Woman Fighting Tiny Home Ban Left Homeless

The housing crisis has hit every corner of the country and few places have been hit as hard as the Boise area; housing prices increased 118% between the first quarter of 2017 and 2022. That is more than double the national increase of 50 percent over the same time period.

Chasidy Decker, a native of the Treasure Valley, had a savvy solution after being priced out of the traditional real estate market: she bought a beautiful tiny house on wheels and found a local homeowner who would let her park it on his property.
Many homes in the neighborhood have trailers and RVs hooked up to them, so imagine Chasidy’s shock when just 1 day after she moved in, the city ordered her to move out or face criminal charges and up to $1,000 daily fines.
At a time when people are struggling to find affordable housing, it makes no sense that the city would rather see Chasidy homeless than live in her lovely, safe tiny home.
This is unconstitutional. And IJ is fighting back.

Do you have a back yard? Does it look at your neighbors back yard? How would you feel if the neighbor put a second home in their backyard, so that the second home stared right into the back of your house? Into your living room? Into your bedroom?

@@johnwesley256 No, your analogy is wrong. Your neighbor has a back yard. Not a whole other house that is way closer to your house. And there is legal recourse to prevent people from filming you in your own house. The neighbors security cams can't legally do that.

They do it all the time. I have had threats like that. Two ways to deal with. Drag them into court immediately to gain time and/or throw a few hundred dollars in some phoney fees at them to make them go away (modern corruption).

I don't care if this city is Dem or Repub dominant, this kind of authoritarianism needs to be stopped. One side says "Let's go back to the old days." How do they think people lived? Small domiciles or wagon trains/nomadism. The other says "We want you to have a place to rent, but only if you get it through our social programs." Absolutely BS, either way. And making laws to make this way of life illegal or difficult is unacceptable.

Im not live in US...in my country you can build tiny house or even a castle on your own land as long you follow safety building regulation...zoning not too strict...you can open groceries store...workshop...health clinic...pharmacy...electronic store...and other small business at your house in the neighbourhood...so if you want to buy daily necessity you dont have to use vehicle just walk to the shop...local business not only good for local economy but make neighbourhood more safe becoz we become know each other and sharing info...we know who our neighbour and who is not...zoning become strict only in heavy industri area becoz safety reason...sorry for my broken english...

Funny thing is I had a tiny home on wheels built 4 years ago in Idaho. About a year later, I bought property in Nevada and put 2 pads on it. I never had any problem with any government agency. I recently sold the property and am living in my tiny home again. Idaho has some very stupid laws including cannabis prohibition. There isn't anything wrong with what this lady is doing at all. I hope she had the same builder.

Same thing happened to my church. Some neighbor complained about litter and "unkept weeds" on the property of the church, school, and living complex that are all next to each other. They also sit on a busy road, so most of the trash is from that. When they realized they couldn't get the school and apartments in trouble, they settled for trying to get us sued.

People only tell you not to sue them because they're hoping you won't. A team of lawyers helps their chances of winning a lawsuit... but whether or not they win in court is not their fear; they fear looking bad to the public they're supposed to answer to. If a lawsuit is brought against them, it's a lose-lose either way it goes; even if they win it hurts them in the public eye. Why so many cities settle if they get sued, even if they think they'd probably win (that, and well, it's not their money anyway so why not settle).

Just be polite and truthful and you won't have to film all your encounters. I still think it's a good idea, but make sure your priority is keeping the situation safe, not documenting it. RU-vid has hundreds of videos of cops overstepping, but tens of thousands of videos of people with cameras being the antagonist. Keep yourself just as accountable.

@@commenter7893 There is quite a logical leap from tiny homes to shanty town. Tiny homes can be (and in smart polities are) covered under building codes. Codes also cover things like power, water, and sewer hookups as well as trash collection and fire codes (one of the reasons for gaps between structures is to slow the spread of fire and allow access to fire crews between buildings). - The major difference between mobile home parks and tiny homes is perception. Well, that and higher ease with which a tiny home can be moved if it has wheels.

Zoning laws are a double-edged sword. They were envisioned to keep industry from encroaching on residential areas but are more often used by the wealthy and powerful "haves" to lay down a minefield to keep away the less powerful and less wealthy "have-nots" - which often has undertones of racial bias. I've been involved in Zoning laws from studying them in school to working with local government in large cities and small towns as well as working in real estate and heard the everpresent cry of "It'll ruin my property value!" frustrating development to help people in our growing housing crisis at every turn. It drives me nuts

It is so important for people to check zoning laws first before setting up tiny homes or parking an RV to live on someone's property. Different towns have different laws. If someone isn't happy with a law, then they can go to zoning board meetings to appeal to change laws beforehand (or find a town with more lenient zoning laws).. It so easy to check beforehand before ending up in a mess.

@@bikebudha01 that's what HOAs are for. Zoning laws just make housing so unaffordable that it keeps people in poverty and increases rates of homelessness and crime. I live in WA state and am in my mid twenties, everyone I know from highschool is still living with their parents (even those with good paying jobs) because we have been priced out of the market. Even with two incomes most people can't make rent... It's 1500 a month for a nasty studio in a part of town that is known for shootings and drugs. That's the market entry point... And you have to make 3 times rent a month to even qualify anywhere. People literally cannot afford to live on their own, families are all living together now when in the past people were able to go out and make their own lives...

The entire state of Florida bans people from living in RVs or tiny homes with wheels, even on your own property EXCEPT in an RV park. I paid cash for one acre of rural property and for my home, but I can't live there. Lots of people get away with it, but I'm just so tired of fighting it. I can't even have electricity on the property. They specifically told me that I couldn't have a permit for an electric meter because they were trying to prevent people from doing exactly what I want to do. I'm in the middle of no where, far away from any housing or tourist areas. I just wanted be left alone. I just need live in my RV long enough to build, but I needed to be able to live rent free to afford it. They won't even allow that. Guess my retirement is canceled.

It's unfortunate. But bottom line is if you are going Tiny you have to fully investigate zoning. The home owner assumed rather than doing his homework. Change will only occur when residents work to get zoning which allows this. This is not unusual yet people keep investing in Tiny Homes before they have a guaranteed place to put them.

Re: Content form. This is a great re-cap of what is obviously a complex case. I don't always have the time or bandwidth for 20 minute+ presentations but I'm always interested in the cases you guys take on, so the short-form is a great way of getting at least the Cliff's Note's version in lieu of the full version. Thanks for all you guys do for all of the people who desperately need a larger and more powerful voice. Checking self-righteous and abusive bureaucracy is a critical component of the Fifth Estate(true journalism, that is), which necessarily needs all the shoring up it can get.

The "land of the free" has the strictest zoning laws in the world. In Europe you can build how you want, you can even open a business wherever you want, for the most part. There's no such thing as single family zoning and business zoning there. Apartments, single family homes, townhones, small businesses, tiny homes, doesn't matter. In America, everything has to be strictly segregated.

In Minneapolis metro there are 1 to 2 places for rent on Craigslist each month where as soon as you move in you become a target. It's a clearinghouse for the community. Cleaning low income undesirable people from the roster so to speak.

I suggest a third option of allowing and making it affordable for people to buy land on which to build homes that suit their needs and tastes. Not all of us responsible homeless people want to live in a small box (aka tiny home) before we die.

Greedy developers and municipal govts who want to maximize their tax income per acre...here in Florida they are putting $500,000 homes on 1/8 acre lots (less than 15feet apart)..one result of this is that they COMPLETELY clear the land when they start a development- not even a blade of grass survives, much less the hundred year old trees and other native plants..this has become standard practice..

Firstly, NIMBYs and actual concerned neighbors. For NIMBY's it lowers property values, and brings in lower-income residents who have statistically higher crime rates that nicer neighborhoods act as an explicit filter against (debate the ethics all you want but it IS a factor for landowners and parents). The actual issue, for groups of homes is if your neighborhood, designed for 5 families, suddenly has 20, and as many cars, overloading power and sewage systems, it can be a large and disgusting problem. So Zoning is indeed a real issue, albeit kinda rare to get that bad. This situation is a bit different, but nobody wants to open a loophole. The waste and inefficiency of tiny homes over an apartment is my contention. It spits in the face of environmentalism while pandering to it's fans. An apartment takes less material to build, costs less to heat and cool, and less systems to maintain. It is in every way worse for the planet, if you are living in a populated area, not to just rent a room.

New, affordable, attractive home = a solution to the housing crisis. Maybe people like Elon Musk, with his tiny home manufacturing company, his forward-looking stance, and his considerable resources, will look at this case and decide to support it in some way. I've thought alot about investing in a tiny home, but the situation this tiny home owner is going through is reason enough to hesitate. Are her only options really moving onto a RV park, or buying some remote plot? The bullying enforcement is such a senseless control trip. It will be a real pleasure to watch this case gain national attention and see the lawmakers, administrators, and enforcers of this short-sighted city planning/zoning office taken apart.

I spent 6 months in boise over the pandemic. I had funds from the sale of my home to invest and was looking into Boise as an option. BUT at the time Boise was turning into the next California. House prices were on the rise and many home were being sold first day on market and for over 100k over asking.... for a small 2 bedroom box in the neighborhood. No thank you! Government overreach has reached a all time high and all the resources that are needed to keep people housed with clean air water and food..healthcare are being given to Karen’s with badges that can’t wait to push their authority. It’s awful. My generation has suffered at the hands of government- bailing out banks, recessions, covid, job loss, wars and inflation. The system is falling in on itself. And for those of us that don’t have 400k to live in started houses in Boise get shafted when we seek clean, respectful alternatives. So sad!!

Authorities should not be allowed to limit the smallness of a home if the land is owned and it’s built safely to “codes”. This is ridiculous we are FORCED into larger house just to fund the city in taxes! (more taxes owed on larger homes) This should not be allowed.

I know my town would never allow a RV park. Heck they don't even allow me to park an uninhabited RV on the driveway unless it's in a garage or hidden from sight. I guess the RV crowd is the poor crowd and that is the line of thinking. It reduces neighborhood property values while potentially increasing crime and further reducing property values.

Many are saying tiny homes will bring down property values. Think about this: There are many cheap parcels of undeveloped land - off the grid - not smack in the middle of community developments - zoning says you can't buy a parce of land & live on it instead of living in your vehicle in downtown, or shopping center due to zoning. Do you really think people living on the streets & throwing up tents outside on your sidewalk will be better?

I wish I had help suing philadelphia and the police due to a woman that made a false police report, my rights were violated in every which way. I spent 4 days in jail for something I didn’t do. There was multiple court hearings but for trial the final one she refused to show up but I did and this happen twice. She didn’t show up because she knew she perjured herself. So now I have to fight the charges $$$ or they’ll be there forever on my record. This woman ruined my life.

You have to remember, the reason why zoning codes are the way they are is to force people to buy larger homes which are more expensive so that the lumber, mason, electrical, etc etc companies all make a sizable profit and the gov can collect more property tax from the residence. The larger the property the larger the tax.

These rules are more common than you know. Mississippi is one of them about tiny homes. Louisiana tried to enforce an ordinance that you can not live in a camper on your own property. It's ashame the way the government is trying to control everyone.

They say they don't want "big government", which is why they fight against things like housing assistance, environmental regulations, entitlements like Medicare and Social Security, etc., because they "help" people, but they have NO problem making government big enough to bully people with. There are health and safety reasons to why a city would have municipal code. It isn't to "keep your grass cut bc it looks pretty", but rather to deter vermin et.al. When you justify ignoring the law and doing whatever it is that you want to do, where do you draw the line? If you want to change the law, there are ways to do that, OR petition for a rezoning.

I've always had bad opinion about zoning laws. I understand they are necessary to a point but I think they go way too far. I think US zoning laws contribute to health issues, fossil fuel consumption, economic issues (incl but not limited to higher barrier to entry to start a business) & more.

My $0.02: I hate "tiny homes", no different than a single wide trailer in my opinion, except less useful, BUT, if the RV hookups are allowed, then the trailer should be allowed. They need to get rid of the hookups to get rid of the trailer.

"They" don't want to make it easy. What they want is for you to be indebted for life. How else would you explain that in the US a "house" made out of cheap wood and plastic costs half a million dollars? I know a guy who bought a 10 room hotel (just rooms to sleep) in a touristic place in Spain called "Benidorm" for $70.000 The guy built a mansion for his family. And his 5 kids + him and his wife have a Mercedes 350 each, with the money he made from the hotel.

OK, so I have two separate thoughts about this story. One, it does appear that the woman was in violation of the city's ordinances. It also appears that the city retaliated against the woman when she exercised her 1st amendment rights to criticize the city and when they attempted to intimidate her weeks after the incident. I hope the ordinance is changed to something more sensible, and I hope anyone involved with retaliating against this woman is reprimanded or terminated.
