The judge: Quiet in the gallery! You say another word and you'll regret it.
Jane: Well, I'm sorry your honor but this woman is spatting nothing but ludicrous petty forgery and I'm a little hungry.
Lisbon: Your honor if you'll let me down I can handle him.
The judge: Well Mr. Jane. That is your name, correct?
Jane: That is correct; Patrick Jane.
The judge: Well, this court here by finds you 1000 dollars.
Jane: Make it 2000 and let me tell this tiresome woman to move it along.
The judge: 2000 then!
Jane: Okay.

He also has a heart made of stone. He watched the murder video ... though, you don't see the suspect in the video. I still don't see how it could have otherwise been found and then planted on him unless it was an elaborate conspiracy. In a way, this is a good judge, because he upholds the rights of citizens, but in another way, it's tragic on a human level when evidence gets thrown out in real life over things like this.

This chapter ends with the judge fining Jane 16k, which would be really funny if we hadn't seen Jane made a quarter of a million dollars in a few hours playing poker on two different occasions.

It's a sad legal system that you can have definitive proof someone committed a murder but they don't get punished because of a technicality. I understand that you can't have police doing extrajudicial searches but if there's evidence there's evidence.

hooligan bubsy unfortunately if the evidence is not collected properly it can be argued the evidence was planted, forged or otherwise tampered with. That is why all evidence has to have a clear chain of custody. Any person who has any contact with the evidence must be documented and vetted. If a murder weapon is collected by officer A, brought to officer B , checked out by lawyer A, and brought back to officer B, then your golden. But if somewhere in there officer B let his cousin, a 18 year old who was visiting him, play with the gun... well who is to say he did not switch the gun or something. So the evidence is now invalid.

When there in enough evidence to convict the criminals always weasel their way out, when there is little to no evidence innocent people get arrested and thrown in jail ranging from a few days to a few months (false claims, or claims that lack evidence)... What a world we live in.

It stops the police, both local and federal, from exercising too much power. Sure, it's not perfect but consider the alternative. What you're asking for is totalitarianism. The Chinese police don't need warrants are you saying that's a better system? My dad is a lawyer and he always told me that the American judicial system was,"the worst in the world, except for every other one." It's corrupt, full of bureaucratic flaws, thousands of meaningless, tedious laws written by politicians who are almost universally lawyers, and inefficient. But it's about the closest thing to a good system that has yet been found.

One of the scenes I like is when Grace and Patrick go to a store and before they went in she tells Patrick not to embarrass her. Which of course he promptly did. He got the people in the store thinking that he and Grace were lovers. 😄

Laughed when I heard Jane use the word 'pettifoggery'. I wouldn't have caught that at all when it first aired. That's the word that Chief Justice John Roberts used during the first night of the President's Impeachment trial in the Senate.

That had me laughing. It was a very entertaining show with good actors and the show kept my interest. It never seemed to stall; it flowed well from scene to scene. Is that a result of good directing and editing?

Good script as well. The dialogue in The Mentalist is top notch. Bruno Heller (the showrunner) has been praised for his pacing, and rightfully so if you ask me.

Handsome Man what’s wrong with your fundamental logic? A fine is a reluctant payment made for a bad behaviour. If you are however willing to pay for it, what does that make it? A bribe. 🙄

except that the person who you might say was being bribed (the judge) would never see a penny of that fine, so there is no incentive which is actually what a bribe is for. If i pay john smith $10 then ask you for something, that is not a bribe because the two have no monetary or other connection

Waoh!!! The passion and anguish in that man's tone of voice, plus the arrogant way the criminal strutted off, tells the FULL story. That's why I'm glad there is a supreme court of the Universe that no human on earth will ever escape - on this or the other side of eternity - that is so comforting. Just give it time!!! So, when humans are done with their crappy judgments, best believe The Supreme Judge of the Supreme Court of the Universe, will do HIS own - just give it time. The criminal MUST either confess and / or restitute or pay for the crime, eventually. No other options exist in the Supreme Court of the Universe.

The way it SHOULD work is if evidence is obtained illegally then it should be counted but whomever obtained the evidence illegally should be punished for their crime as well, instead of letting both go.

I agree. If someone is guilty and there is evidence, punish them, but we can't have police deliberately obtaining evidence illegally because it would create an Orwellian society, so if they obtain it illegally, a punishment for them, as well.

“Fruit of the poisonous tree”. Ha. I am glad that this is not a thing in Germany. There such things could be ruled as illegal, people would be fined (or even sentenced) but the evidence would be used. There is a possibility that evidence can’t be used, but the judge decides that on a case basis.

Things like this (this fictional example is highly hyperbolic, btw) are unfair-and it's up to good lawyers and law enforcement officers to work within people's rights to execute justice-but the federal government has no business inside my house on a hunch.

@@sevensailsinsymphony , the truth much more important than perfect technicality in german courts. There is a reason it is called an inquisitorial process. At the same time, please note, judges here are not very fond of police officers just breaking into people’s houses. We had a case where the police “sneaked” into a house and the judge ruled self-defense when one of the officers was shot and killed. (He was actually quite angry at the police for not using normal procedure) It is not an automatic process over here. Most important distinction: In Germany, judges are not just arbiter in a dispute but do their own questioning (at least in criminal law cases, it is more nuanced in civil law), and come to their own conclusion. Also, emotional arguments are much more difficult here, as there is no jury you can sway. We have lay judges but those function very differently (out of scope for this discussion).

@@BlackandGold83 I really appreciate your thoughtful response. I think there's a general problem with politics and law in the States in regard to emotional manipulation. The difference between the US and other countries is the foundation of our government and the principles behind it. Americans like distribution of power. Having a jury is a purposeful check for corruption in positions of power; government by the people makes it harder for those who have influence to take advantage. It's also harder to bribe a jury, and more likely a jury will be measured and fair because it's made up of people like your neighbor, your mailman, and your kid's kindergarten teacher-not career politicians who potentially owe favors. The US is shaky right now because The People are uninformed, passive, and apathetic. Our system of government only works to govern an educated, involved, enthusiastic people.

@@sevensailsinsymphony, and we go a different way to rid ourselves of corruption: Legal system and Executive System is very clearly separated. Even to get rid of an unwanted judge, a politician would have to fight a very hard fight. Forget it if you don’t have clout on at least a state level. And over here, judges (and DAs) see themselves more of servants of the law and it is very seldom that they lay the foundation of a political career. It probably has to do with that they are “Beamte”, they are not elected but sworn-in officers of the state. Also, germans don’t think of the state as something different from the society, we also don’t have such a clear distinction between communities. For example, most germans don’t really get why a sheriff in american TV caters so much to the needs of his community, as most police officers over a certain pay grade are expected to change postings quite often in their career. That is also the reason we often find it quite funny that people have problems with the FBI. The german pendant to the FBI looks exactly the same as local law enforcement. So the idea that only locals can judge over someone is seen as alien over here. I understand the roots of the american law system. It gives different answers to the same humane problems every society has: How to live in a peaceful and just society? For me it is sometimes very alien in the particulars but I won’t say it is a “wrong” system. Ok, I personally really like our system but it probably has flaws too. 😅

@@BlackandGold83 As an American, I just always find it funny when Europeans compare their countries to ours one-to-one. I don't think a lot of Europeans have an idea of the sheer geographic size, population, and radical cultural diversity of the United States. Germany's national government is more comparable to our local, state government. Of course our local officials need to cater to their specific communities. Changing a post from California to Georgia, within our national borders, would be somewhat like moving from Sweden to Greece, or from Germany to Kazakstan. The cultural difference is not minor. Imagine that Europe (excluding Russia for its size and the sake of argument) were united under a higher level of government. That would be comparable to our federal government (and our FBI)-it's understandable why individual states balk at it. Imagine that every citizen in every European country had a vote to elect a president who would make unilateral decisions for the whole of Europe. From an American perspective, it's funny when European people-whose cultures are neatly divided into countries and kept separate under different governments tailored to them-look down on the US for our political disagreements. They generally have no idea how well unified we actually are, in spite of all our cultural and racial differences. I'm certainly not saying that's what you're doing! This is just a soapbox of mine. I like our structure of government and want to keep it; what works for European countries wouldn't work here.

Any good lawyer could smack that down. The consultant wasn't told to do anything, didn't take any evidence from the scene, and the video wasn't found by means of a search warrant. It was shown by the killer willingly. From a legal standpoint, the police didn't obtain the evidence through any illegal means. They got a tip from what amount to a private citizen and acted on it. How that private citizen got that tip only matters if he is under orders to do what he did.

not correct . you don't have to be under orders from a superior to break the law . you can break it yourself . jane was not acting as a private citizen , he was acting as a consultant on a specific case he learned of from police .

Amazingly in this day an age anyone can plant any kind of forensic evidence given the scope of technology available. It's good that the truth is spoken in front of him. Not sure why he lies, when the truth he uncovers can be found by not lying. Flawed characters are considered more interesting and help make official entities look competent on TV.

Am I the only one who think that Jane purposely left his fingerprint on the cup so that the case will be dismissed and the psychopath hitman will be release then? 1- When the hitman was release, Jane know the real culprit a.k.a the man who pay the hitman will kill him to shut his mouth. 2- Also the release of the hitman is to lure the real culprit to make his move by killing the hitman with his own weapon. 3- By the end of the episode, Jane manage to reveal the killer because he killed the hitman with his weapon once the hitman was release (because of the lack of evidence when Jane crap of it with his fingerprint). 3- Jane successfully to lure our the real killer, and executed the psychopath hitman "instantly" without needed to wait for legal proceedings.
