The Philippines is one of only two countries in the world where divorce is illegal.
Join NowThis World Producer Alex Janin as she explores how the Philippines became one the last countries in the world with a ban on divorce, and how that affects its people.
The only other state with a divorce ban is Vatican City - and with a population of under 1,000 made up of mostly nuns and priests, divorce isn’t in very high demand. But in the Philippines, a country with more than 40,000 married couples, more than half the population supports legalizing the practice.
So when will Filipinos in unhappy marriages finally get the chance to move on?

We are officially a Secular Democratic Country and in the Philippine Constitution there is a Separation of Church and State. But in practice we are not. Religion always dominate the discussion in the philippines. And the corrupt and incompetent politicians are playing with religion to stay in position or power.

I knew the Philippines and the Vatican don’t allow divorce, considering I’m Filipino, but I never knew they were the only countries to have it banned. In my opinion, a divorce is something I don’t want to see happen to a family, but it should be legal regardless. It restricts a couple’s ability to decide what to do with themselves and that’s very oppressive and backwards.

Im a filipino american, born & raised in Southern California. Both of my parents are filipino & tbh, I was always raised to look as divorce as horrible thing. If my parents found about that friend's parents were divorced they'd honestly low key kinda look down on them & feel really bad for them. As I grew older, I found that although divorce isn't really the ideal situation to be in.. women really need the opportunity to leave unhealthy marriages. Its just a straight up human thing to do. Let these individuals be happy as indviduals!

My mother has been separated from my father for almost 10 years. They were married for 20 years. They're not legally separated but both of them have their own partners in life now. We their children is okay with it and I think that our goverment should legalize divorce so those separated married people can marry the person who they think is the right one for them just like my mother she is happy with her new partner. And my mother's happiness is our happiness.

As a Catholic, I agree that it is crazy that a non-Catholic should have to live under Catholic law. I don't think Catholics should have to live under a secular law that enforces Catholicism. Separation of Church and State is one of the cornerstones of US law as much as some people try to forget that.

Clarence Viduya It wouldn't be fair if the law made exceptions just because I'm a * (insert whatever religion comes to your mind here) * because at the end of the day, it shouldn't matter. All that should matter is that, like so many others, I am a law-abiding Filipino citizen, and should the day I call upon them for help, will they help? Like I said, I don't expect this to be resolved in my lifetime. While faith and belief are inherently good, mixing it with law and State, and instilling beliefs unto the people's way of life doesn't like harmony to me. History taught us that.

It's not because of Catholicism or Political environment in Philippines. It's culture. No other culture in this earth put more importance to family than Filipinos. That is why even the non religious people opposes this move. Don't get married if you would want a divorce. Non marital relationships are already accepted here.

Let's take a look at this from a Christian perspective. Genesis 2:24 says, "That is why a man leaves his father and mother and is united to his wife, and they become ONE FLESH." From a Biblical point of view, marriage is simply the union of flesh or becoming one flesh. This means as a married person, you have to show that you are indeed one with your partner, that you have become one flesh with them, that you are both compatible with one another. Because you cannot attach a body part to another body if they're not compatible. Sadly, this isn't the case with several married couples. They struggle with abuse, infidelity, etc., and sometimes they simply can't get out of these struggles and instead fail to prove that they are indeed united. According to the Bible, marriage is the unification of flesh, and these couples don't seem to be unified in any way. This only shows that the couple was, in a Biblical perspective, never married at all. The only thing that really brought these two together as a "married couple" would be legal documents stating that they are married, but they weren't really married at all, at least not according to the Bible. This is because marriage, or the unification of flesh as the Bible would call it, is spiritual and doesn't immediately occur upon signing your marriage contract. The contract does not make you compatible with your partner, and the certificate does not decide whether or not you are married (well, legally speaking, yes it does. But the legal and Biblical definitions of marriage are different, so... It's actually yes and no.) Rather, the purpose of these documents should be to signify that you are already unified and, thus, married. On the other hand, the entire process of unification happens over time, and it occurs naturally as you build your relationship. This is also why you should really let time decide if a person really is for you and ask their hand for marriage. If you rush, you'll only be disappointed in the end. Anyways, so how does it relate to divorce? Well, as I said, you cannot unify two incompatible flesh no matter how hard you try. In the context of marriage, this is harmful to either or both people in it, which means separating them is urgent. Now, the only things that really bind these two together are the legal documents stating they are married, which means if these are to be scrapped, then the two people are finally free from one another. The purpose of divorce here isn't to separate the married couples or to destroy marriages, but rather to save the people who are currently trapped in what the law calls marriage. These are for the people who thought it was going to work, or for those who were lured into what they thought was a happy marriage promised to them by their now abusive partners. These are never for the marriages that work because simply put, these couples are already one flesh and therefore inseparable.

Speaking from experience, seeing my parents force themselves to stay together in a loveless marriage depressed me more. 🤕 I would be more okay now if I didn't need to grow up seeing my parents constantly screaming, hitting each other and making themselves cry and I would rather spare more kids from the trauma by letting spouses like that separate. Annulment would be fine if only it didn't cost so much 💵💵💵.

You know, there is a possibility that if someone is abusive to their spouse chances are they will also be abusive to their children. As a practicing Roman Catholic who has been happily married for 18 years and whose parents and grandparents were all married for more than 50 years each, I think that they are out of their minds allowing the Church to have that kind of influence national laws like that. Church doctrine can make for bad social policy. It is great to go into marriage intending for it to be for life. Life laughs at our plans. As my grandmother (who wasn't Catholic, was married to a Catholic and refused to convert) used to say, "Divorce is better than killing each other." My grandparents were devoted to each other in their rather contrarian way, raised five sons, had 16 grandchildren, lived to see three of their now 16 great-grandchildren and stayed married for 59 years until she died after a series of strokes. Yet she always reserved her legal right to leave if she ever wanted to.

We have a lot of hippocrates here in the Philippines and one of the biggest factor that divorce will be oppossed is because ,Churches has a big political influence here in the Philippines which is a big problem and one more thing a lot of Filipinos are really religious, Filipinos believe that divorce is immoral or something (I hope you get my point on this one)..PS I am a Filipino ,I consider myself as an Atheist .I will definitely support divorce here in The Philippines... I will just leave my opinion here.

Many filipinos oppose divorce because it makes legal separation very easy! and many can take advantage of that! annulment on the other hand, might be long and tedious, but atleast it isnt vulnerable to abuse.

Sadly, there’s no separation of church and state in the Philippines as opposed to what’s stated in the constitution. The church has been a great influencer to legislators for ages. It’s time to move forward and honor what’s stated in the constitution - separation of church and state.

I'm Filipino & I'm pro divorce... Legal Separation and Annulment is just failing our society, your video truly explained our people's plight. Yet most are content of annulment or legal separation because of the influence of the Catholic Church. Good thing their influence is greatly decreasing. Hope it ends these couple of years. The State should be secular. No religion should influence the ranks of the government. DIVORCE SHOULD BE LEGALIZED!

the rationale why most of filipinos disagree with divorce is that i think the degree or the impact of marriage will be nullified and therefore will result to couples getting married and getting separated for lowly reasons on some cases. marriage is a very sensitive issue and should be taken seriously.

Annulment is Easy in the Philippines ……...as long as you have money. I have heard of Annulments between married couples who have several children and certainly do not fulfill the other requirements for annulment as laid down in the Catholic church

Marriage has its own definition of its own in each country. In India wedding is supposed to be a life long thing and it had been like that for about several thousands of years untill British brought their idea about their life If you think people around the world are just like the place you live in or the tradition is the same like yours then you are totally worng. And now after globalization people saw the easy life western people lived. No effort in understanding, you feel you cant cope with the situation then termination is the only go they know. Kevin Troy Remember, even if a person has been good for the 50 years of his/her life, he/she could still change. They're not pushing people to disrespect the sanctity of marriage. First of all, there's a reason for divorce. For example, a husband/wife divorces his/her partner because he/she is too abusive, the one who didn't respect the sanctity of their marriage is the abusive one, not the one who filed for divorce. Why? You got married and vowed to love your partner forever. Is abusing a sign of love? Of course not.

I usually oppose the divorce legalization in the Philippines as, I think, it would breach the the profound essence of marriage. I bet that we should see the painful process of separation in the Philippines as a challenge for us, a force that would make us think that entering marriage is not an easy decision. That in order for you to get married, you should be totally prepared, psychologically, financially, emotionally and the like. That entering marriage should undergo bunch of deliberation and maturity at first before you may regret it. I do not also agree to pressure any woman to marry if she is not yet ready. Anyway, this vodeo make me think of the bigger picture and reexamine my stand about divorce.

Sir, I respect your opinion about opposition of divorce in the Philippines. People nowadays have different attitudes, and they cannot force them to love each other. If there is a point that they are already married and have unsolved situations, they have also the right to terminate their marriage. It is also indicated that divorce is prohibited (as stated on the Bible), but making a LAW is LEGAL (as stated also in the Bible) referring what is RIGHT and WRONG, and for the betterment of our lives as well. We need a strong legal basis on that issue. I hope that you got my sentiments.

Well said. As the elder’s would say: “Hindi parang mainit na kanin na pwede mong iluwa kasi mainit”. I’m not 100% sure if I’m pro divorce but it’s such a cool thing that we are one of the 2 countries in the WORLD who don’t have divorce. I understand there are women who are abused etc. But they can flee from their husband too. And start a life, maybe find a boyfriend again etc. But marriage is sacred and when you wanna marry someone you have to be 100% sure you wanna be with this person forever. I don’t think Divorce will really answer to anything since we already have legal separation and annulment, except it will just give you an option to get married again.

No one is really 'ready' in a sense, sometimes, things just don't work out, sure, in the first few years but after that the 'spark' just dies, no one expects that, no one even wants that, but it just happens, you don't plan for it to happen do you? People should have the freedom to divorce especially if things don't work out between the two of them anymore. Besides, what's more beautiful than marriage in which both partners are no longer together, right?

I'd be honest with you. In our school there was a movement in catholic church called "no to divorce" and Catholic schools are forced to join the campaign specially college student. The teacher told us they will give us great points on our grade if we go but he was not forcing us. I find it really idiotic to reward us with something that would really help those unhappy marriages finally let go if divorce was legalized. I didn't go. It's nonsense. Why Catholics are against this when Spain was allowing it in their own country? I don't really understand with this close and narrow minded people. I'm sorry to burst that out but Filipinos should legalized divorce under extreme circumstances like cheating. Although I see that Filipinos were afraid because if we had a divorce, people might just get married and divorce when they think they don't like he relationship and children's are affecting like what's happening in other countries were doivorce has such a high rate. But I think we can also so make our own law regardless of divorce that couples should known each other long before getting married and physical abuse or evidence of cheating must be present to court to legalized a divorce. I k own it would be hard for the part of their children but it would even harder when they both see their parents cheating or seeing their mother getting abused. I really agree that divorced should be legalized and Catholic church should be stop going into the political affairs and should focus more on spreading the word of God. I'm sorry but we're not in medieval ages anymore, were on modern society were practicality is more important that being martyrs. PS. My mom and dad were separated for ten years now because mom cheated on dad when he was working abroad. I didn't see her since but I support divorce not for the sake of my father but for the sake of everyone whose marriage fall down.

This is because of too much influence of their religion. its population spiraled out of control because the religion discourage its people to use modern family planning. Annulment is only for the rich people hundreds or even thousands of unhappy couple cannot afford to a country where most of its people are living just above or below poverty line. Priest and nuns are very vocal against this law and yet they don't know how it feels like to be trap in a stressful marriage since they are not allow to get married. yes marriage is the foundation and sanctity of family but this only applies to those who are happily married, it wont encourage every couple to file divorce simply because it exist. divorce is only applicable to those who badly need it.

Shadowschannel1 Have you ever thought before these couple went into marriage, they would have known each other first? If the relationship includes like abuses, then why did they even pursue a higher level of relationship? It is best to not include all the citizens because of their personal problems. If the divorce is implemented, then their a higher chance of having a lot more cases similar to this. Knowing people, they would abuse this concept of divorce. Making a widespread of unstable and unhappy family. There would be thinking of "oh we have divorce, if there's even a small argument, we can just have divorce". And there would be a less thinking of a well thought marriage. And they would choose that path of divorce rather than thinking of sorting things out of their own relationship.

It's a special CONTRACT! The way the state view, it's technicall the same as going into employment contract. You sign, then work. You leave, then resign. Well, except it's special. Read Family Code under our Constitution not your so called "holy book".Your "morality argument" is total bs! What if one or both spouses were no longer happy with their marriage? Christians view polygamous marriage as immoral but in Muslim its not. Who is supposed to say which is moral and not? Your HOLY CHURH? How about other religion? The government should weigh each side and options. I know that the Philippines is a family oriented country. So it is really hard to pass a law that will nullify the marriage. The fact that the Filipinos are mostly Christians. What God has joined let no one separate. So please younger generation. Pick the right person. Don’t rush things. Getting married is not a race. You chose to marry the person you don’t love. . Not because someone tells you to do, it doesn’t mean it is the right thing to do. Be brave, stand firm. Clearly, you don't know Philippine's culture. Elders/parents have so much say on the children, that includes marriage. If a woman gets pregnant unplanned, whether that guy is her boyfriend or not, whether she loves him or not, they have to get married or it would mean WAR between families (figuratively speaking). I bet she got pregnant at 19 that's why she got married! Nobody gets married at 19 unless you got pregnant. FYi, we don't leave our parent's house when we reach 18. We still live with our parents and we are going to the university courtesy of them.
