.

Tom, thanks for watching and commenting. But with due respect, your advice on here is bad and dangerous. I will tell you why. And it is an example of why taking advice from non-lawyers is a big mistake. You are talking about Social Security Disability cases, not Civil Personal Injury cases or Workers Comp cases. In Social Security Disability cases, which I do not handle, you are right -- it doesn't make sense to hire a lawyer until you have been initially denied by Social Security. BUT IN WORKERS COMP AND CAR CRASH AND OTHER CIVIL PERSONAL INJURY CASES, THAT IS TERRIBLE, TERRIBLE ADVICE. Talking to a lawyer right away is the best thing you can possibly do. Most of the people who watch my channel have Workers Comp or car crash, dog bite, bar fight, medical malpractice, nursing home abuse, etc. Cases of that nature. And their BEST MOVE is to do a free consultation as soon as possible after an injury. In these kinds of cases, insurance is setting traps for people from DAY ONE, and a regular working person better know what to look for, or better yet, have someone on their side. Workers compensation cases are so gray .. i been dealing with my case for 1 yr and barely gettting treated . My adjuster is always lagging with responses and treatment . My lawyer never knows whats going on until i call and complain . I feel stuck with this situation and with a lawyer that doesnt seem to really fight for my rights

It depends on what state you are in and whether you’re in a Worker’s Comp. or third-party case. It depends on whether you have health insurance or not or whether you have Medicare or Medicaid to help pay your bills. Usually it’s a bad idea to pay your bills out of pocket Unless your credit rating is critical like you’re right in the middle of buying a house or a car or some thing. Yeap in Texas they don’t care about us and are very corrupt. I got smashed with an excavator into to the back end of a trailer and I need surgery in multiple places in my spine and now I have Radiculopathy and many more injuries etc. smh this isn’t what I expected with 2 children in elementary.

Yes, and I'll tell you why: Do you notice I never look at the camera and keep my entire focus on the road? Yep. My eyes and attenion are on the road at all times. That's why I do not use notes or a script. So it is no different than a phone call or conversation with a friend in the car. I actually record videos without the camera recording a lot because I do not even look at the phone at any point. Lol.
