Form 4473: Common Mistakes & Complete Walkthrough (Aug 2023 Revision)

The ATF revised the 4473 form and required all dealers and customers begin using the new one on February 1st, 2024.
This video is a detailed walkthrough of that form, the places that hang people up, and the things you really need to know to keep from being in a bind.
If you're thinking about buying a gun from a dealer and you have never purchased before, or if it has just been a while, this video walks you through the things to keep in mind when filling out the federal paperwork.
ATF Form 4473 is required for any purchase through a dealer, regardless of what state you're located in. What happens after the form gets filled out can vary depending on state laws, but it's all pretty close.
Keep your ID current, read all the boxes, don't leave out a 2nd middle name or a 2nd last name, answer all the boxes, and don't guess.

Basically this form is unconditional. 1 it was put in place by the ATF not Congress. 2 your 2nd amendment shall not be infringed on. All they really need to know is if you were ever convicted of a violent felony crime.

@@benjaminreynolds3659the ATF 4473 form within itself is an infringement. I'm assuming that's what he meant by his comment. The ATF 4473 infringes on an Americans constitutional right to keep and bare arms with requirement and enforcement of a federal background check and subsequent denial of owning or purchasing a firearm if an individual does not pass said background check. If you are a native born or legal citizen of the US then you have a constitutional right to buy or own a firearm. The ATF is infringing on that right with this form.

You didn’t go over the exceptions part for the domestic violence question. There are now exceptions to dating relationships on the new form relating to expungement/set asides or if it’s been 5 years or more since misdemeanor conviction against a dating partner. In which case you can answer no to the question

I'm in my 40s in Indiana. I've had my permit for about a decade. I've bought several guns at stores I've the last couple decades. I usually get delayed 3 days and then get my purchase. I was just denied for the first time ever and nothing has changed on my end. WTF?

it took NICS about under 2 hrs to tell me I was delayed today😔😩. Don’t know why. Answer every question right. The only thing I can think of was a misdemeanor charge for loitering 15 yrs ago. I guess I wait to see but should go the lawyer route?

Thanks for the video. Great info. There was one question unanswered. In the last form question 21 was to leave blank but in the new form it does not say in parentheses to leave blank so I don’t know how to answer this simple question. Lol. Please help

Omg. Horrible question for a dealer to ask and base it on - unless he knows your county / city laws. I always ask people what police show up. If it’s city then you’re within city limits. If it’s sheriff then you’re outside city limits.

Hi I recently tried to purchase a gun first time buyer and they said it had to do with reformed and they didn't give me any other explanation when they called they said I can fill out a paperwork and find out exactly why I've never bought a gun before just kind of curious can you maybe give me some pointers

The verbiage you’re using doesn’t make sense to me. “Reformed”?!? The rest almost sounds like you need to appeal it. I’d ask them for more information or ask for the NTN (NICS Transaction Number) then try to appeal it.

i went juvenile court for domestic violece my case was dismisseed as prejudice and im pretty sure i wasnt convicted this was when i was around 13-15 ish range and was hoping to buy and long rifle as i am 18 now and wondered if i was able too

I was placed on a 5150 in 2016 (8 years ago). Besides that, I have nothing else in my record. Law states after 5 years, I'm able to purchase a handgun (California), if I don't have a second 5150 or other stuff preventing me from owning a handgun. Problem is, I have no idea how to fill out the 5150. There's a question about being held in a mental facility. Truth is yes, but I've heard of people who are in a similar situation like me get automatically rejected for saying yes. Some say to fill out no, but I don't want to lie. I also don't want to get an attorney involved because he's going to charge a lot.

Read the instructions carefully. A lot of times the instructions lay out criteria where even if technically it’s a “yes” it instructs you to answer “no” because of your circumstances.

@@Gunner411 I went over the 4473 last night and read the question and footnote instructions. Technically speaking, a 5150 is an observation hold. In the 4473 it states that if you were held for observation which is a 5150, we should answer "NO". Thank you for pointing me to the small print instructions.

Question on L. m1 and m2 What do you answer as a permanent resident, green card holder? I already bought a gun and the dealer first told me to answer, then when I went to pick it up they ask me to crossed it out and sign next to it

It wouldn’t be one of the exemptions as a permanent resident. Those boxes are for non residents like a person here for college but that wants to go hunting, for example

Hello I have a quick question. I know peoples height and weight fluctuate a lot. Would they record what’s on their Drivers License or would it be more appropriate to put their current weight/height only if it’s 3 pounds heavier, and an inch less. Thank you!

As close to current as possible. That’s not a field we’re required to “match” since it’s not included on every form of ID we’re allowed to take.

It means convicted or pending. Under indictment means there’s a pending charge that hasn’t been resolved yet. That said, the most important part of this one is that the sentence COULD have been a year or more.

So if you are a felon but rights restored do you click no to the felony questions bc in the fine print there are exceptions to the answer saying to put no but then again I’m not trying to lie on a form this is so confusing ☹️

Yeah. It can be confusing. You have to read the instructions and ensure your restoration of rights satisfies what it says. I had one customer who had a deferred adjudication felony and it took him 3-4 months to get everything cleared up after he got denied. Sometimes the local jurisdictions don’t do what they’re supposed to do

Gun store will not go forward with the form if you answer yes to that convicted felon question. Which means automatic termination of the form if answered “yes.”

Question 21 D; how would I answer if I had an expungement 8 months ago, for an offense that was 30 years ago, and that held more than 1 year of jail time?

If it was truly expunged, per the instructions it should be a “no”. Be sure to flip to the instructions or look them up online before you go in but afaik an expungement means, legally, it never happened. You may be delayed or denied initially and have to send in supporting paperwork.

@Gunner411 thank you for responding to my question. One more detail I have is this; in 2010 I filled out a 4473 in Georgia and was denied for the offense I stated previously. I at that time was unaware that it was on my record. The offense took place in Louisiana in 1994. I have returned to Louisiana and live here permanently, so my expungement was completed here as well. Will I have to refer back to my original attempt to purchase and produce anything from my previous denial while i was living in the state of Georgia?

I've taken the form and was denied. I stumbled on m.1 & m.2 I've been in the US since 73' and have my I-94. m.1 I answered [No] and since m.1. is No] then m.2. should be [Yes]? That's where I'm failing I believe. It looks like I may just be stuck with my G22 which I purchased in March of 2022.

If the answer to m.1 is no…m.2 doesn’t apply. If you aren’t on a non-immigrant visa then you leave m.2 blank per the instructions.

What if you own a licensed firearm in the state of Florida where you live, but you are found guilty of a misdemeanor in the state of Pennsylvania and placed on probation? Does that completely take away your right to own a firearm even in your home state of Florida?

It’s a federal form, federal check. The questions aren’t state specific and states can really only be more restrictive, not less.

@@jl6168 purchasing requirements are a bit different than ownership requirements, oddly enough. I'm honestly not 100% on this question. A felony conviction is totally different and holds a lot more weight in a lot of cases.

Some dealers choose to use an iPad or digital system. That makes it harder to get to the instructions for sure.

Stuff doesn’t automatically go away. You need to read that specific part of the instructions and your state laws governing what happens with charges. The question is “ever” and unless you’ve got one of the very specifically outlined scenarios that instructs you to say “no” then you’d have to say “yes” and not be able to purchase.

@@erinjones3102 it really comes down to your specific circumstances. If after reading the instructions you feel you can answer "no" to the question, then yes you could redo a check as long as the dealer lets you. They'll often make you wait 30 days.

Not really. You answered it honestly to the best of your knowledge. When we run checks we only enter the state of birth, not the city. It won’t get looked at that closely, just make sure to put the correct info next time now that you know.

Yeah. That’s my understanding. The PMB addresses they use in the Dakota’s don’t work. It’s kinda odd. I mean, it makes sense if the person gets denied or is prohibited but it’s kinda overkill if they have a clean BGC.

You’d have to verify with reading the instructions but you should then answer no to the felony question. You may still get denied and have to appeal it and potentially send in supporting documentation

If you’re convicted, your role or part to the crime doesn’t matter. If as part of your conviction you could have been sentenced to more than 1 year, you can’t purchase a firearm. You’ll have to get with a lawyer and see if anything can be done to get its status changed.

Case nully processed.” 1, Victim is someone who is not convicted of any crime or misdemeanor but is harmed in a crime or a misdemeanor. 2, “Nully processed” simply means not convicted of any crime or misdemeanor. 3, Why would the court put a victim in jail??

Yeah. This is new to me but somebody either has or doesn’t have a misdemeanor. I googled the “nulle prosse” term and it seems like the charges can be reinstated so it’s not the exact same as other circumstances. Never claimed to be a lawyer. Working the process for an appeal is always the way to go to figure out exactly the denial happened.

I'm glad you did this video, but I think because of your age being somewhat younger, there are some things you said that are like fingernails on a blackboard to me, "got to," "have to," "must," "permissible," "cannot," "never/ever," ... I want you to understand, if you can, that we have been trained all of our lives to being subservient to authority - or even perceived authority - we have been trained, to fill out forms and to "color within the lines" ... But you need to understand, and so does everybody else, that pretty much, this is tyrannical. This is not America's way, and I do not know why or how we got this bad - but jumping through all these hoops does not a "RIGHT" make - especially one that specifically points out - to the government mind you - that this Right "shall not be infringed." ... That is the law. If they do not obey the law... Then what the heck are we doing here? And why have we just accepted it - and go along with it? This cannot remain like this.

In the last paragraph, where are the words, "to the best of my knowledge"? ... Not only are they breaching the Second Amendment with this, they are breaching the Fourth Amendment and the Fifth Amendment. Regarding the 5th, they're basically asking me, - correct that they're basically forcing me, if I wish to exercise my, supposed right - to testify against myself. There is so much wrong with this I can't even get into it all here. .... And by the way, by forcing people to answer either yes or no, without providing for additional answers or elaboration, they are forcing people to lie if there is additional answers or elaboration. How are they getting away with this? How has no Second Amendment advocate sued the crap out of them for doing this? They essentially are forcing people to lie if there is any other extraneous answers to the questions they are asking simply by boxing the person in with a yes or no answer. This is horrific - absolutely horrific. .... Oh, and by the way, they know exactly what they're doing. And they're doing it intentionally.

Honestly, I still don't understand this video. Can you please denote what a yes or no answer means in practicality on each question for those in the 21 group? Like on 21.a I DO NOT intend on giving the gun away as a gift. I am purchasing FOR ME. What is the answer I would mark to correctly indicate my stance? yes or no?

21.a If it’s for YOU or even if it’s a BONA FIDE gift the answer is yes. They toss some legalese in there and it just breaks down to “is it for you?” But there’s a caveat in the instructions to also answer yes if it’s a bona fide gift. As for the other questions…if your answer is “yes” to pretty much any of them (the immigration status ones are odd) then you’ve declared yourself prohibited. Personally, if somebody self prohibits, I’ll ask an open ended question to see if there’s something there OR if they didn’t understand the question. It’s a fine line between telling somebody how to answer or leading them to an answer - which isn’t allowed, vs giving them the information to properly answer.
