Is there a lot of marriage fraud? There's a person I knew for a minute a while ago. She married someone while on a student visa just to obtain a greencard. I guess she also got friends to write letters stating it was a real marriage. She obviously divorced and married someone else. When I was told this I couldn't decide if I was annoyed at her for doing that, or the government for making it difficult pushing people go down a deceitful path. This puts honest people who are in real marriages under such scrutiny. As someone going through immigration for my husband. I can actually give some sympathy towards these government employees. You have to rely on documents that's supposed to paint a picture of people that you don't know. I suppose if I were doing that job perhaps I'd become jaded and assume most people weren't honest. It's definitely a cause and effect world.

there are americans they married for money !! ashamed i mean usa is a rich country is it? and poor immigrant they just send money to their family in poor country they also pay this usa citizen but they get deported the usa citizen got the money....i dont know why ,,i dont like fake marriage especially with those americans.

Yeah it is difficult, even in non-immigrant cases there's marriage fraud where someone is marrying for ulterior motives (money, comfort etc.) so it's really hard to detect cases where the immigrant is seducing a citizen just to get the green card. Regular citizens will willingly cohabitate and have children with each other without getting married and separate and become single parents, so it's not a stretch that someone would go through all of that for a green card.

From my experience USCIS denies cases where things don't fit and where people have failed to follow direction and/or be responsive to requests. With my case, we were fortunate in that we did direct consular filing, and my wife's case was approved in 8 days. And the VISA was approved in another 8 days after we submitted the DS260. Note, our case was an EASY case since it was a CR1 case where my wife had never been to the U.S. Anyhow, submit your paperwork properly, and be responsive. And if something is out of place, explain it within your initial filling. Also, make it easy for them so everything is there the first pass through. Don't leave things out.

You are the Truth Whisperer!!! Thank you!!! It’s sad in 2022 that my marriage will be judged based on our race/background…I’m black and my husband is Turkish and because I didn’t marry someone of the same race/background that makes us suspicious..WOW and not surprised at all of that mentality!!

My husband is Haitian . I’m white American . I’m 20 yr older. Took 3 yr to get the visa after we married in DR. After much much stress waiting he arrived in US then received his green card just a month later . Thank God . But I definitely know the wait of him getting here caused so much stress on our marriage . His getting here to US was just last year . Even though I do work in Haiti, I was not even able to go see him for over 1 yr due to covid . My nerves are shot . We took in 10 orphans in Haiti and now are trying to bring 3 of the small children , who are his distant relatives to US. Only God can help us …

Thank you for openly sharing about white immigrants having it easier to legalize in the US. I also noticed that but it’s really hard to prove and nothing is being done about it. Sad reality of life but best to know the truth and prepare accordingly.

I like that you're very honest. You mentioned all race but Asians, what about their case? LOL. Could you also make a video of the recent change of 3, 10 yr, or permanent bar that some people who left and re-entered to US are now allowed to adjust their status in US? I'm confused because I'm not sure who can get a visa again and re-enter to US once they overstayed? Is that only for someone who has family in US?

you perfectly highlighted the long list of possible scenarios... what does it mean when uscis seats on a case for more 3 years after the interview without any correspondence? what is the way out when the relationship is obviously crumbling due to the stress of the filing and delay?

Talking about stupid ways the USCIS works sometimes… Many, many years ago I firstly entered the US on behalf of the European company I have been working for about seven years at the time. I applied for an L1, I was supposed to start a new US subsidiary and my role was going to be CEO. I used an attorney, so the paperwork was supposedly correct. Time passes, no answers from the USCIS so we paid for expedite. The answer we got “THE COMPANY DOESN’T EXIST YET SO IT DOESN’T NEED A CEO”… Duh??? I was supposed to “create” the company and hire the people, who do you think could do that? Should the parent company have sent a receptionist or a janitor to start?… The attorney suggested we appeal and in the mean time apply for an E1 which would have been discussed at the European consulate. I got the E1 and started operating with that… The appeal was approved two and a half years later…

This is very informative. All my papers and documents are well handled and submitted for USCIS but still they sent me a REQUEST FOR INITIAL AND ADDITIONAL EVIDENCE. My employer applied for i360 Petition for Special Immigrant (religious monk). They said they sent the letter last September 20th, 22 but as of now the letter we haven't received it yet.

I dunno know whether my son's aging out is either an easy case or a hard case. My parent's dream was/is to see all of their children enjoy what they call the American dream. However, this dream took 20 yrs to come to fruition and now that's it's finally here, one of my children, (M) 35 yo has been removed or dropped from the petition list as a derivative applicant. I am confident that the provisions of the Grandfather petition law and/or the Child Status is still yet to be enjoyed by my son as a derivative applicant. He is still single and was still in his teens when our petition was approved on April 30, 2001. Hoping for answers to my query. Thank you.

Sort of. There is TN status, but a lot of people don’t qualify for it. It’s also only technically good for three years and it’s intended to be temporary, so it can’t be renewed indefinitely. There are also benefits with a green card that you can’t get on TN status (collecting unemployment insurance if you lose your job, being allowed to work for any employer, not having to leave the country if you get laid off or fired, getting certain credit cards and investment opportunities, donating to political campaigns… the list goes on). I’m Canadian and was on TN status for 7 years before I got my green card through marriage.

I feel like I was targeted. We waited for five years and they did send my kids back however thank God everything went well and I got approved now. I’m just waiting for my green card interview. I’ve been married for over five years going on six next month this is my second marriage. We do share two children together and yes, me being an immigrant has been a problem. It has stopped us from doing a lot of things we put so much money into this case. I pray everything goes well. In Jesus name amen.

Wow! Good information! Ive been married for 20 yrs in September and over 22 together and we have filed through our lawyer home land security., im my husbands petioner hes turkish and im American white we love eachother very much! But i have a past when i was young im 60 now and have a history of depression i also have type 1 diabetes for 48 yrs and chronic issues due to my condition My husband has paid taxes for over 20yrs because he was issued a ss card in New Jersey where he lived in late 90s we wanted to get a new lawyer because our lawyer told us yrs ago “our case is difficult”? Because of way he enterd?

I got married over a year ago and my visa status was still good then, but after getting married it expired and yet we still can not apply because we can't afford the forms and lawyers atm. Does that make my case too complicated? I'm curious do you think would be a bad idea wait until complete 2 yr married and then apply for the green card or is this a situation like the longer I wait the worse it will get?

From what i heard is more than 4. And how the divorces ended. Also the number of divorces that is too many if you are younger. Ex if you’re only 35 but already has 3-4 marriage Maybe is considered high.

My I94 expired 3months after I entered USA and in 2013 my visa expired. I got married in 2020 and I’m waiting for green card interview. Will I be turned down and my case be treated as marriage fraud.

You overstayed by 7 years. They know that you overstayed but it will be forgiven as you got married and adjusted. However it may come up in an Interview.

So I came here legally in 1994 I was 11 years old was in a homeless shelter they got rid of my backpack with my passport in it but I am here legally I'm going to renew my green card also I was homeless I did get in some trouble with the law it was mostly misdemeanors nobody told me and taught me when I came here and if you get in trouble it may affect your status but I haven't been in trouble since 2016 i'm here parents died so I'm in the United States by what is the immigration do when somebody has a disability like me I'm going to have to renew in the next two years hopefully I'll be okay like I said they're mostly misdemeanors and I didn't know the law that well I was homeless when I got a couple of charges so we should be okay right?

Please Jim, thanks for your information, I have a problem my VAWA petition was approved in May after 3 years and I was to go for I485 interview but after few days of receiving the mail, I got another mail saying it has been desehedluded with no future date but if they reach any decision they will let me know but if they schedule another date they will let me know. Watching your videos, I am confused. USCIS interviewed my wife but never interviewed me as the sponsor. Her Green Card was approved the next day. We did submit a lot of evidence of us being a real couple, but I don't understand why I was not included in the interview.

From looking at my friends, a white person with criminal history will get the same treatment as a black or latino person with criminal history. Ridiculous statement. Now a more nuanced approach would be if you have 2 white folks with no criminal history and two black folks with no criminal history, I think this may be tilted slightly against the minority couple, but it depends on which part of the country you are in. Midwest, maybe. But in NYC or LA or SEA or even South Florida or Texas, no issues, generally. That being said, no where is guaranteed. And the mixed race situation in the wrong USCIS center may be an issue, but I would argue that it would depend on the Officer involved. But in general I have not seen this play out as starkly as Hacking says. Way more nuanced.

As far as the racism, I will defer to your experience. But - when it comes to couples from different backgrounds, from living as an expat in Thailand for a few years, I can say that 90% of marriages/relationships between Thai women and Western Men, don’t end well. Again, this is anecdotal and purely from my observations, but nonetheless it is a bit warranted for USCIS to be skeptical. On the flip side, there are many common denominators between the inter-cultural relationships which don’t work out. Most key among them is age gap, and more importantly when the man doesn’t speak Thai, and the woman doesn’t speak English. In fact, Western friends of mine who are in relationships with Thai women around their age range, who speak good English, tend to have stronger relationships then western couples. - and that is something I would expect a USCIS officer to be able to catch onto.

Dude it has nothing to do with the skin color, of course if there is a person from Canada, England, Australia, or any other native speaking English country, they will be more likely to get approved why because they already speak the language and therefore will be a good asset to our society, in the other hand immigrants that can barely speak the language will have a hard time to incorporate, thats simple
