9:50 The police bullied me when i was walking down the street. When i complained to their supervisor, he said it was just a consensual encounter and all I needed to do was ask if I was free to leave. These pigs are a bunch of crooks!

Make sure to file a written complaint. Never expect cops to admit wrongdoing. Remind them of their duties to uphold the US Constitution. Remind blue line gang they are accountable to God. Record, video all encounters. Cops or any government employee .

- If they ask you a question just say "I don't answer questions." - If they give you a command ask "Am I detained or free to go?" - Keep asking until you get an answer. - If you're not detained, leave. - If you are detained, ask again if you are detained or free to go every 1-2 minutes. Detention is only legally valid for the time necessary to conduct the investigation and you have no obligation to assist in their investigation. - If you're detained state "I've been advised by an attorney to remain silent and I am invoking my right to the counsel of an attorney."

There are things you have legal obligations to provide that won’t incriminate you, such as identifying yourself etc. Simply denying to do anything at all is an easy way to insure you get a free ride somewhere you don’t want to go

The speaker said several times "Be calm so you don't look suspicious." Easier said than done. I fear the police! I've never been arrested, but nonetheless, cops frighten me because of what cops have done to so many other people. Cops are not here to protect us, they are here to rack up arrests to meet monthly quotas and also to see if you have cash which they can steal. Cops are criminals. I love this Category: "Entertainment". Man, this is some hard-hitting "entertainment".

The majority of LEO's are good people that genuinely are doing the right thing day in and day out. Don't get wrapped up in thinking all police are thugs in uniform like the media is portraying. Trust me, they have chosen to fight crime for the better of the public. The majority are not into fucking with people for shits and giggles. If you have an encounter with police it's normally for a good reason. You got their attention for some reason. If you fucked up, you fucked up, pay the piper. Be cool and you maybe surprised that he or she maybe cool if your fuck up is minor. If your good, your good. Just be cool. Don't freak the fuck out and say or do stupid shit. Just be cool.

Toosly, you can record ANY public official so long as they are on duty. You also have the right to record in any public space. This is protected by the 1st ammendment and has been upheld by the courts

You also have to consider the danger you are placing yourself if you are around police when they are doing their job. As we all know cops do get shot at all of the time. More so now than ever before. If you are going to be one of those people out there recording traffic stops etc, make sure you keep a safe distance/cover just incase lead starts flying. Modern tech enables people now to be able to film/tale pictures from a good distance and still get quality video/pics. Remember, bullets have no names on them.

You can film any public official if they're on duty or not, as long as you're doing it from a public place. There is no expectation of privacy in public for anyone. And if someone leaves their blinds open facing a public space, there's no expectation of privacy.

Keep in mind the power you speak of has been bestowed on them in the form of legislation/laws so they can effectively do their job. If you are not happy with those laws there are ways to address them. You can't move the wheels of change here by engaging the enforcers. You have to engage the lawmakers/legislators, lobbyist. They are the ones who help initiate/help pass the laws for our society to follow not a police agency/department.

@@EddieLeal no, the power I'm speaking of is that they can get away with abusing the power that has been bestowed upon them. They're constantly engaging in misconduct, racially profiling, abusing their power, killing extrajudicially, they get away with falsifying police reports on a daily basis, and our judicial system is letting them get away with this. There is corruption in every Police department it's just a matter of how high the corruption goes, and it's usually very high. An argument can be made that the power bestowed upon them by the law is still too much, but I would be happy with some baby steps and just get them to stop abusing the power that they have, and get it so that when they do break the law, justice is handed out to them as it should be. They take an oath when they become a police officer, and yet nothing is done when they break that oath, nothing is done when they commit crimes and atrocities. That's what I'm speaking about

I see some one new in town on foot drunk talking to the cops, I pop up and say "officer if it is ok with you I will take this guy to my house and feed him get him some rest for the evening" I never had a cop tell me know for that, and later when they see me I get break on something.

1st. A detention is an arrest. 2nd. He can ask you to do things, it's by law a request. He has no right to give you orders. 3rd. All law enforcement is under UCC (Uniform "Commercial" Code) and consider you an employee of the corporation they work for. (The State) Remember, when they go to court, they are representing the State. 4th. Statutes, codes, rules and regulations are not law. Common law is the only law. (Self v. Rhay, Rodrigues v. Ray Donavan to name a few.) 5th. As soon as you hire or are appointed an attorney, you become a ward of the court.(Corpus Jurus Secundum vol. 7, sect. 4) The court holds all your rights.

Yes, you can refuse to do a request. However, they can always just taser you or beat you up. They're required to say the words "stop resisting" but they're allowed to abuse you whenever they feel like it. This is the de facto law. Welcome to the police state.

Worse, the judges will side with them in a court of law. So if you sue them and have to prove they acted in bad faith, the judge will invariably say they were objectively reasonable, and dismiss the case with prejudice.

It is so sad we have to be educated about the deceptive practices of the police. Police should not be allowed to lie, they should be forced to be truthful just as we the people are . I had a friend who was a police officer in training. He told us that legally they are never wrong and can say whatever they want to try and trap you. I was shocked at the blatant disregard of basic human rights.

Most traffic stops are illegal stops .. none criminal driving code violations .. cops are trained to escalate these stops for the sole purpose of getting DUI's, felony drug charges and basically any arrests.

If they don't steal from people they will lose their source of income. 40% comes from the state stealing from you by taxation the unconstitutional income tax that the 16th amendment which was never ratified was falsely passed is that portion of their check. The other 60% comes from what they steal.

@Handsome Wade Brody Jr. okay, age of Majority is the legal way of saying someone who is able to handle their own dealings by law, through age,competency and "mental well being". So the concept of being in good standing, being a gentleman, prevents them from practically inacting power of attorney. I dont believe it would be called power of attorney but that is what i alluded to. The state uses Police to try and contract with you.

They ARE just doing their job, that is, revenue generation through using the people as the basis for creating negotiable instruments and other chattel paper that the color of law entity and/or its officers then profit from. SCOTUS has determined police have no legal duty to protect the public (WARREN VS DISTRICT OF COLUMBIA), because legally and factually, protecting the public simply ISN'T THEIR JOB. If you ever feel that you have been mistreated by police ALWAYS file a complaint and get a copy with a persons name and number that you can follow up with. Most times nothing severe ever happens to the officer. The good thing is that the complaint will follow the officer throughout their career and can be used to deny them promotions or employment with other agencies.

Our rights aren't "Constitutional rights," they are inalienable rights *protected by* the Constitution, especially those spelled out in the Bill of Rights. The Fourth, Fifth, and Sixth Amendments protect our rights from the police and prosecutors in particular.

My2Cents I agree with you; most judges probably aren't as clear on the meaning of the Constitution's words as they should be, and calling them "Constitutional rights" is a sort of shorthand for the true meaning, that being natural rights protected by the Constitution rather than rights granted by it.

Sadly, Judges swear to uphold the constitution and allow you to have constitutional right because the courts defines what they are and what they are not. They can define them to take them away from you. They can't do that with god given inalienable rights. Something everyone should think about. Thanks for your post.

+buddybudmac That's an ancient, tired, dried-up piece of bovine scat, my friend. That yellow/gold fringe on the US flag is for purely decorative purposes, and has absolutely nothing to do with signifying court jurisdictions or anything else in the civilian sector. It's a different story in the military. The US armed forces use two different flags: the one with the fringe is called the "national colors," and is restricted to indoor use and to being carried in parades, usually with other colors: service colors and unit colors, all with decorative fringe. That's it; no secret "flag code," no nefarious scheme to sneak martial law into our courts. Not a very sexy or satisfying answer to the big fringe mystery, but at least it's true.

in new Zealand we are very lucky.we MUST give name,DOB,residential address(driver license if driving or the licensed driver for a learner). we have no requirement to carry or produce I'd(we actually have no official I'd at all) police can not "detain" a person(except alcohol testing procedures if driving). all we do is say "am I under arrest" if they say "yes" find out what for and comply then screw them in court or IPCA. if they don't answer state to them that silence on third part is a "no" and your exercising your right to freedom of movement and then walk off. if answer is "no" then you can legally leave and any further action becomes harassment. the REAL problem is being able to PROVE that you did everything right. we also cannot be searched without being arrested first.

Become a Supreme Court Justice, or make sure you elect a President and Senate who'll appoint ones who most closely adhere to your ideal interpretation of the Constitution. Trust me, in all those cases where our rights appear to have been thrown out, there is a breadcrumb trail of dissenting opinions that contain some of the most eloquent and well reasoned interpretations of liberty you'll ever see.

In the State of Texas- there is an exception to resisting- if an officer applies unprovoked excessive force a person may use any level of force except deadly force, so long as the force used is reasonable force under the facts and circumstances, to terminate the excessive force. However, the resistance must cease once the excessive force has ceased.

I got stopped for jogging at night in a sweat suit because... At first, I looked suspicious. Then, it was past curfew... I'm in my 30s. Then it's was because they thought they saw others running... When so told them where I saw 2 teenagers running into the woods earlier they blew me off... Then finally they said they were out for my protection. When I said "I am currently in pursuit of happiness, happiness being getting in shape and feeling good and the only one stopping Me Is You!" they backed off and let me go. They still followed me home, lol Small town life.

They can detain you on reasonable suspicion. They can arrest you on probable cause. Two different standards. With reasonable, articulated suspicion, you have to at least verbally provide name and DOB. They have a right to see ID if you've been arrested.

@@jeffokriya3389 This is why you always stay calm, polite and respectful while firmly asserting your fifth amendment rights to remain silent and recording everything up to the time of arrest on video if possible. The biggest enemy most people have in an encounter is usually themselves and the inability to STFU. As Ron White says in his routine "I had the right to remain silent, I just didn't have the ability".

No one is obligated to possess any identification period. I would argue equal protection clause. They can ask all they want, but I am never obligated to perform any function for free. Lawyers don't answer questions for free, neither should you!

Which has NOTHING to do with the equal protection clause. The equal protection clause in essence prohibits singling out a protected group for special treatment. Rather, the ID laws apply to everyone so there's no equal-protection argument there. The more appropriate argument would be along the lines of the fundamental right to privacy.

I think ideally the cops shouldn't be able to detain without it being more likely than not that a crime is, was, or is about to be committed. So greater than 51% chance. And if cops arrest someone it would be nice if either charges were mandatory. Either charging the individual as someone shouldn't be arrested if they aren't going to be charged or the cop for kidnapping/abduction without a good reason. Also if DA decides to protect the cop by filing charges against the citizen that there is no good reason to thing the person is provably guilty and will likely be convicted then not only should the cop be charged but the lawyer should be charged as well for malicious prosecution, perversion of justice, etc. A detainment or arrest is very serious and needs to start being treated as such. The current norm is for the gov to pretend that a government employee threatening violence and/or death to a citizen (fyi that is what they are doing when they are detaining or arresting you. They are saying stay here or come with us or else we will hurt or even kill you) and holding someone up hours or days is no big deal. Also, it should be legally required for cops to immediately identify themselves by name, badge/personnel number, department/agency when they start an interaction with a citizen and be required to give the specific crime you are being suspected of is and what their articulable facts are that leads them to think you are guilty as soon as they detain you under penalty of jail time if they fail to do so. It is sickening to see all of the videos on youtube where our public servants refuse to identify themselves, refuse to tell you why you are being detained/arrested, and even refuse to tell you if you are being detained.

For those who don't understand how @tell couldn't possibly be serious here, I'll explain. There is absolutely nothing you can do, short of dying, that will make it where cops will never detain you, arrest you, raid your house, etc. Sitting on your porch doing nothing wrong? Cops have arrested people for that. Done nothing wrong and had your house raided? That happens a lot too. Cops raid a home they don't have a warrant for many times a year and give 0 fucks and typically refuse to pay for the damage they caused. Go eat out with friends and come back to find your car vandalized so you flag down a nearby cop to report it? Arrested, because even though the cops go look at the security footage proving your story correct, they are sticking to their story, without any evidence, that actually you were involved in a hit an run and are lying and somehow got the restaurant to completely fake the security footage. All examples on youtube, and those are just some of the examples from the past year or two. So no, so long as cops are above the law and can violate our rights and the law with impunity, the only ones who are safe from cops are the dead.

One of the amendments says that anything NOT specifically mentioned in the Constitution which does harm another person is permissable and lawful.. The Constitution does not have to expressly define every single instance of your constitutional rights,... It's more defining when your rights are being violated.... Life, liberty , pursuit of happiness.... Liberty is many things, including the "right" to travel...

Producing a physical identification such as a driver's license is not an element of the crime of loitering and prowling. One of the elements for giving suspicion leading to detention is not giving a name and address under the crime, but ID is not itself a sufficient reason for the crime of loitering and prowling to be grounded as having been committed.

Stop and identify is unconstitutional as defined in United States Supreme Court KOLENDER v. LAWSON, (1983) No. 81-1320 and NO state can enact a statute or code or anything for that matter to stop and ID which is also stated here.

Nope. WRONG. Koelander v. Lawson was decided on the statutory vagueness doctrine. The court did not issue an opinion in that case on the fourth amendment issue. There are also a plethora of cases that state that mere identification information does not present a valid fourth or fifth amendment issue, so long as the information is relatively unobtrusive in nature. DNA has been the only kind of information in the category of information that merely identifies a person that the courts have tended to subject to the warrants clause.

I was pulled off at a camping site in my truck, as while driving home though I was fine when I left my friends I started to feel a little more intoxicated as I was driving home. I pulled off and laid back to sleep for a while so as I was not willing to drive while intoxicated. Some troopers show up and start making demands of me. I refuse. They bully me out of my truck, then start demanding that I give them a field sobriety test, I tell them that before we continue with any sort of questioning Im going to need to have an attorney present. Guy tells me were not to that point yet. So I says, ok im free to go then? He replies, No your under arrest for DUI. I need you to blow into this. I, frustrated at this point tell them both that im not going to, and when asked why I told them that if your saying im drunk prove, I dont have to prove that im not. I repeat that I need my attorney if they are going to talk to me. I get arrested. The Troopers take me down to their station, and begin again demanding that I blow into this "special" device that Im required to by law. That if I do not i will be charged with a crime more serious then the charge of a dui 1rst offense. I told them they havent even proven that I was operating anything let alone while intoxicated or if I was intoxicated beyond my legal limit to drive. That they have to have me an attorney present to continue to speak to me. I dont sign anything I just keep refusing in this manner. Going to court soon, they charged me. Not only have I been charged with the other charge, when I was required to make my appearance in court they have levied sanctions against me as though im already guilty and taken my license not to mention the money Ive spent getting my impounded truck etc etc. This entire system is Tom Fuckery in the highest degree. Extortion plain and simple. I was kidnapped from the side of the road by men in uniform claiming to serve the public. Had my property stolen and have lists of inconveniences heaped upon me and my previously good standing in society.

I do not believe this to be true in general. In Hiibel v. Nevada the US Supreme Court ruled that a state may require you to provide your name. Some states have S&I laws, others do not. I have not seen a ruling on other items such as "what are you doing?". Do you know of one?

@@marchevka22x Yes, but in Hibel, the courts affirmed that a VALID Terry stop needed to occur BEFORE the demand of ID is lawful. Without RAS of a crime, there is no way for the 4th amendment to be triggered and there can only be a consensual contact. No state currently allows for the DEMAND of ID without RAS or PC of a crime. Also, interestingly, Terry stripped our original 4th amendment rights in the name of “officer safety” and the majority opinion was written in part by a card-carrying Racist member of the KKK! Terry and one of his friends was black, the cop was white. The effects of Jim Crow were still being felt in DC in 1968.

One reason that this happens is because the contradiction is an unintended consequence. Laws are written carefully, but sometimes it turns out that the wording wasn't specific enough. This results in something being interpreted a certain way that the law didn't intend. When this happens it takes a judge to review the case, and sometimes the legislature has to amend the law.

Regressive policies that are unjust or misguided cannot be called "reforms." The pendulum always swings too far, and then it reverses. One time, back when I was homeless, I was sitting under some trees in the middle of the day in a public park just trying to stay out of the heat. Someone called the cops because apparently people think it's illegal to be poor in public. So the cops came and tried to tell me that the park was closed in the middle of the day. I pointed out that there were no signs stating the hours of the park anywhere in the vicinity and they still tried to insist it was closed. Finally, I said, "With all due respect, sir, if the park is closed, why are the bathrooms still open?" That's when they told me I should leave and then they left, probably because they had no legal grounds to mess with me in the first place.

Most of us now realize that police encounters, court proceedings, etc have just become an experience where public servants operate in this mode of tricky language and maneuvering. The police which our tax dollars pay the salaries, think nothing of lying to a citizen and/or committing any number of sneaky, tricky, underhanded tactics to get you into the system ultimately. The prosecutors are the worst too. Completely unscrupulous. And judges....don't get me started. They either have no balls to speak up for a defendent when they know they should or they are corrupt to the core. So bottom line, the so called justice system at every step and level, has the goal of deceiving one as much as they can get away with. Why do they hate the public at large so much? Why do they consider citizens, enemies? I don't get it. We each contribute to paying their salaries. Why can't they just treat people like human beings. They're evil extortionists. They are no better than street gangs. Thugs. Going around misleading and taking everything from people. If we had a different system, we would have a happier, more easy going society. The police, our laws, and our cruel, torturous, prison sentences, I think, hang a permanent dark cloud over our society. All I ever think about when I'm going about my day to day driving, or walking, or when riding a bike even, is whether I will see a police officer, and if so, will they try to stop me, and if so, what will they get away with. It is exhausting and it terrorizes people. Yeah, I never worry about getting robbed, or any criminal behavior. I don't worry at all about criminals. I worry about police. That fact in and of itself tells you who the actual criminals are.

Driving is a commercial activity. Most people do not drive, they are traveling. The state uses the common definition to obscure the legal definition so that they can force you to consent to be engaged in a privilege (driving) and not a right (traveling). You should look at all of the court rulings regarding this. The SCOTUS even has a Travel Doctrine.

We were outside a concert at the old Civic Arena in Pittsburgh (The Big Igloo) and my buddy had a bag of peanuts and was sharing them with everyone. When the peanuts were finished he threw the bag away. Immediately a handful of cops grabbed him and threw him against the wall and started searching him. The next thing we knew there were more cops, even a couple on motorcycles pulling up. Then they started saying "He kicked it" and started looking around, even in nearby shrubs, but they didn't find anything and reluctantly let him go. We never did find out what they thought that they saw.

This is very close to the most honest bit of information regarding encounters Ive heard from an attorney. These “officers” are not immune. They also have ..or are suppose to have bonds. However, take a look at Cruden v Neale & Rodriques v Donovan. Unless you have hurt someone, damaged property or the officer has a “warrant,” they really have no reason to be speaking to you. You can invoke the 5th and you do not have to provide ID! Did you run a stop sign and you were pulled over? Go back to hurting someone, property damage, warrant…unless you are operating in commerce…..they has no reason to stop you. Government can only control what they create, and you are not their creation. You have to know your rights and how to invoke them. Unfortunately, the last thing I would ever suggest is the hiring of an attorney. You are the most powerful person in a courtroom. No law, mandate, ordinance, statute can supersede your constitutionally protected rights. Don’t argue with someone who has a gun on the side of the road. Know your rights and educate them in an Article III Court with a trial by Jury in all matters over $20!

Also, if I am being illegally arrested (especially if being harassed or physically assaulted by said officer), I will resist and defend myself by ANY means necessary, as is my right to do so regardless of what any law says. As a Constitutionalist, I firmly believe that shiney metal badges do not grant extra rights, for an officer is no more or less of a human being than I am. I will defend myself and my property against ALL unlawful invaders.

Just in case but I really think it’s more for double the intimidation. Plus he is there to be another witness to lie with him as he manufactures probable cause and your arrest without care or concern for the damage it causes your life.. You were just on your way home. When I was young a policeman was like the public good guy. Like the referee of life and they had to be NICE To people. They said things like be careful and have a nice day. Wrote the ticket and went on his way. Not any more at some point the whole demeanor and attitude changed. Then they started getting violent an mean. Good cops are even Afraid of the bad cops. Terry Knows You can defend yourself but the threshold for legally doing so is an almost impossible case to defend yourself against in court. The only chance you would have is if a couple defense attorneys just happened to be recording your stop from start to finish and captured clearly the video and audio of the assault. In other words you can do so legally however you have almost zero chance of being found not guilty.

A few years ago, Bob Dylan, one of our greatest singers and songwriters, was arrested by a couple of dumb cops for loitering. Obviously they didn't recognize him . He told them he was merely walking around the area near to his hotel, to relax before the concert. They cuffed him and took him to booking.

Please don't tell me for "officer safety" because they exist to secure my/our safety - NOT THEIRS. I also do not consider their arguments of "public safety" nor "national security" to be persuasive, nor even logical, considering the Constitution and BoRs were written for the expressed purposes of insuring [sic] the domestic Tranquility, providing for the common defence [sic] and promoting the general Welfare. All terms which include "public safety" and "national security"! Not to mention to RESTRICT the "Police Power"! Re. providing identification: Only if being detained, I'd tell them my name, specifying the style and status in which I represent it, along with my address . I'd then tell them that I'm sorry but I cannot lawfully attest to my date of birth because I simply can't remember it even though I'm pretty sure I was there when it occurred. I'd act like I'm afraid they'll charge me with another trumped up crime for attesting to something to which I have no firsthand, personal knowledge or memory. If they were detaining me anyway and insisted I provide "photo ID" rather than "identifying" (as the law only requires in my State of residence), I would give it to them for several reasons, to wit: they'll find it anyway and tear my wallet to pieces in the process; the original Book of Law stipulates "give unto Caesar that which is Caesar's" (or words substantially to that effect) and it is their creation issued to a person they created that is a distinct legal entity and presented in a different style and status than me and, therefore, aren't mine anyway. I'd tell them that too when they ask, "Do you have ID?", I'd say, "I do but I'm pretty sure they're for another person with my same name because they're presented in a distinctly different style and status"; and, finally, I always execute all government documents under protest with a full reservation of rights without prejudice and my DL and CHP, etc. are no exceptions.

I will not sibject myself to the financial strains, the emotional burdens, and the time consuming processes of the court systems for an unlawful arrest. This may be viewed as unwise, but I would rather die standing as a free man, than live on my knees as a slave to the corrupt and biased system of government that we have today.

You should be able to shoot a cop who is trying to wrongfully arrest you! Wrongful arrest is kidnapping and kidnapping is a forceable felony, meaning you can use deadly force under the stand your ground law! A tin badge and gay costume shouldn't put the pigs above anyone else or give them special rights to mistreat us! 😠

You are not required to produce identification walking unless they have reasonable suspicion to ask you, this law is very vague. You do not have to talk to police if they do not have "reasonable suspicion". So often this rule is broken for instance an officer can stop you and say you're not supposed to have that cd dangling from the windshield "obstruction of view" or in the case of walking, refusing to converse or produce ID can be a charge of "Obstruction of Justice" it is not safe out there.

I'm pretty sure that in California Police Officer's can stop and require you to produce ID to ID yourself. No PC or whatever....At least in Los Angeles the LAPD are pretty much in charge of things

The supreme court has ruled that giving you name ISN'T incriminating however that is the ONLY thing you have to provide. NOT you DOB or address which the supreme court HASN'T ruled as NOT incriminating information.

Every state I've checked has that on the books. Until or unless some madlad actually raises the issue, it's probably prudent for us mere mortals to abide the law as-written even if the law itself is blatantly illegal (especially given all the other blatantly unconstitutional things the SC upholds, I wouldn't want to invest the next years of my life into fighting a POTENTIALLY doomed battle)

Wow this sucks I live in Kissimmee Florida and I've been stop so many times on a bike on full compliance I have all my lights even wear a safety vest and I've still been put in the back of cop cars padded down and even had cops completely make stuff up and the only thing I knew was asked for a supervisor which save my butt a couple times but watching your video just makes me realize just what I I've let them get away with

Most Terry Stop events are a violation of law. 2 things must be present. Reasonable suspicion a crime has, is, or is about to be committed AND reasonable suspicion the person is armed and dangerous. Most Terry Stop events lack reasonable suspicion of being "armed and dangerous". Now I wonder what else I can debunk in what this BAR attorney is going say.

"Common Sense" goes a long way. "Choosing your battles" is actually key, here. Most of us know the police are out to arrest as many people as they can... a bit of research will educate you on their normal procedures. If you have a minor traffic infraction, and nothing else... don't play the "I KNOW MY RIGHTS!" card. It's not worth it. Be polite with the cop, don't help him/her escalate the situation, and maybe you'll get off with a warning... or at worst, a ticket. Yeah, it's a "money grab" by the state, but is it REALLY worth losing your freedom over "chump change"? "Do you have anything illegal in the car?" "No, sir." "Mind if I take a look?" "Yes, I do mind." "Dispatch, can you send a K-9 unit to my location?" Yes, that happens. Now, I'm not saying to let them tear your car apart... but if that cop is hell-bent on dragging you to jail, he's going to FIND a reason to. Battling the cop on the street never ends well. Best advice is to go with the flow, then confront the cop in court. That's where you stand your best chance of winning.

When the cop is on a track to have the dog "indicate" about the drugs they subsequently plant, you need to give your lawyer the tools to suppress that in court: establishing the involuntariness of your detainment can be just one such tool, especially if it takes longer to fetch the dog than the issuance of the ticket would have reasonably taken

I don't understand how _"talking on a public phone"_ (was that a payphone?) would be trespassing. Especially if they have a "PHONE" sign. Were you smart alec? Had you previously been found to be buying or selling drugs on that property? Have others used that phone to buy or sell contraband?

Step 1. Require their State of Constitution Oath of Office as required by Law and NOT their State Statute Municipal Corporation Oath of Office that is a False swearing pursuant to the State Constitution Oath. They are required to have their Person and must ID with Oath when asked and Yes prior till the man or woman must produce ID. Not one has their State Constitution Oath but a False swearing. Before watching this video, I understood as you explained that suspects are required to identify upon the request of the officer when he had detained them. But, what if the officer asks the suspect to ID themselves as opposed to asking them to identify? I ask because never in my decades of life have see the abbreviation ID commonly used. However, it apparently is common for folks who are employed in the criminal justice system to use the abbreviation ID. Don't cops have an obligation to speak in a manner that the general public is likely to understand?

You have the right to remain silent. One officer said that only applies after you have been arrested. Not true, don't talk to the police. You're lawyer will thank you if and when you need one.

Because they want to intimidate you into deleting your video. Regardless of what they may tell you, don't buy it! You are allowed to film officers in public as long as you are not in the way of their investigation. They have no right to demand or take your film or camera equipment, if they fucked up and you got it on video there is nothing they can do about it! 😁

Doesn't the probable cause clause about "experience" give cops a big out in legal matters? It is said ignorance of the law is no excuse for the common man but apparently a cop can claim to his "experience" someone was doing something illegal when it is perfectly legal. Also the experience angle can be used to cover anything he does. As in all shooting incidents, the cops claim the subject made furtive moves indicating to them per their experience that the detainee was about to get violent.

Correct....our concern should be about beatings or shooting incidence.... When in doubt put your hands in the sky and turn around.... Later in court the judge can figure out who was more "inexperienced" ... Stay alive is the priority

Folks, please ensure you know what you are talking about/fully versed in what you are citing to a LEO. You want them to take you seriously so don't start muttering gibberish like some other misinformed people on RU-vid and expect the LEO to take whatever you are saying into consideration/seriously. Do your own due diligence. Find an attorney. Most will see you on consult visit free of charge. Check/verify your local state statutes/laws. Fight any perceived injustice in the courtroom NOT on the side of the street. It takes two to tango as the saying goes so be courteous. If the LEO flies off the handle and crosses the line in his behavior then you have that much more to sue the city for down the road. If the situation warrants it file a complaint as soon as possible, track/maintain good records. Names, locations, dates, what was said etc..Video/audio where permitted by law would be ideal to include witnesses if any. In closing please remember folks. Keep the old EGO in check. An overinflated EGo gets many LEOs and civilians in hot water/trouble every time it rears its over inflated head. ;) It's hard sometimes I know. :) Guilty of that myself and have been working hard to keep it in check. That advice is for both sides. ;) Tensions can be high during police encounters. Everyone's nerves can be on edge. They do not know you personally or your intentions and you don't want to be harassed over what you perceive to be nothing. The last thing anyone wants is an escalation that may lead to getting locked up, an injury or God forbid someone losing their life over something that could have been avoided. In the end, everyone on both sides just wants to be on their way and make it back home safely. Be safe and be good folks. Happy belated thanksgiving to all! ;)

I carry a combination waiver of qualified immunity and billing authorization for detainment. On it the cop can WRITE the RAS or PC. Issue what orders he expects followed, and acknowledge the billing structure. 2000 each detainment, 20 min free and 9 bucks a minute until resolved.

Title IV benefits are distributed to agencies for any and all services provided by said agencies. A police officer is a commissioned agent of the STATE, a salesman selling Police services. As an example, Child Support Agencies are paid $0.66 for every Dollar collected from Non custodial parents. You might pay $1,000 a month to Child support in turn the Federal government gives that office $660 in federal funding to support said actions in collecting your $1,000.

Thank you for making this video.. I was just wondering if you have made or know of any informational videos on the specifics of what constitutes 'Reasonable Suspicion' and 'Probable Cause'. From my experience, police officers can seemingly produce reasonable suspicion out of thin air. Also are they inclined to explain said suspicion or PC before they cuff you search you or detain you ect? And how far can one argue against RS or PC without any additional charges.. Oh and I'm a Ca resident.Thanks!
