The German word "Geschlecht" can mean both "sex" and "gender" - the translation app went with the less applicable alternative here. The same thing happens close to the very end when translating "Anzeige ist raus": It means a criminal complaint ("Straf-Anzeige") has been sent to the authorities, but the shorter term "Anzeige" can also mean an ad (as in advertising), which the translation app wrongly chose.

Don't call it right wing clothing then. If it's Nazi clothing call it Nazi clothing, if it's extreme right clothing call it extreme right clothing. This is a below the belt tactic from some left wingers to conflate the whole of what is not left like them with the extreme right and discredit it. I don't know, those fonts rub me the wrong way immediately, but I also know in Germany they predate the Nazi era.

The woman said the construction workers wore rechtsradikale Kleidung, which is radical right-wing clothing. Most translations in this context on many videos are very misleading, as when Germans say „right-wing“ in regards to the political german landscape, it almost always means radical right. I’d bet that only Germans who’ve spend a ton of time either living in the US or in American online communities, would say „right-wing“ and mean conservative. These two political terms are not simply interchangeable in German.

National Socialist propaganda is forbidden. Opinions on who is extremist of politicians or of the "criminal organisation" Verfassungsschutz (Federal Office for the Protection of the Constitution) don't matter at all because of the countless crimes it's responsible for and it's anyway subject to instructions of the interior ministers of the federation and states. A court sentence matters that something is National Socialist propaganda. The hurdles are high for the judgement that something or someone is extremist and permits a ban. Otherwise mere opposition against certain policies could get easily criminalized.

Früher hat die Union noch großen Wert darauf gelegt, "rechts" zu sein. Es ist im übrigen ein bewusster Versuch, "neulinke" Standpunkte durch die Hintertür verbindlich zu machen und Andersdenkende und Oppositionelle zu verunglimpfen. Nein, "rechts" bedeutet keineswegs rechtsradikal. Und viele Standpunkte der alten Linken wären in den Augen der Neulinken "rechts". Die alte Linke war weder antideutsch noch Anhänger der Konzeption von Deutschland als Einwanderungsland.

I think the prosecutor just didn't want to bring this case to court, because he thinks it's a minor case and nothing to go to court for. Therefore he had to explain somehow, why he wouldn't go to court with it.

Its about the city "Gera" itself, which is located in one of the most right-wing leaning counties in Germany, that also tends to have a right-wing issue within the police itself. The prosecutor very likely just shared the mindset of that internet guy and didnt want to start actions against him based on pure sympathy.

I think this video needs a basic explanation. So. The AStA (General Student Committee) of the University of Cologne is a self-governing body of the university's students. They take care of the social needs of the students, organize campus life and are the contact persons for the university administration when it comes to student needs. In this case, they received complaints that construction workers were seen wearing clothing that belonged to the radical right-wing spectrum. The AStA makes the complaints public and addresses everyone responsible for them. Then they get a shit storm. A contribution to this Schitstorm comes from Gera. Gera in Thuringia. Like all East German states, Thuringia has a small problem with right-wing extremists. There are of course some in the West, but the West encapsulates them a little better. In any case, the message from just now says "Fuck you." This can be seen as an insult and an insult is punishable in Germany. "§ 185 StGB: The insult is punishable with imprisonment of up to one year or a fine and, if the insult is committed publicly, in a meeting, by disseminating content (section 11 subsection 3) or by means of assault, it is punished with imprisonment for up to two years or a fine .". That's why the AStA filed a criminal complaint with the public prosecutor's office in Gera. And they write back a long letter why they don't want to investigate. First of all, it says that the term fuck you could have something to do with reproduction Translation of the video wrong because it confuses gender and sex. Then the term Wohl is also common in military language for a hard drill. And in some areas in Germany there is still the term "Fickrich" which can mean restless or excited. The public prosecutor now says that it doesn't have to be an insult due to the different meanings.The AStA and actually everyone else thinks this explanation is nonsense. The public prosecutor may have tried to find a reason for not having to investigate.

In Germany any form of cursing, swearing or other inflammatory and insulting speech is prohibited by law. The general freedom of speech in this case is more limited than in the US. There was a case in the US in the late 60s and early 70s (Cohen vs. California) in which the Supreme Court held that it is unconstitutional to prohibit insulting speech and that only fighting words can legally be banned under the Constitutions 1st Amendment. But if you look at the fact that it was a 5 - 4 decision of the court, you can see that even the Supreme Court judges had different opinions on that topic. In Germany the majority of politicians and judges decided differently and that is why today you can use insulting speech talking to any individual in the US but not in Germany. If only one judge back in the 70s decided differently, we would most likely have similar laws restricting the freedom of speech today. One question you had was, why the prosecutor searched for excuses for the individual that used the f word in this context? The answer for this is a bit difficult but essentially it is a difference in our justice systems. In the German system the prosecution has the role to simply find out the truth and any kind of evidence regardless wether it proofs the accused persons guilt or the opposite. While in the US on the other hand the prosecutor only has to find evidence that indicates the accused persons guilt. That difference derives from the fact that the criminal justice system in the US is based on a process between two parties (State vs. Defendant), an adversarial system, while in Germany we have a nonadversarial system in which the prosecution is not seen as a party.

I'm actually surprised the prosecuter's office took the time to explain their decision in so much detail instead just answering: "Live with it." Chances are higher to see an elephant in a helicopter landing on a daisy, than a successful trial of defamation here in Germany. From my time in law school I remember that there were only about 3 actual verdicts of defamation in the entire history of Germany (meaning since 1950) and in each case policemen were the victims. It takes MUCH more than a simple FU. Otherwise courts would have to deal with nothing else than this kind of stuff.

Honestly, I think the prosecution is just desperately trying not to have to get someone punished for a commonly used insult. It's a bit backwards that this is even illegal in Germany. Most things are IMO better in Germany than in the USA, but this is one thing that's better in the USA.

@@tarkitarker0815 Insults are an expression of free speech that should be protected by law, not condemned. The students are free to insult them back - or would be, if it was legal. Also, I'm Austrian, and frequently visit Germany. But I won't stop visiting just because of one issue - as I said, most things are better in Germany than in the USA (this is also true of Austria). No country is perfect, every single one has some kind of stupid, backwards legislation (at least AFAIK). There is nowhere for me to go that is sufficiently better. Plus, that wouldn't solve the issue of Germans having to live under such a stupid law. And before you ask, no, I don't know if Austria has a similar law. I only know Germany has it because I watch stuff like this. I'd have to look it up.

Not necessarly. They were supposed to bring a case to court, which has a relatively low fine value. And with a high chance that this user and offender would have been able to avoid a fine anyway. So high costs and a low chance to succeed would have been enough to not bring this to court. I'm sure they also wrote that in their tree page letter somewhere. But it is hilarious, how far they went out of their way with a full set of rediculous explanations.

It is nothing more than a (stupid) summary that previous court cases created. This reply is most likely just a template that is stored on prosecutor servers.

Insulting is criminal Act in Germany but with a Twist. Insults are directed against the lowest Legal Interest wich is Honour. Because of this one can not use the right of self-defense by all means. Self defense must be equally or less strong but effective. So the only two things one can do would be a criminal complaint (misdemeanor Complaint) or simply insult the other Person back and get away with it. The last is exactly how you start a Barfight.

I have heard different opinions on that. Even to the point that physical force is justified to stop someone continously insulting you. You have to warn the person clearly that you will not tolerate being violated further, then you can do whatever it takes to make it stop. Well, beginning with the lowest reasonable level of force, of course. But you dont have to let someone commit a crime on you in general, and have the right to protect yourself - also in the case of insult.

@@SASMacDroid Well, it was a vlog of some german lawyer here. It was said that it is debateable, as 2 legal fundamentals collide. For one the "Selbstschutz" rule, that allows you to defend yourself against a crime being commited - and no, you don't always have to wait for the police to sort things out. On the other side is the "Angemessenheit der Mittel" in the given situation, so not to use excessive force. Yes, it is moving on thin ice, but I just wanted to point out that things are not as clear as you descibed it.

Insulting someone is a misdemeanor in germany according to § 185 of the german criminal code (StGB) which reads (Not word for word but as close as possible): "Who insults another may be subject to up to a year in prison or a fine; when the insult is public, in a gathering of people, or made by distributing something (§ 11 paragraph 3, German criminal code) or is done violently, the offender may be subject to up to two years in prison or a fine. If it is an insult or not is in fact debatable, the public prosecutors office here sided with an old ruling of the german constitutional court from 1958 (Az. 1 BvR 400/51) in which the court ruled that any phrase that could have multiple meanings has to be interpreted in the most positive way for the defendant. If thats applicable and called for here is disputable though.

In Murica, "freedom of speech" is valuated higher than the normally equally strong "human right of personal integrity". In other 1st world countries, that's usually not the case. All human rights are equal. Therefore the human right of personal integrity cannot allow insults to be protected by the right of freedom of speech. It just doesn't work that way. That is why in many 1st world countries, hate speech, insults, holocaust denial, nazi paroles, and so on, and so on, and so on are outlawed. They aren't necessarily always automatically a crime, though. Depending on the severity of the speech, it can be a crime (when discrimination is involved, for example) or a misdemeanor. Often the judge will mediate, rather than punish. And sometimes the charges are dropped due to banality of the claim. NOW, to the background of this very story, which is very important to understand the entire problem here. Gera is in Thüringen, which is in what we call the "new federal lands" (neue Bundesländer). These are those states that were in the DDR before the reunion, a little more than 30 years ago. The DDR was communist, so it's not really that odd that since the fall of the Wall, those regions are weary about leftism (even the good and positive leftism!) and turn to the opposite. That's why the former DDR has the hightest percentage of racism in Germany. Right wing crimes are about ten (!!!) times as frequent there than in the rest of Germany. The AfD and NPD (the two extreme right unparties of Germany) are very strong in that region too. And now there's Gera, where the prosecutor's office - who are rather likely also right wing - is trying to minimise the racist insults of one of their subjects. After all, it's very well known that right wing extremists, just like during the years before WW2, are infiltrating and undermining all kinds of protective services, like police departments, fire departments, prosecutor's offices, and so on. Makes total sense, as disgusting as this is. Gera actively tries to trivialise the claims of the claimant. Unacceptable! Reality, unfortunately, but unacceptable nevertheless! What the prosecutor *SHOULD* do on the other hand: suing the culprit on the misdemeanor of insult towards the student and on the crime of spouting the following acronym and number. This should result in prison time, at least on probation, some fine and some community work.

The gender thing was a misstranslation in your translation program. "Geschlecht" means "sex" and "gender" in German. The correct translation would have been "sex" in this context, not "gender".

After aked by the AStA (student's union) to forbid extern workers to wear the shown clothes the university administration of the University of Cologne anwered that according to law it's legal to wear the said clothes and the extern workers weren't subject to the "principle of neutrality" (like wearing no clothes with political symbols, statements etc.) employees of the university were. But I'm surprised that the students from the AStA seem to be under-worked. They seem to have a lazy student's life. My student's life was different. My chemistry studies were very exhausting. I had spare time but I needed that for recreation. These students seem to have a propensity for persecuting dissidents. I grew up in an atmosphere of free opinion. Back then you still didn't get into prison because of differering opinions. We had absolutely no problem to disagree with teachers and other persons of authority. But persecuting dissidents or denunciation was the worst we could imagine - back then in West Germany. According to my observation the said students probably will censor, oppress and persecute dissidents whenever they get into positions of power - if extremist or not doesn't matter. They are used to call everyone who isn't of their opinion easily an extremist if only they don't like his opinion.

"rubbing and grinding was translated from the German words 'reiben', which i rarely hear in intimate context compared to 'rubbing', and 'schleifen', which has zero sexual meaning and is used mainly for processing 6:25 "ad is out" is a bad literal translation. the translated phrase is "Anzeige is raus." the word "Anzeige can mean ad, Display or a report to the police. common store policy is "Jeder Diebstahl wird Angezeigt" meaning they will call the police when they catch you stealing, no exception

FYI 88(HH) = the 8th letter in the alphabet. I think u can figure out the meaning of this. There are some other numbers that used or maybe are still forbidden like 18(AH) in combination with something else.

For decades all cars registered in Hamburg have HH as the first two letters of the registration number. I believe it comes from Hansastadt Hamburg. Will they ban that too? They even have AH plates which is the Borken district in North Rhine-Westphalia. Until now nobody was bothered by these plates but suddenly they are a problem.

About the relation with f*** and gender in Germany: I think was mentioned so often, because the german word "Geschlecht" (gender) is used in a few more cases. The best example is the word "Geschlechts-verkehr" (directly translated: "gender-traffic") wich is just another, more formal word for sex. There is also a "Geschlechts-teil" (gender-part), wich is another word for "genital". And that is why the lawyers put the f-word in relation to "geschlecht". Funfact: Geschlecht can also mean "bloodline". Here is a example: "Dieses königliche GESCHLECHT ist 100 Jahre alt." "This royal BLOODLINE is 100 years old" So... Yes, your f-word and our f-word realy are the same thing.

Insulting is a crimein German, but since in social media many people very fast insult other and more and more people now, press a charge, the Staatsanwaltschaften have lots of work. And if there will be a trial, very likely the defendant will have such an excuse, saying "I only wantetd t mention, they should keep on with the hard drill" or similar, at the end, there will be no to a very small punalty. So the effort seems to be very high, for this small penalty and the Staatstanwaltschaft, want to avoid this, explaines, why they won't start a trial. So the only option would be to make a civil case instead of a criminal case.

Yeah we have a law that prohibits multiple things related to unconstitutional organisations (that is mostly the right-wing situation, but can also include any other organizations that might be considered to work against the constitution.) Prohibited is by law (German StGB, §86, 86a): The distribution, production and usage of symbols, marks, hallmarks, flags, etc. of organizations or political parties that are deemed unconstitutional. In fact, you are by law allowed to take any necessary action in order to prevent someone from changing the german state order (e.g. establishing a dictatorship).

You know, i kinda hate German Law-Enforcement sometimes... Well, actually i mean it literally when i say "sometimes" because some Law-Enforcers are good, some are bad, this is especially important if you end up in a Courtyard and your Judge or Prosecuttor has a "bad day"... then they can sometimes be unbearable "Assholes" but some other times they can be so nice that you could go Bowling with 'em or have a nice Time eating some Ice Cream and drinking cups of Coffee with them... IF (and that's a big IF on purpose) they have a bad day, they sometimes even act against you as if they were corrupt or somebody bribed them to act in favor of someone who hates you... This is here in Germany most of the time a huge "Game of Luck" if you get nice people or assholes... sadly it certainly is as shitty as it sounds, not gonna lie... Our Laws are also not really the greatest in some cases, especially if someone stole something from you and you can't prove it that the stolen part is your property (because you lost the receipt from the stuff you bought which was stolen from you) because then the thief can just say that he didn't steal it from you and that it was gifted to him by his/her ancestors/family (aunts, uncles, mom, dad etc.) which makes it a "word-against-word" case, where both parties are considered "right/correct" but also "wrong" at the same time, which makes this entrie case become "dropped" or just "delayed to another trial" until the evidence against the robber can be proven in a physical matter (if you manage to find the receipt after some time of digging around in your files that you've hidden in a safe, locker or on a digital medium) or in a digital matter (Security Camera Footage or other Video Recordings of the robber stealing your Stuff), otherwise the robber might be able to keep your stuff... That being said: Stay always safe and aware that anytime, anything can happen... (also keep the nice quote in mind: "Anything that can go wrong, will go wrong" (at least that's what i always keep in mind, even when i change the "go wrong" part against "happen", in this case))

Wow. Those comments. Either not checked the law or not understood it before posting. Nearly as bad as the translation. *_To clerify:_* The clip was about construction workers wearing far-right-wing (radical) cloths. And a university in Cologne complaining about it with "We don't think you should wear that in a free and open country." and the negativity that post got online. The show then went on how the prosecutor did not act upon the insult "f u c k you (group)." The policeman example is lacking. *_In German law:_* The insult is declared a crime, but a lesser one at that. It is a so called "Antragsdelikt" (report to prosecute crime). They did report it and the prosecutor went to work. So far so good. Now an insult in German law has different variants. They all have a slightly different additional conditions. But they all have the same pre-requirement: *An insult can only be against a person or a legal bodyship. (See § 194 STGB)* The university is not a legal bodyship in this law. There we reach the first problem of declaring this an insult: "euch" [you (group)] Which is also the reason, why the example: "If you go to a police officer and say 'f u c k you', you can bet he understands the insult." is lacking. -> Yes, he will, because it is no longer the you for a group but the you for a person, therefore the pre-requirement is fulfilled. Now the conditions of insults are declared around the ability of an insult to reduce the value of the targeted person. "F you" doesn't devalue a person in the sense of the law, does it? Next is the entire phrasing of the comment, which protected the person even from hate speech, the insult against groups ("euch") handled by a different law. The phrasing has too many elements of cynical speech and sarcasm. With this a defense in direction: "I was just using sarcasm to point out how I do not agree with the university complaining while not reporting those construction workers for their radical right-winged views. In a certain way, I did satire." Satire is using the one exception of the use of forbidden symbols: for educational purposes. Not sure how solid this defense is, but the prosecutor might have determined, that this defense would win in a German court, because of "in dubio pro reo" (If there is plausible doubt, void the case; literal: In doubt decide in advantage of the prosecuted) I can fully understand the decision of the prosecutor after checking the actual law. *_Disclaimer:_* However I'm not a lawyer and it's late, I'm only able to read and figure out text. So feel free to show me any flaw in my analyses. But don't even dare to comment with your anti-east-germany crab (typo intented) of must have been nazis in that prosecutors office.
