The solution to America's jobs problem lies not with budget-busting federally mandated "stimulus" programs.
Instead, what is needed are specific reforms that wouldn't cost taxpayers, would create a broader tax base for cash-strapped cities and states, and would provide opportunity for millions of Americans who worry where their next paycheck is coming from.
As demonstrated by a series of eight new reports issued in October 2010 by the Virginia-based Institute for Justice, one of the principal obstacles to creating new jobs and entrepreneurial activity in cities across the country is the complex maze of regulations cities and states impose on small businesses. IJ's "city study" reports are filled with real-world examples of specific restrictions that often make it impossible for entrepreneurs to create jobs for themselves, let alone for others.
Chip Mellor, the president and general counsel of the Institute for Justice, said, "If the nation is looking to the federal government to create jobs in America, it is looking in the wrong place. If we want to grow our economy, we must remove government-imposed barriers to honest enterprise at the city and state levels. Remove those barriers, and you will see a return to the optimism and opportunity that are hallmarks of the American Dream."
IJ's eight reports document how irrational and anti-competitive regulations block entrepreneurship. More often than not, these government-imposed restrictions on economic liberty are put in place at the behest of existing businesses that are not shy about using government force to keep out competition. The Institute for Justice's city studies examine regulations imposed on a wide range of occupations in Chicago, Houston, Los Angeles, Miami, Milwaukee, Newark, Philadelphia and Washington, D.C.

I used to have a small business that I ran out of my home. Not much more than a hobby that made me a few hundred bucks a year. I had the appropriate sales tax license and I did such a low volume that I only had to file once a year. I had a business license from my country based on my inventory, $20 a year. Then I moved. The town where I now live has a "business privilege tax." It doesn't matter how small your business is, the tax is a flat $300. So I'd be spending $300 a year, be subject to inspections, and still only make a couple hundred bucks a year. I shut down. If I was a published author and wrote in my home, I'd have to pay $300 a year. If I did computer consulting, $300 a year. Anything that makes money costs $300 a year. The town wonders why new businesses don't want to locate here.

Idk, criminal law? There don't need to be a million regulations and permits and shit against businesses, there just need to be anti-fraud laws and such. And those large corporations, ironically, are nearly immune to that law considering how much lobbying power they have to change laws and legal power to fight cases. they can violate as many codes as they want, and only very rarely do they get tried and even rarer get found guilty.

While Wall Street actually needs more (and much better) regulation and enforcement to keep it out of trouble, this video makes the great point on the excessive and often nonsensical and harassing maze of local and state regulations facing small business. One rule for the big guys, many other rules for the little ones. This helps prevent the little ones from becoming big ones. For many examples of corporate shenanigans, see moneyspork (dot) com.

In Washington State, you cannot open bank account for a business or a non-profit until youv'e registered with the Secratary of State and paid your fee. Usually you must also buy a business license from the local government as well.

I've been running a machine shop out of my garage for the last 3 years. I signed all the appropriate state and federal forms but didn't bother to look into any local laws. I'm sure there's something that says I can't do what I'm doing but I figure as long as the tax man is happy, I should be ok for a while.

Ut-oh. Now I'm worried. 10 years ago I started a business in my home selling toys retail over the Internet. All I did was get a "home occupation" permit (took 1 download, one stamp to mail in and a week to get approved), a county business "doing business as" licence ($10) and a Virginia tax/sales tax certificate. Then I bought some stuff, set-up a webpage and Ebay store and have been selling for a decade. Did I do something wrong? Is Big Brother government coming for me?

LOL To be a taxi driver in Bay County FL, you only have to have a vehicle, a sign, and insurance. But if you want to pick up people in Panama City, Panama City Beach, or the Airport (which is in the county) you must meet their requirements and have your vehicle inspected, and pay a fee for the vehicle and the driver permits.

All too true. I've had to pick up a contractors license in another state to work, then file for all the permits which are followed by inspections. The contractor license didn't require any type of check other than the one from the bank. Lots of runaround for a little work!

I used to have a business, more of a hobby that made me a bit of money. I had a sales tax license and a business license which cost $25 a year. Then I moved. My new town has a $300 per year "business opportunity tax" for "any activity that generates income." That applies to people who work out of their home as well as brick and mortar stores and offices. So rather than spend $300 to make $500, I just up and quit.

We need a clean judicial system that allows the markets to work for themselves. We don't need protection for entrepreneurs. If they fuck up, we can sue them and wipe off their equity, it will be in their best interest to serve us right and honestly. People wake up. This nation wasn't build they way we are running it now. Hey now, I tried to save some money and hired an unlicensed interior decorator once. $*%@#$% put my shirts IN THE SAME CLOSET as my coats. It was CHAOS! I for one am GLAD someone stepped up to do something about it, just too late for me. :-(

@ImperatorZor I actually think The Jungle is a good example of a market based response to poor industry practices. Company sells a bad product, consumer releases information to the public, people stop buying product, industry changes its ways or goes out of business.

@MitchofSmeg A law backed by a Senator from Iowa that was about "freeing the children" from "oppressive sweatshops" in several Asian countries led to about 3,000 children with no other choice but either sex or hard labor outdoors for much less than the pay they got when they worked in the sweatshops.

@TheQuinch I agree with you that big businesses should have to abide by regulations especially when it comes to the environment. I just think that the state/government should not be the one enforcing or creating them. When the BP spill happened the US gov put a cap on how much BP had to pay to clean it up.

@iammetx Consumers are better than any regulatory regime at finding mechanisms to respond to irresponsible businesses. If it becomes known that a restaurant is dirty, people won't eat there and it will go out of business. You don't want to eat at a restaurant that passes the low bar of the health department. Then there's private industry standards set by organizations like Underwriter's Laboratories, Kosher or Halal food practices, etc, all far more effective than the FDA or CSPC.

@ImperatorZor Since corporations exist to make money, they generally try to avoid killing their customers. If their product harms you, then you can sue them. But you have absolutely no right whatsoever to initiate force against them because you want to control how they do things. If you don't like what they do, then don't buy their product. Regulation is prior restraint. It creates barriers to entry, drives up prices, creates official corruption, leads to "regulatory capture," etc. It's bs.

@MitchofSmeg Once the subsidies went away, slavery disappears. The Northern War of Aggression in America was about bringing America further from "United States" and closer to "Empire." The slavery thing was a Public Relations campaign, and the only reason slavery ended in America was because the subsidies went away, not because of the emancipation proclamation.

"Why budget deficits drive private profit" (do a google search for the article) The federal budget deficit has usually been a major profit source in modern history … The support to profits from the federal government will remain a requirement for as long as balance sheets in the private economy are shrinking." You can produce whatever you want, if you don't sell it, you can just stop producing and lay on your butt.

@ImperatorZor Here's the thing--- Corporations are products of the State. If it weren't for the State we wouldn't have corporations... or at least corporations as we know them. Many of these Corporations rely on things like regulations on small businesses, taxes, subsidies, corporate welfare, intellectual property, etc,to keep their monopolies. We have Corporatism. In a free society workers of a factory or retail store should be able to pool their resources together and create a compet factory

@MitchofSmeg The minimum wage has led to widespread unemployment, child labor laws in other countries have led to children starving on the street or selling themselves for sex, and slavery in most countries was government subsidized.

There are reasons behind these laws. You can't run certain businesses from homes, because such activities will disrupt quiet neighborhoods. So there are commercial areas to do this kind of thing in. A second hand store has laws protecting people from acquiring stolen goods. and so forth. These laws might be a pain sometimes, but NOT having them is a much bigger pain.

How exactly does the consumer base know that a meat processing plant does things safely or not without oversight and mandates? That is, of course before a large number of people died of Food Poisoning. Corperations exist to make as much money as possible, if that means cutting costs through laxed safety proceedures to satsify their shareholders, they WILL do it. Read up on the 19th century, before regulations on safety and health were common. You will be amazed, shocked and disgusted.

@FlashVirus Give a link, doubt if someone selling flowers as a hobby was arrested as a 1st resort, a full fledged business in a residential area would impose a burden on residents in a given area, hence zoning ordinances. A once a month report is hardly an indication of a huge problem.

@robertmike57 I saw an article in the new york time, about a littler girl in Summer of 2010 was selling Lemonade outside her yard and she was fined 5,000 selling without a permit. She was about 8 years old.
