nah if you watch the full vid of it in the bar it was clearly a fight , even the family is saying it was something that just got out of hand and wasn't a murder.
@@jamilusalisu8075 let me rephrase, murders are when people commit homicide with prior intent to kill before engaging, I'm saying she didn't have the intent to kill which is also the reason she was charged with manslaughter not murder.

Intent is part of the subjective element of an offence - the mens rea - which is separate from the actual act that was committed - the actus reus. For the offence of murder, “intent” requires a subjective foresight of death. We cannot determine whether that existed from merely watching the video. Surrounding circumstances and facts that have not been disclosed to us yet, can make a pivotal difference. There is a reason the Crown decided to downgrade the charge from second degree to manslaughter. They don’t do that unless they’re convinced that the facts of the case won’t support a conviction for murder, usually because they wouldn’t succeed in establishing intent.

@@ferdowsroble5509 stop grasping at straws. It was a horrible thing that happened but this isn't a race thing. Two things happened: -The deceased attacked first -No stabbing occurred. The deceased was thrown onto the ground where her throat was cut by broken glass.
Disappointed with this decision but not surprised. I looked back at the video and it appears no weapon was visible in her hand . It just appears like it because she’s punching her in a stabbing motion instead of a clenched fist . Hodan must’ve suffered a lacerated artery when the girl through her down on the ground; as their was a broken bottle right next to her. Thats why initially the suspect was charged for murder but then as they gathered more information, it was later downgraded to man slaughter . I hope I’m wrong though. RIP Hodan & I send my condolences to her family
Did you watch the video? The white girl initiated the fight, used a broken glass as a weapon and stapped hodan multiple times in the nick and face. White privilege is real
@@ferdowsroble5509 The video starts midway through the fight . Also its impossible to see any weapon in her hand in that dark club setting, especially with the video shot in poor quality . I agree white privilege is real but for them to downgrade it from murder to man slaughter, they saw no intent to kill . This would presumably mean they have evidence and eye witness testimony that no weapon was used. Another reason for that charge would be self defense and maybe she did have intent to kill but Hodan started it and therefore they think she was justified in defending herself . They would have let her walk but because of how grotesque the incident was, police went with man slaughter . Again I’m just speculating and trying to understand why they would downgrade it.
Yea, watched the video and initially thought she was stabbing her but I watched it a few more times to understand where the blood came from and realised sadly that kind of blood pool so quick could only come from ab artery and then I saw the glass and realised she must've hit the glass when the both fell to the floor. Sadly m, it is manslaughter I'm sure that girl didn't realise let alone wanted hodan dead that's why the fight continued but the fight 100% contributed to hodans death. What a waste of a young life. I pray her family get justice and closure because the awful way she died alone will traumatise them for a lifetime
@@Arawelo24 Yup. It was a significant amount of blood and that doesn’t come from multiple stab wounds but from one big cut. Its sad because this was apparently all over a boy. Everyone in that club failed her. Those men are cowards, they should’ve pulled those two away but instead they encouraged them
@@taximan031 I think you're right. Im gonna guess it will go to trial and all charges stayed. Not only does it appear no stabbing occurred, it also sounds like the accused was attacked first.
