Since the Constitution, in Article II Section 3, says "[the President] shall take Care that the Laws be faithfully executed..." it seems to me that any illegal action (i.e. in _violation_ of the law) by the President would - by definition - _NOT_ be an official act. But that's just me, reading the text of the Constitution; what do I know?
