Public defenders aren’t the same as court appointed indigent defense. When somebody says “court appointed attorney,” that usually means any lawyer that gets hired per case for some extra money. A public defender has a full time government job doing criminal defense for those who can’t afford attorneys. It is the true counterpart to a prosecutor’s office. If you get a public defender, you’ve got somebody who cares but is overworked. If you get a court appointed lawyer, you’re just getting somebody doing it for a bit of extra cash.
So the Court-Appointed Lawyers has an obligation to help me, but how do I sue him if he does a bad job if I would not have taken a Court-Appointed Lawyers if I had had they money to pay a lawyer. I am not from the US so to me this is just like badly written TV Series: "In a world where police can lie to you during interrogation and public defender handle up to 600 cases a year..."
My advice would be to see if there is a place for you to file a complaint against the attorney. In the US, each lawyer can belong to a bar association in each state, with some belonging to multiple bar associations spanning numerous states. In order for these lawyers to practice law and represent clients, they MUST belong to one of this bars and pass a test to obtain a license to practice law. Lawyers can lose their license if a panel of the bar association deems it's warranted, and such reviews can take place when a complaint is made about a lawyer's alleged misconduct. Sometimes lawyers are disbarred or suspended from practice, but it rarely happens in the US. I know you wrote that you're not from the US, and I'm not sure if you've been wronged by a lawyer from another country or if you're complaining about a US attorney that represented you as a foreigner of the US. Here's a Wikipedia article regarding legal malpractice that can be sued in court, but I would advise only pursuing a lawsuit against an attorney only if you consult with another attorney that believes you should file suit. If you sue this other attorney and you lose, he could counter sue you for damages and force you to pay thousands of dollars to him. I think your safest bet would be to file a complaint to a bar association that he belongs to, as I don't think you have anything to lose by doing so. However, I have doubts that it will lead to any action being taken against this attorney in question. I wish you the best.
LOL It's a lot like many of the laws that people just assume people can't get away with. Like fraud, where someone writes your business a couple of post dated cheques from their business, then if your business runs into financial troubles, that other company closes that bank account and starts another one up instead to avoid paying you, knowing full well that since you are low on funds, there's no way you can do a damn thing about it, and it ruins you even further. That's what happened someone I know, back about 20 years ago, and it was a real eye opener. It may sound stupid, but to that person and anyone else they told about this happening, everyone said "That can't happen because it's fraud, and that other business will be charged if you report it to the police!" Uhhh ya, that seems like a legit open and shut case to many people, but the police don't care at all, and will tell you to take them to court if you want to, but there's nothing they can do, sorry... Also, there's no court appointed anything either for that kind of situation... Even though it's blatantly obvious that it's a crime that is against the law, and the police will even tell you to your face that that is definitely illegal and a crime, nobody cares, and it's totally on you to fork over the money to fight the obvious crime that took place, that the other person is laughing at you for getting away with... Pretty sick and disgusting people out there, and sometimes you just have to live and learn, and deal with crap on your own unfortunately...
A buddy of mine had a court appointed who told him if he didn’t sign for the 25yrs he was being offered they would take him to trial and give him the max.He paid a lawyer and instead of the 25yrs or trial,the lawyer he paid got it thrown out..There is a big difference

Rather than telling clients that another attorney is bad if advice that he should talk it out with attorney than if no improvement complain to judge of Bar. That would give him (her) several options-1) talk out problems with their attorney 2) letter to appointing judge and 3) Bar Complaint.
There is a specified motion known as the marsden motion that the defendant needs to plead with the court in order to have the court determine if you are to be represented by another attorney.

In most cases, especially when a client is vulnerable and disadvantaged and is in incarceration, then most court appointed lawyers use scare tactics to convince a client to admit of wrongdoing so that he could get lenient sentence from judge and that is the fact. Besides, the client has no choice but to get along with incompetent and inexperienced lawyer and ends up with denial of justice.
I was recently accused of a crime I didn’t commit. I was appointed a public defender. I researched him and found out he was demoted from the AG office to PD after he was arrested for assaulting another attorney in court causing him to seek medical attention. He also has silenced people during a public hearing and has very poor communication skills. He even yelled at me over the phone. I have absolutely no confidence in him to represent me and I feel he doesn’t care much about my case. I can’t afford to retain a private attorney so I’m stuck with him.

I was wrongful termination. Iam property manager and I was wrongful termination. And I need a lawyer that can work for free. I don't have money to pay for a lawyer. I live in Los Angeles Calif. The owner and maintenance guy change the locks on a tenten. She called the police and police asked me who changed the locks I said the owner and maintenance guy. Same day I got a termination letter. Ask judge for a Marsden motion due to ineffective counsil. Have proof to present while doing it (communicate via email as much as possible, especially when requesting information or actions to be taken by your attorney so if and when there is an issue you already have proof. Things you should ALWAYS request in writing in any court case are: your discovery, any plea offers, depositions, copies of the transcripts or recordings, copies of any motions before being filed, if the prosecutor has contacted the victim or witness(es) yet) answers should be all the proof you need. I am not a lawyer, this is my opinion and I hope it helps.
And that folks is why they are called "Public Pretenders" In many small towns and counties where there are few people and fewer attorneys the public defenders not only work for the corrupt legal system they are a part of but are also punished if they win the "wrong" cases. The ikshe seeps into the CNO of OK (Cherokee Nation of Oklahoma) and with the McGirt ruling, now has (SUPPOSED) jurisdiction over a 14 county section of Oklahoma. Problem is the CNO did NOT organize under the OIWA Act (Oklahoma Indian Welfare Act) and therefore has no jurisdiction to prosecute Indians.

Can we request the court to replace the assigned attorney if they are not returning your calls, emails, is not filing any motions on your behalf, talking to the county prosecutor and not informing you of what was discussed, not giving you copies of discoveries from the State, declining a face to face meeting. If we can request a replacement, how do we go about doing that.

Public Defenders are court appointed attorneys. Public Defenders usually only practice criminal defense and have the resources of a entire office with more money to use than most private attorneys plus staff assistance like investigators and co-counsel. Mitigation evidence is used through the entire case telling the client’s story to both prosecutors and judges on behalf of the client to advocate for defense purposes. Mitigation is used for the defense to show innocence and also in plea bargaining if appropriate.

I’m guessing this guy is a court appointed lawyer. CLARIFICATION-- court appointed lawyer work for the COURTS and get paid by them. As someone who has had 1 about 12 times and 3 being 100% innocent. They lose EVERYTIME. They will immediately give you a plea bargain that is crap. You have to fight all the way til the day of jury duty to get your best offer. It’s should be illegal for a court appointed lawyer to work with the courts on a first name basis. The last 2 times I needed 1 and hired them myself we won with ease. The secret part is that I played a little trick and got the same charge as previously with a court appointed and then I hired that exact same guy and won the battle….. I’m gonna repeat myself!!! DO NOT GET A COURT APPOINTED lawyer. You have a better chance representing yourself (you can drag it out for years then) and I’m sure of that at least 90% of the time. The work for and get paid by -- the courts. If they won every case do you think the courts would want to give them a check when the lawyer has shorted the system of all that fine and incarceration money!! $$$$.

In my case the two public defenders in my case where to get information and they gave it to the judge i b the way they were working with the judge.. why because i told the second public defender about what i told the first public defender with the motions etc he answer he didn't left anything.. like the second public defender doesn't care he doesn't even know what form it was that i told him and he denied me telling him that when i have it on my notes when i told him
My wifes attorney just sent her a letter notifying her that the head of the firm not the attorney that works for the firm that shes had contact with and has been representing her thus far not her but the head of the firm the guy with the actual nake of the firm sends a letter saying he was present for my wife and that he in her best interest requested a 2 month continuance and its funny because its after the 6 months last month on feb 21st since the prosecution filed the information (evidence hearing) back on aug 19th the 6 month time frame he had for both of our cases was done feb 21st since neither of us asked for any continuances neither of us asled our attornies to do anything we kept telling them we are defending and need to know what his offense is so yea im not going to say argue and be unhonorable etc... anyways this head attorney that was hired to represent her but isnt a public defender went in and signed a 2 month continuance and that was feb 12th and by feb 21st the 6 month was up well the time stamp on this document she was sent stating this is fed 10th and the document itself was typed up and done on the 11th and the mailing stamp was done on the 24th and we just got it today so im still going to do my danmdest to rebut this and say we are not consenting to what he just did nor did we ever advise this moronic action as why would we want to add 2 months to something the prosecution is already past due on by the state laws which say 6 months minus any time noncalcuable.... u ever seen an attorney literally do the opposite to their client this is number 2 from the firm and thats just the ones they openly did in bad faith that we have either audio recorded or the document stating it... i mean its getting so bizarre and ive been studying so danm much but how do you study for this i mean its not even anywhere but the responsibilities etc of a BAR member and attorney etc etc etc... just cant believe how crooked these people are and how lazy mist are to not even catch this because its so blatant its had too been going on unrebutted for a long ass time....

A public defender is not the same thing as a court appointed attorney. A public defender works for a public defender office. A court appointed attorney doesn't work for a PD office, he/she is a private attorney who is appointed by the judge to represent you in a county that doesn't have a PD office. A court appointed lawyer works at the pleasure of the judge who appounted him/her and will not cross that judge.
Don't look for them to win, or do you much good. If you want a good lawyer, you gotta pay. I found one and am still paying 3 yrs later, however, my felony was expunged, and I did no jail time.
I was charged with DUI in the city limits while I was just driving casually one afternoon. I got same coke bottle midget as everyone else appointed to me. Too much to type but he got it reduced to a p.i. I payed a fine and left. My question is; I was just getting prepared to hire our family attorney and he called and said he got it reduced. Was it luck of the draw or something else?

I was not wearing a helmet, had a few drinks in the day, but I was fine when I got arrested. I refused the breathalyzer test, but took a blood test at the station. The officer arrested me at my apartment complex, I could have just walked to my door and called it a night, but he decided to take me in and impound my bike

I found lots of errors and assumptions and what seems like no reasonable suspicion in a police report for my relative’s dui and wrote them up in an organized manner. If my relative were to give that to his pub defender, what does that entail as far as my responsibility? would I be involved in court proceedings?
@@marcushaynes4216the pub defender keeps getting a continuation but has told his client that the punishment is 3 months incarceration, possibly released after 1 with ankle bracelet. He was parked with car running-no breathalyzer, but didn’t pass the tests. He explained that he wasn’t able to do the ones with moving head back etc because he has problems with the crystals in his ear canals and those movements cause dizziness. I didn’t see video of the testing but that must be what the prosecutor is relying on? He was also using prescribed crutches at the time. Thank you for following up. I appreciate it.

But he should’ve refused the circus test they try to make you do. I going through the same thing, I refused everything and I’m taking my case to trial. All they’re relying on is slurred speech and my refusal as an admission of guilt. He should get it knocked down to reckless driving.

Oof, that's a pretty shaky situation. I haven't been in a situation where I was being prosecuted in a criminal case, but I hope you've been able to question your attorney about his strategy and even do research into what he's saying in court. Sometimes, even the private attorneys are shit, so I'd imagine like what the uploader's message was, public defenders can be good too. Though, with such little experience, one would reasonably be warry of his abilities, especially if your case is highly complex. I hope you have a fair trial, and if you're innocent, I hope you're found not guilty...

Ignore the stomach factors that put them at a disadvantage think about what your minimum acceptable standard would be do you want to be a felony and go to misdemeanor do you want to diversion program do you have immigration or licensing concerns collateral consequences from conviction. Communicate those clearly to your court appointed counsel and keep in mind 90+ percent of all charges in the US and in some sort of plea deal of course if you want to go to court either at a principal or because the prosecution can’t or won’t make an acceptable deal to you that is your prerogative however if you lose you’ll get a much worse sons in time at least some cases it doesn’t really matter if you’re facing immigration consequences it doesn’t really matter that much be at one versus 10 years in prison in some ways it might be worth fighting to not be convicted felon and other ways if your goals do the least amount of time in prison you’re probably gonna wanna play deal

I had a public defender once and she fucked me over! This case happened out of state. The first court date I had I drove 5 hours to be there and I wasn't even on the list of people expected to appear. The next court date I had she told me not to come to, so I didn't and then got in trouble for falling to appear. She didn't even inform me of another date. She refused to return any of my many many calls and I had to talk to her supervisor before she finally contacted me. She mailed papers to to wrong address even after I confirmed the correct address several times. Then she wrote up a plea agreement covering her own ass and expected me to sign it despite the lies she had written and the fact that she spelled my name wrong. Correct spelling of your name on a legal document IS VERY important. Hire a real lawyer! The state appointed attorney DO NOT GIVE A FUCK ABOUT YOU!
