Anytime a member of the public hears about a criminal defendant choosing not to testify at their trial, they typically assume that it is because he or she is hiding something, or that they are definitely guilty and don’t want to face the prosecutor. But this is a dangerous and harmful assumption that defense lawyers have to work CONSTANTLY to overcome. There are a ton of reasons why a lawyer may not want his or her client to testify. In this week’s video, we touch on just a couple of those.
