UK gun laws can be complex at the best of times, with there being particular confusion around the sharing of Section 1 "Shotguns" I thought it was important to clarify. Enjoy!

In my opinion once you have an FAC you should be able to shoot any gun you like, you’ve already been vetted so why does it matter?

Even then i don't even know if that would hold up in court, the "I didn't know the law excuse" typically doesn't work well as a defence.

Unfortunately ignorance of the Law is no defence. If you are prosecuted for using a sec1 without authority even if the police told you it was ok, you would still be guilty of an offence. You could use the police advise as mitigation to much reduce any sentence, but you couldn't use it as an absolute defence

Thanks for the information , just wish we had a strong gun lobby’s like the yanks . We just roll over here ?? Killing our own sport on a daily basis and we don’t even have a gun problem

@@britishbalaclava I should have specified by saying all gun laws. Im just speaking from my experience and its okay if you dont agree, I understand. But think about this, why is it okay for those in the Isle of Man and N. Ireland to have more gun rights and access to a far more selection of firearms than the rest of the U.K.?

Since a precedent was set about long-barrelled pistols sharing. Should this information be amended. I believe the case was won due to a long barrelled pistol meeting the same criteria as a rifle: min. 12” barrel and a min. overall length of 24”. I would be interested to see what you say as it would, surely, affect the law as a whole and not just the constabulary concerned.

With the 3 shotgun shell restriction what would prevent someone from using the mini shotgun shells and getting for and I still think it's ridiculous that you cannot use shotgun slugs in a shotgun in the UK without a firearm certificate I guess the best you can do is buckshot for large game like a bear

Do you plan on any time in the future having a video dedicated to Lee-Enfield rifles? I'd like to see what the domestic UK culture is like surrounding what is ubiquitously known around the world as "Britain's rifle". Here in the US, there's no shortage of love for platforms like the M1 Garand and AR-15. I'd like to see something like that, maybe on the Lee Enfield Rifle Association.

What does 'share' mean in the context of section 1 firearms/shotguns? Does share mean borrow ...as in take away from the owner for a period? or would it still be classed as sharing if two FAC holders with S1 shotguns were out shooting pigeons in the same hide and swapped guns for a couple of shots with the other present the entire time?

Not allowed to swap on S1 shotgun or LBP, even if both of you have an S1 shotgun on your cert, which is dumb TBH considering you've been legally cleared to have one, Its pretty crap for someone new to the sport as you would like to try a few different options out before you buy and guys in your club would happily give you a go had it not been against the rules.

@@weegaz22 wrong, LBPs are legally rifles. hence why they have to have a minimum length, even says so on your certificate. so they are the same as any other semi auto rifle on your cert. no idea bout lbrs, i dont have one

So, what is the future for UK shooting in general. Can we ever hope of these old laws changing or will we keep sliding on this slope until they eventually just implant chips in our brains? Hate to be the so negative, but it just never seems to get better, only worse ☹ Edit: atleast we can not pay the TV license and not watch TV, so I guess that's a plus?

The Conservatives have said that they're going to do away with the BBC licence fee - or rather decriminalise it. That may not seem like a big thing to a lot of people but it actually encompasses a huge area of anti right (including anti gun ideology when it arises), anti individualistic thinking etc. This continual drip drip of misinformation and fearmongering, not to mention ostracising and condemnation of anyone identified with a "wrong" opinion (recently Laurence Fox etc). Cut that off and people will go back to forming their own opinions, the influence of social media and alternative sources increases, and we could potentially have a huge shift in thinking. Whatever happens it's difficult to argue that the Left haven't screwed up and gone too far - ordinary people have clearly had enough. To get anything back (firearms wise), long term, it's going to take that sort of fundamental shift. But I think this could be the beginning of it. The Cons need to be brave, do big things and stick to the vision outlined. This isn't the time for them to play it safe.

Fortunately here in New South Wales Australia we are able to share fire arms, at a pistol club or rifle club. If a person is thinking of joining they can do a written multiple choice test and do a quick training course then be eligible for a thing called a P650 which is a temporary arrangement until they apply for a licence (pistol) . Our club has pistols available for training, but you can swap pistols amongst members as long as you have a H licence or a provisional licence Unfortunately at the present time it can take up to three years to get from a P650 to H licence .With long arms if you have an A B licence you can borrow firearms from another shooter provided your safe keeping is up to the standard required.

Technically yes, a club has challenged this in court and won but most people don't want to go through court and do the same.

Thank you for making this video, clears up the query I made on your other video yesterday! Why on earth are LBPs not exempt, how on earth is anybody meant to get in to 50 m pistol shooting. Actually, for that matter, why on earth was it dropped as an Olympic sport!

A good presentation so well done. Although it may seem odd after all a shotgun is a shotgun, if I remember rightly the objective following Hungerford was to outlaw automatic weapons. In this respect whilst traditional shotguns were twin barrel side by sides and later over unders, the pump action shotguns represented a challenge because of their magazine capacity and the compromise was that they should be restricted to 3 rounds only to be treated as shotguns and a greater magazine capacity meant that they would be treated as firearms.

Great video! I was always told that a section 1 shotgun and LBP aren't allowed to share as centre fire semi autos are no longer legal in the UK, yet these are centre fire semi autos so probably, technically section 5 firearms, but are exempt so stay section 1 with restrictions. Is this correct?

How does the magazine capacity constraint deal with the existence of minishells? A magazine capable of holding two 3" shells can hold three 1 3/4" minishells, a magazine for two 3 1/2" shells will hold four minishells. Does the UK have a legal minimum length for cartridges? Do minishells mean that by the letter of the law no Section 2 shotgun can now have a magazine longer than 3 1/2" in capacity?

AFAIK Legally the moment you put a third shell in the mag of a S2 shotgun you're breaking the law. There are no laws on minimum shell length though.

@@DEADB33F I agree, inserting a third shell would be illegal. It demonstrates that the shotgun in question is capable of holding more than two in the magazine. But isn't the classification of the gun based upon whether it is capable of holding more than two, rather than whether or not you choose to insert more than two? Do minishells mean that every magazine fed shotgun should technically be classified as a Section 1 firearm?

James Bradwell well from what I have heard that’s actually a grey area as no modifications have been done to the gun. And my local RFD had gotten in a batch of shotguns like this and he contacted to make sure and they said they didn’t want to know/ care. Due to how difficult it would be to deal with. You can also ghost load some shotguns to so could get an even higher capacity. I’m sure the law actually points out that there are grey areas and shotguns that can hold more and creates an exception.

James Bradwell wrong. The restriction is on the physical properties of the gun, not its use. If the law does not prohibit something then it is permitted. Section 2 guns are magazine restricted to 2 unfired cartridges of the nominal maximum length the gun is chambered for and then and proofed. Since this needs to account for longer roll crimped cartridges, if you have a 3” chambered gun then you will likely fit 3 65mm and possibly 67mm cartridges in and for a 3 1/2” gun you’ll probably fit 3 70mm cartridges, nothing says you can’t ghost load the gun either. Mini shells then just become a matter of degree.

caterpillardriller I was under the impression the law did point out exceptions as you mentioned? I thought it said stuff like 2(+1), 2(+2) and all that. So you could technically get a 5 shot gun? And I don’t think I would risk it to be honest. And is the capacity restrictions only on for magazine or cylinder fed shotguns? So you would have a 10 barrel shotgun on a section 2?

I think there's some flawed logic at work here. As far as I'm aware the firearms act does not make any distinction between firearm types covered by the exemption that allows members of approved clubs to possess firearms and ammunition for the purposes of target shooting. It's not so much a case of section one shotguns and long barrelled pistols being left out, the legislation in fact was in force before the handgun ban of 1997. I believe the confusion arises due to what specific clubs are APPROVED for. As such if a club is not approved for the use of shotguns and long barrelled pistols within it's home office approval then those types of firearms can't be possessed within the exemption, however if the club is not approved for that specific type of firearm it begs the question how have individuals obtained variations for these firearms without being a member of an appropriate club. I find it interesting that you show the two Benelli's and make the distinction between one being legal to borrow and the other not, if you apply the same logic you could only lend the section 2 Benelli to either another SGC holder under the 72 hour rule or a non certificate holder if the club were approved under section 11 as many clay shooting grounds are.

So on the same lines, how does this stand for a license holder who uses one for vermin control? For example you can allow other people to use your rifle to shoot a deer under your supervision, but presumably this law still stands in terms of a sec 1 shotgun being used for vermin rather than at a club?

LBP is technically a semi auto rifle. hence why its allowed. my fac slot for the lpb is a 'semi auto rifle'

I’d say that the definition that your government uses for shotgun is stupid, but the ATF decided that the Franklin Reformation is a shotgun and that shoots .223.

That's the big difference with FAC/Section 1, you do have to give a reason why you'd want a particular gun. If you're a member of a gun club where they do practical shotgun, that should be enough. The other main one is pest control, if you're decoying pigeons ect. Then you could make the case you need the extra capacity.

I've also heard the thinking that if it's not a shotgun, then it must be a rifle. Well, not really, it just occupies a grey area where it's neither a rifle nor a shotgun.

So If I owned a section 2 shotgun (like a Ruger Red Label break action shotgun) you could legally share it with a person who does not have that particular shotgun on their license?

Both, anyone using a sec 1 shotgun that is not on their FAC. The only exemption is RFDs.

Hi Callum. Quick question... As a member of a home office approved club, can I lend my personal rifle to other members of the club? My FEO said that I couldn't but it seems that you showed that I can..... difficult one.

I would ask the club, they should know. I have shot other people's and no one seemed to care,but that doesn't mean that it was legal. I have been told so many different things regarding this It is unreal

@tacfoley yes this was a long time ago now and my FEO was mistaken. She said that clubs have special exemptions to be able to lend their guns to club members. What she meant to say was that members of the same club can handle each others firearms under that exemption. And yes you are right about LBP/LBR. Also the same for S1 shotgun.

@@mahrufurrahman9759 Pump and Semi-Auto Shotguns, whether Section 1 or Section 2, must have a barrel length of at least 24" and an overall length of 40". Section 2 shotguns that *aren't* pump-action or semi-auto must have a barrel length of over 24", but no overall length restriction. Section 1 shotguns that *aren't* pump-action or semi-auto (like side-by-side, lever-action etc.) follow the usual 300mm/600mm rule. So yes, you can have a 12" barrel shotgun as long as it isn't a pump or a semi and is held on a firearm certificate.

because the law to Borrow aS1 FAC was written before S1 shotgun and LBP where invented and because their description doesn't meet the wording in the Estate rule you cant use them and they wont change it to allow it you also cant have a LBP conditions to shoot vermin

Can you please do a video on shooting clay pigeon with a section 1 shotgun? My force insist that it must appear as a condition on your FAC otherwise it is a no no - would be good to get Adrians thoughts on that.

I had to get it cleared on my cert for that, i use mines for practical and slug shooting but forgot we do a small 30 clay shoot after the slug shoots and I had to take it back and got them to add in the variation, It didn't cost anything and got my new cert within 20 mins at the Firearms office desk.... although your force might vary

You require a condition on your FAC for any activity you want to do with the gun, be that target shooting, PSG, clays or pest control. As mentioned it’s not a ‘variation’ and can be done free of charge

Conservatives have been in power since 2010, nothing has got better, last consultation removed MARS rifles off the table and they were also considering taking the .50 cals too, but i think the 50 cal shooter clubs managed to group together and put money in a pot and fight them off legally this time....

Also, I may be completely wrong because Im viewing British gun politics from across an ocean, but it seems like the tide is slightly turning in the U.K. about firearm ownership. More and more Brits I talk too seem to be more comfortable with the thought of a law abiding person to have a firearm in the home to protect their families. Of course they are still hesitant about having the access to guns like we have here in the U.S. But I understand their hesitation too because of the last few decades of fear mongering by the British media on firearms. I hope the U.K. gun laws will change for the better.

@@RicArmstrong Guns in the mainland UK are for recreational use only, there is no legal defence option to apply/own one, although Northern Ireland is slightly different in that respect in that you can preface "Self defence/personal protection" as an option when applying for one, and northern Ireland is still "technically" part of the UK even though it has a sea separating it from the rest of Great Britain.

@@weegaz22 Yes, I understand lawfully firearms in the U.K. are for sport shooting only. I was talking about the attitude towards self defense with firearms by many Brits I talk to lately.

I get this all the time, a lot of people don’t realise that “Functionality” it’s a shot gun, But “Legally” it’s a firearm So it’s then controlled under firearm legislation. I know people who think you can just turn up with section 1 shotgun to places, and they don’t realise you need permission to shoot on the ground with that type of firearm first. They think it’s just like a section 2 And a lot of people (or correct me if I’m wrong.) don’t realise you can actually own a “sawed off” shotgun on a section one as firearms only need to have a 12” barrel. But I don’t think it can be a semi auto shotgun or pump shotgun. (Even though you can own 12” semi and pump rifles...) I would ask are revolving shotguns legal? As I haven’t seen any of those about? And what is the legality of “ghost loading” a section 2 shotgun? And doesn’t the capacity restrictions have not effect magazine and cylinder fed shotguns? So you could if possible have a 10 barrel shotgun on a section 2? And is it true that muzzle loaders can be any shape/ side as they don’t have a minimum barrel length or overall length restriction? So you could have a short barrelled muzzle loading rifle and shotgun with a 10” barrel? Or have a cap and ball revolver with a stock clipped on it? And do you know where about that club was that managed to get a LBP on a club license? And to add to that I have never heard about the borrowing of another persons private firearms? I thought that was illegal? As clubs have stated even allowing someone else to use your guns is illegal on club property too? (Especially if it’s a LBP/R?) And didn’t realise section 1 shotgun wasn’t treated the same, I’m surprised a club cant have them but can have a high powered rifle. So does having a shotgun with a rifled barrel change it even more? And .50 cals people have told me only the license holder can own and shoot them? Yet that range in Dorset called the “tunnel” allowed anyone to shoot them? I got told it was because they were a certain length of rifle? And my very last question is no one believes that there was a loophole in legislation that allowed you to get a miniature firearm with a ticket (I’m sure you did a video explaining that?.) Or I’m I getting confused? And so sorry for the long post!

For the LBP question, look up Mike Wells of the sportsman association and Kensington rifle club. The outcome of the court case does not set a precedent as far as I aware. Have a look at www.guntradenews.com/comment/legal/legal-small-bore-and-the-law/ I am not sure of the current state of the law, I remember there was a Home Office consultation sometime between 2005-2008 which mentioned it but I don't remember the outcome of the consultation

Refuse Sack I was under the impression a club (not sure what one.) took it to court to point out how u fair it was and the jury actually sided with the club and they are the only club on the main land that can have LBP/Rs? Thanks for that info, much appreciated!

@@refusesack4897 yeah that's also what i understood the ruling to be as well, does not set precedent in UK law, cant remember the exact reason though but it was something to do with firearms laws being of a different nature to criminal law or something.

The Film and TV exemption is a funny one when it comes to Section 1 shotguns, it doesn't cover ammunition so for something like a rifle is only covers handling the firearm or shooting it with blanks. Due to shotgun ammunition not being as restricted you technically could shoot it but it's a grey one, the police and potentially a judge would view that it's not in the spirit of the law.
