I'm a firearms dealer that has decided to get online to answer questions that we get from customers or within the industry on a regular basis. There is a lot of information out there about firearms and a lot of it is not very well informed. We hope to clear up some of that bad information and answer questions from anybody that asks - novice to expert.
The firearms industry isn't just an industry, it is also a family. Regardless of background we all appreciate the importance of responsible gun ownership.

You forgot to mention that sometimes (quite often) the system just makes mistakes. I was recently denied a purchase for a misdemeanor conviction that the FBI said "I could've served more than a year for"... which is funny, since for even the most severe misdemeanor in the state I was convicted in the maximum sentence is 364 days. Sounds like an easy fix, right? Yeah... try convincing the government to use common sense and take 30 seconds out of their day to correct a record and admit that they were wrong. Good luck!
Today I received a letter from the DOJ about a firearm purchase delay. Stating the “Department has identified state and or federal records matching your identifying information or a stolen firearm record that if confirmed would prohibit the purchase” they say it could be wrong and my information may be similar to someone elses but they are required to make its determination within 30 calendar days. They are clearly wrong and I have no criminal history whatsoever. I have about 3 more weeks of waiting left 👎🏽👎🏽👎🏽 To California

I am from Wyoming been on delay for One week. I have not bought s gun in 15 years and now delayed. If we can put s man on the moon in 1968 we should be able figure this out. Thanks
Me and my wife was trying to purchase a firearm My wife got cleared. I got delayed.And what I can't understand is that?I am a truck driver with a hazmat license. I had to go through a FBI Background check to get so endorsement for hazmat . That's why I can't understand why did I get delayed. But in the state of michigan , you have to go to your local Police station and get a firearm purchasing license. They ran a background check on me. In every. Thing came back I got my purchasing license to buy a firearm. That's why I say is crazy.

Asking your opinion here. Been on delay over a week after a purchase, I’ve got old blemishes on my record that I’ve cleared up and couldn’t ever get given a definitive answer to if I’m prohibited or not so State police suggested i go try and buy. I’m in open status and dealer said I’m good to pick up. I’d think if I was red flagged, it’d come back immediately. Would I be stupid to pick up my firearm? Should I wait until potentially never to get a definitive NICS status?
@@serialseatsniffer5610 it would depend on why you came back denied and what the dealer is willing to do. I let one guy return his minus a restocking fee. If it had been something he could have appealed I would have held it for him while he worked through the appeals process. It's going to be dealer dependent.
In 2016 I was charged with 2 felonies but I got it pleaded down to 2 misdemeanors and was convicted of those 2 misdemeanors. So when I answer 21D it’s correct to answer with NO, right?
If it wasn’t a felony conviction then correct. You’d have to know the maximum potential sentence because it would come in to play in one of the other questions.
i went juvenile court for domestic violece my case was dismisseed as prejudice and im pretty sure i wasnt convicted this was when i was around 13-15 ish range and was hoping to buy and long rifle as i am 18 now and wondered if i was able too
FDLE does the checks but they can’t be less restrictive than the federal checks. If the charge had the potential to come with a jail sentence of more than a year there’s a chance you’d be denied. Read through the instructions specifically for the questions that reference convictions.
You’d have to verify with reading the instructions but you should then answer no to the felony question. You may still get denied and have to appeal it and potentially send in supporting documentation
Pennsylvania - every time I buy a gun from Cabelas the background check takes between 2 and 5 or 6 hours. One time a clerk told me the hold up is being caused by the State Police. I've had no involvement with any police beyond a traffic ticket every 5 or 10 years. Conversely, my local gun stores routinely complete a purchase in 10 or 15 minutes.
Big box employees aren’t usually nearly as well trained as LGS employees. A lot of times big box delays are due to their internal processes or procedures.
After two years and spending $3500 on a lawyer to clear your denial, they will forever delay every transaction in the future. Even though your record is 100% clean.
First time being delayed. Kind of annoying since they already have the CA two week hold also. I'm told 3 days to months... Hopefully it's resolved soon.
@@lilbart9177 instructions on the form, it outlines directions on how to answer questions if you're unsure, beyond that it would be a question for a lawyer, especially since it was something while you were a minor.
so if you've been denied before in the past ... say more than 10 years past sense that denial. when you go to purchase a firearm again will it instantly deny you or delay ,then deny ? just trying to do some homework.

In my opinion, if I can go to the ford dealership and buy 10 cars or trucks and sell them the next day I can do the same on a firearm, most “private sellers” I’ve ever met do not sell to felons or try to have this -trench coat what do you need- type of business. The reach on it is too far but that’s just my personal opinion.
You didn’t go over the exceptions part for the domestic violence question. There are now exceptions to dating relationships on the new form relating to expungement/set asides or if it’s been 5 years or more since misdemeanor conviction against a dating partner. In which case you can answer no to the question
Yeah. That’s my understanding. The PMB addresses they use in the Dakota’s don’t work. It’s kinda odd. I mean, it makes sense if the person gets denied or is prohibited but it’s kinda overkill if they have a clean BGC.
@@Gunner411 Having a fake ID with the intent to purchase a firearm or possession of a fake driver's license is definitely a felony. I guess its just up to the cops whether they want to enforce it or not
What if you own a licensed firearm in the state of Florida where you live, but you are found guilty of a misdemeanor in the state of Pennsylvania and placed on probation? Does that completely take away your right to own a firearm even in your home state of Florida?
@@jl6168 purchasing requirements are a bit different than ownership requirements, oddly enough. I'm honestly not 100% on this question. A felony conviction is totally different and holds a lot more weight in a lot of cases.
Only gets used if it’s routed to an agent. I’ve actually had a customer clear the NICS having written down the wrong SSN. He realized it after I’d submitted it but it still cleared him.
