Dr. Grande did not mention one of the most important aspects to bear hunting that adds weight to support a conviction . . . The hunter must always watch the bear for a long enough time period so he/she is 100% confident that the bear is not a sow with a cub or cubs following along behind her. Every bear hunter knows this and it is the law.
Oh, just this one would be enough to convict her. Add to it the life insurance aspect and his brother moving in and we have it very clear that it was murder.

Depends on the state & season. We have a spring bear season & I don't think you have to wear orange then. We don't have to wear orange during archery season either. During the fall hunt, when everybody is rifle hunting for deer & elk, you have to wear orange
It depends on many variables. Blaze orange is usually associated with deer and pheasant. However it would be near impossible to hunt turkey with orange
I think it’s likely she killed him on purpose. I have seen a bear, in the dark and in daylight. They don’t look a bit like a person, unless you could argue it was so dark Mary Beth could only see a misshapen lump. Even a misshapen lump doesn't add up because on all fours it's short and wide as a car. When it's on 2 legs it's tall like the predator (unless it's a smaller bear).
I've never seen a bear in the wild, we don't have them in my country. But there's really nothing much in nature anywhere that looks like a human running around either and if you're hanging out with people that shoot at 'movement', its a good time to stop being anywhere near them!
I have an aversion to hunters who do it for sport and not for survival. This is a story of adultery and trading partners like musical chairs. Mark leaves his partner of 12-years for Mary. Mary's brother-in-law lags behind as Mark is mistaken for a bear. Mary shoots and kills Mark dead. The brother-in-law then moves in with Mary and Mary collects a lot of insurance money. I feel this could have been planned by both Mark's brother and Mary! I don't think she mistook him for a bear. As the grand finale Marks brother eventually dumps Mary for the babysitter. This convoluted story is almost too much to bear. lol I think Mark's murder was a set-up!
I agree. After living with Marybeth for a time, Mark's brother, Barry realized that living with a murderer wasn't a good plan and that the Babysitter was a much better option. He couldn't expose her to the authorities because she would do the same back to him. They had planned Mark's murder together.
I’ll never understand why a hunter would ever discharge their firearm if they don’t have an unquestionable and clear view of their target. If you’re not absolutely sure of what you’re shooting at, don’t do it. My uncle was shot and killed while out deer hunting. He was found propped up against a tree trunk. It was awful.
Still have no idea why folks don't use high vis orange camo. Bright to humans, blends in with a breakup background to most prey. Even my hunting and tracking/detection dogs wear hunter orange and reflective body armor.
I can't believe this! This horrible woman committed a murder and not only got away with it, but got rewarded with all that money. I can only hope that the only bit of justice in this is that the hubby ( poor marks brother) ran off with the babysitter. A person as narcissistic as her would be beyond devastated from that, I hope it kills her knowing it. She needs some sort of punishment!

I do not think she is guilty. Lots of hearsay evidence not admissible in court and needed for an guilty verdict. No mention of her mental state at the time of shooting. Was she taking the medication? Could have been hypomanic. Dx? Why did the husband increase his life insurance. Her behaviour after the shooting suggests prepsychosi with paranoia. The role of the brother is unclear. Is it a good idea to leave this woman alone with young children? Why on earth would a person with potentially severe mental è à illness be allowed to carry a gun, at least should be accompanied. Seems too many Americans love their guns.
That's wild! So you think someone who's been in a mental institution, is bi-polar, has anger issues.................shouldnt have free access to guns? The NRA and the GOP would hang you by the yard arms for saying that. EVERYBODY should have guns, 30 maybe 40 guns is bare minimum. More is better always. If things go bad, they have their guns.
Lord Jesus. I'm bipolar and that's exactly why my husband's guns are not where I could immediately access them. I've been stable for a long time, but that's just too easy a way to harm myself or others.
I have BP so I understand how blessed you are to have a supportive husband. I’ve met many husbands who divorce their wives once they find out she has any type of mental illness (I.e. depression, BP). There are many BPs, such as myself, who spend much money to take care of self & be good to the people around me. I am sick of the Kanye Wests who continually use their BP to get a pass for their atrocious behavior. And yes, Mary Beth Harshbarger should be in jail. I wish there were more Deidre Westovers in the world who are responsible enough to know what they can or cannot do as a person with BP.
I've owned several Weatherby rifles in addition to dozens of others, and spent a lot of time hunting bears. It's virtually incomprehensible to me how that could have been an accident. Occasionally, hunters shoot others, but it's always in deep woods where only a nervous glance of the target is obtained. But none of that applies here. Plus she was seasoned hunter and shooter.
A 30.06 is nothing like a shot gun. A 30.06 round might make a 1" hole going in you, but would leave a huge hole going out the backside. Very powerful rifle.
Dr. Grande. You explained this in great detail. What I gathered is If a person handling a rifle shoots there husband than says oh I thought that was a bear. Give me a break. She was smart enough to play dumb.

You'd think they would've fought the claim harder and dug deeper into the alleged "accident." Insurance companies know better than anyone when claims smell suspicious and will investigate thoroughly, to avoid paying out large sums to scammers.
@@Locutus The case was suspicious enough its surprising the insurance company couldn't find some fine print or technicality in the policy to avoid paying her. I thought their own policy/review process is independent from legal outcomes, at least partly.
@@Locutus Well before she was tried in court, I would have thought the insurance company might have dug up more incriminating evidence about her which would help the case. They have greater resources than the public police (limited manpower etc. to spend on just one case). It's a large amount for the company to just pay out, if they strongly suspect it's fraud.

But I just thought the company, with their money to pay for top notch investigators who can put in way more time and effort than the police (it's only one case among many for the police) might have dug up more information.
My hubby won't allow his schizophrenic younger brother on our 50 foot sailboat. The sailboat books that he read warned against allowing people with psychological problems to sail. It could turn fatal if they get unstable , very unsafe to everyone on board!

Then there was the time I shot Dad with a 12 gauge high-velocity slug. Big mistake, I admit it. Dad lost his head, the wall behind him blew out, and I ended up with a walk-through bathroom.
IMO, the circumstances leading up to Mark’s death is highly suspicious. I think one of the two following things happened: 1. Beth and Mark’s brother, Barry, conspired together for Mark to be killed on the trip, then Beth would receive the money from the newly increased life insurance policy on Mark’s death, and then Beth and Barry would get together…or… 2. Beth alone decided that she would kill Mark on that trip, and then Beth would receive the money from the newly increased life insurance policy on Mark’s death. Too many things made it unlikely that it was an accident: -Beth and Mark were not getting along and Beth was mad at Mark. -Mark had made the comment to someone about how Beth could kill him and, if she did it, it would be quick. -Beth was bipolar, was quick to anger, and was disliked by many of Mike’s family. -Beth had a history of previously attacking someone physically. -Beth was angry with Mark over having to check into a mental treatment facility voluntarily. -Beth was proficient with firearms and hunting and knew when to shoot and when not to shoot at animals. -Beth had knowledge of what a bear looks like. -Beth knew not to shoot at an object not yet identified and/or at night when something could not be seen. -Mark’s life insurance policy had recently been increased.

My BFF is horrifically bi-polar. She's the sweetest person you'll ever meet and certainly not argumentative or aggressive and when she does need to be hospitalised or go into respite, she's happy to do so as she knows they need to readjust her meds. She manages to work as well, though she's had a lot of work time off lately. Mary Beth's guilty, I think. Her character is a problem when it comes to her being difficult to get along with, not her bi-polar. And Barry is a completely awful person. Mark never looked happy in those photos either. The life insurance increase is suspicious. I think she would have “accidentally“ shot her husband at another time if she didn’t get him on this trip. It would be helpful to know whose idea was the hunting trip and I wonder if the police considered the guide might have been bribed to pretend to stop to pee in the woods, therefore letting the husband go on alone. Any way you look at it, she should have done some jail time.
I find the involuntary conversation coercive usually. I’ve had a number of people who did not qualify for inpatient care come to the facility because the doctor was going to 302 them if they didn’t sign voluntarily. I get it. We need to keep them safe, as well as the public. I don’t care for this arrangement though. If they are a 302 and have demonstrated themselves as a threat, then use the system put in place to protect them and others.
Definitely one bad explosive relationship! I know there's numerous arguments to the contrary, but I will never understand hunting and especially hunting bears. My experiences with bears are all positive and these have been cute and fun as it usually involves playful cubs, but I really do not get hunting bears.................

I have less than zero sympathy for any human who wants to kill an animal. I can't even imagine wanting to do that. The murder and all of the circumstances and details aside, the only thing I can't get past is that these people wanted to kill animals and that makes them demented and Insane as far as I'm concerned. An example of an ability to shoot a firearm call emselves “hunters” but incapable of recognizing the target animal- she is a perfect example of a person who should not have firearms- she failed to follow the basic safety and hunting rules, a bipolar diagnosis should also prohibit firearm possession.

I think that hunters should be allowed to go to giant hunting parks and be allowed to hunt each other. This would get rid of a lot of violent people who like to kill things.

Did you know that it appears from statistics that Republicans died of Covid at a rate of 5 to 1 during the worst parts of the pandemic. Some say that it may have even affected the mid terms. The question is: Did they die from poor medical advice or from worshipping the Beast?
If your wife thinks you are a bear to live with, this is somewhat common and simple therapy might be a good option. If she thinks you are an actual bear and wants to kill you, she is suffering from severe psychosis and a hospitalization is likely going to be necessary.

How that Canadian judge could make that decision of no malice is beyond me. Her brother-in-law lover ran off with the baby sitter while she was in the can is at least some karma. Despite the pro gun rights & obvious slaNT OH HER 'LOVE OF THE OUTDOORS'(KILLING THINGS) & cLEAR oMISSION OF HER MENTAL CONDITION...WHICH WAS nO sECRET AS SHE WAS ALWAYS IN SOMEBODY'S FACE FOR UPSETTING HER ONE WAY OR ANOTHER...opinions were polarized...they were gun & kill happy...she was exceptionally pretty, and flirtatious...& besides that guys around here are drawn to women who love guns. So...she was Always allowed any infractions she desired to commit, including having custody of children in her Known Dangerous mental state... I am Firmly convinced she was misdiagnosed....she actually displayed Psychotic characteristics not BiPolar...there is a big difference between those mental issues. But..this is Good Ole Boy territory & the Letter of the Law is viewed as more of a suggestive guideline rather than..well..The Law. Besides that lil factoid..did i mention she was very pretty & flirtatious? Another thing Wrong with the case...it Leaps out to me that she knew the Insurance phone numbers off the top of her head..Fascinating, especially considering it had just been Radically increased...& she immediately began a relationship with hubby's brother... All are screeching red flags of spousal murder. It is Not hard to co-ordinate a hunting trip...and a murder scene with such easy loopholes such as this one.
