Why do i need probate? Hi i'm Darren Findling of The Probate Pro and iIm going to explain why you may need to be involved in the probate process well when somebody dies with an asset that means it has value and it's in their individual name and there's no named beneficiary there's no joint owner and you need to get it from that person who died to the family you go through the process of probate so again first the asset is owned in the individual name with no named beneficiary or a joint owner meaning two people own it with a survivorship right to get it from the person that died to their family you got to go through probate people often ask well i have a will doesn't that avoid probate and the answer is no the will is simply the rule book or the guide or the instruction manual to guide you through that probate process the will actually goes to the probate court to be administered through the probate process there are great ways very effective ways to avoid probate we call them probate avoidance techniques and that is with effective estate planning you can avoid probate but if you're in it it's not the end of the world it's just a process that you got to go through to get the asset from the person that died to their family if you have questions about probate related issues visit us at theprobatepro.com or call us at 833 PROBATE.
