Branigan Robertson is a lawyer in California. He loves explaining the insanity of the legal industry. This channel is his best effort at explaining the law, making fun of lawyers, and posting about stuff that interests him. Branigan is an employment lawyer, not a stuffy corporate attorney. His office represents everyday employees in lawsuits against employers. This includes wrongful termination, retaliation, discrimination, sexual harassment, etc. etc. etc.
Yes I de be interested....I watched this video to it's entirety. I thought HR was payed for by the government like OSHA ,…& was put there for the employees protection. Wow I didn’t know the companies paid HR to be there. That’s something I had no idea. Thank you for making this video. ✌︎ ꧁𝄞 ⓟε𖦊𝇊𝖊, ⓟ〄𓇱, &,.. ,.... ℳ⑄cℜ⟦㋛⟧𝒹☮︎✞s꧂
What about surveillance cameras at the workplace? Isn't the employer suppose to point them all out to you? Is it legal to watch the employees all day long? I'm a manager, and my employees are getting freaked out (so am I) by HR doing it and I'm unsure how to address it. Are there resources I can be referred to? I work for a non profit in CA.
I worked as a supervisor at a Hospital in Massachusetts where I had to work 11 days in a row and 12 days on another occasion, and nobody offered to replace me. I suffered constant yelling from the employees and the managers told me I had to accept it because of the union. The yelling and working so many days in a row affected me emotionally. I wasn't trained properly so I made mistakes that were used to fire me. I tried to sue the Hospital but several lawyers in Massachusetts told me there was nothing to do because of the at-will nature of the job. I complained to HR, and they didn't do anything. I am a straightforward person (it is a cultural thing), and several employees used this as an excuse that I was offending them. My manager didn't understand this and mentioned it as an excuse to fire me. The poor training and my lack of experience (which they knew) affected my professional career.
My situation is peculiar. After I was fired I won unemployment, while receiving unemployment I had a workers comp claim going for an injury on the job. Workers comp settlement requires I sign a release and say it was a voluntary termination. I want to know if this is perjury against me for when I was in court with unemployment against my employer, and if i would have to pay unemployment back. In Minnesota.
I have never been written up in the past. I complained to HR about sexual harassment and discrimination against my manager. The following day I was told to sign a write up for my attendance for some attendance points that have already dropped off. 😮
I’ve thought bout just going to a news outlet to show the screws in my foot. My fmla was approved but they kept ignoring my doctors updates so I’m hoping I have a good case. Sucks that I lost the job I can’t even afford therapy with another kid on the way. Just trying to scrape by to the next update and see what’s the word. Bout 15 more days! I dunno I would imagine economic damages could be worst lower, they put me out on my bills consistently but the trick is getting it done quickly or funding yourself while everything is going on which is stressful and exhausting emotionally mentally and physically. But the disability dept had me hold when I requested my disability forms after the termination then said they can’t give me them, 2 weeks later my lawyer made the request. But it’s been a struggle staying sober and not being impulsive and irrational. Not to mention my pregnant wife’s been on a sick one about finances
I reported an Amazon delivery driver to his superiors after he started messaging me inappropriately on WhatsApp. He knew my address from delivering my items, and even though I only told him to stop, he kept sending explicit messages. I didn’t block him right away, just kept taking screenshots. Amazon assured me they’d handle it and keep it confidential. When I asked what would happen to him, they wouldn’t tell me due to “company policy,” but said appropriate actions would be taken. A week after I blocked him, he contacted me from a new number, cursing me for getting him fired and claiming his cousin sent the messages (which was obviously a lie). He knew where I lived and was now angry after losing his job. It turns out Amazon showed him the same messages I gave them. The advice in this video is spot on. If something serious happens, go straight to the authorities. Don’t rely on HR or the company, even if you think you can trust them.
My manager hates and belittles me because Im white. I mean hates me. Calls me stupid all kinds of stuff. Making inappropriate jokes at my expense. This goes both ways. I feel for anyone going through this. Oh yeah i missed 2 days. Never got written up. Yet others were written up and still miss. I was told i will be fired if i miss any more days. I am treated so badly i want to quit.
Do you know any employment lawyers in Houston that you can refer me to? I have a discrimination and Retaliation case. I'm a nurse. Im originally from Africa. I dealt with so much discrimination unfair assignments till they broke me. I tore my rotator cuff and I'm almost disabled. Its so hard to set your foot in a lawyers office for you to even tell them about your case. Believe me, you've never heard a case so bad. And yes i do have some emails, text messages and some other documentation to prove it. If i can't find any lawyer, i plan to file a complaint at the EEOC next week. This behavior and unfairness needs to stop. Its not fair to the patients because the patients ultimately also suffer as well.
I gave 30 day notice by email that i was leaving the company and told them i would be glad to train anyone before i leave. After the 30 days i left the company and 2 weeks later i found out that ex-boss said i was terminated. I emailed exboss and asked her. She wrote back in an email that i was terminated. So now when i apply for other work they are saying i was terminated. Do i have a case against them? I feel it was retaliation cause they didnt have anyone good to take my place.
Can we prove harassment even if it happened 5+ years ago and what if there was no actual proof apart from couple of witnesses or you doubt wilful participants in the harassment? btw i'm not from california but would like to know.
Great video. I grew up in a world where I was always told if there's a problem at work it's always you who are the problem and never your coworkers! I knew on several occasions when I was being sacked I was being lied to but if three people from HR are telling you with straight faces that you are the problem and not them its difficult to contradict them simply because of the overwhelming numbers. They can also claim mental illness such as paranoia if you claim they are picking on you simply because they don't like you.
I am suspended till now they never contacted me or told me what's going sounds fishy they don't tell you So am going to discuss my legal optionsm I call them all they is shove it shove it under the rog
News to me but I feel like I should have known better. If a complaint is legitimate & true then maybe the best way to protect the company is to focus on the cause, and not the complainant.
I loved my HR job! I think having worked for small “mom and pop” companies where the owners always acted (and I have no reason not to believe them) like they cared. Now for big companies I absolutely believe this. At the mom and pop there was just “cover your ass” because we absolutely could not afford to go to court so give that crazy employee whatever they want and hope they quit!
You r absolutely right about 45 being Racist and could see this a mile away. Unfortunately there are people like "that" guy who r blind in 1 eye and cant see out the other one.
Ok wait, how does anyone solve a problem if one doesn't address the issue with the person causing it? Health and Safety in the workplace 101: talk with person causing issue. IF that does not feel possible, talk to supervisor. Supervisor addresses issue immediately and directly with the accused. A resolution is provided. Extreme circumstances (illegal offences) require a different procedure. It 'gets worse' ...what a fire starter this person is. IMO: avoid this lawyer at all costs.
Is all fun for the company and HR until they meet their match which is an employee that gets fired and he or she starts a full social media campaign against the company which ends in the news as well all while that person is suing on the background the company naming specific people with racial profiling pr something like that. And no, arbitration is not on the table because the person is no longer an employee so he or she can do whatever they want regardless of whatever contract they might had while hired. It becomes a headache for the company and they will end up giving that person something to end the dispute quietly. Do not be afraid of any contract from employers, they can say whatever they want, but when they get hit by both a lawsuit and social media at the same time, things change rather quickly. And the best thing is that they know they cannot sue you back because you basically have no money so they will be spending much more using you than just giving you some money to end the dispute.
I was working at this ridiculously low paying company that is honestly hazardous for what they're paying and has like a weird workplace environment. Anyways. When i got hired on. They also hired a temp. Im just gonna call him michelle because i really dont like him or what he does... Bear in mind. The workplace environment is 95% men and have a certain disposition working there. But all of them work very hard and they're very smart at their jobs. So I was willing tolerate their nonsense and childish behaviour. I respected them. Except michelle. Michelle is in his twenties and we're only a few years apart. Yet me and him are completely different despite both of us being adults. Which then directly reflects his overall presence when working there. I realized he wasnt very smart and also had horrible work ethic. And poor attitude. Was demanding things. Barely works. And also wasnt respectful to the workplace. And the biggest problem is that he constantly stares. Especially at me. I do not know why. But it was evident that everyone working there doesnt really appreciate him. More specifically my boss. I asked him to help with something and he said "you can do it" it upset me because the way he responded and his attitude. I wanted him sent home and he can be sent home if he was problematic or wasnt able to work. It has happened. Unfortunately. My boss said no and he is not gonna get sent home. Told me and said if it bothers me between me and him. I go to HR. Eventually i got fed up with him because of his behaviour. Not working. Not being respectful. Kept bumping into me. And then the staring. I complained and told them all the issues I had with this temp and thought that was that. Well his problems still persisted and I did not like the fact I was working more than him and he wasnt helping me. I wanted to quit. Then. One day. On my birthday to be precise. A confrontation happened between me and him. Where he yelled at me to help him even though he wasnt doing any help all day and ended up getting upset. I told him i have duties. He has his. He just had to stack and prep the bundle for me because that is what he is there for. And i just strap and palletize... well my strap machine broke and i was left standing there because the operators wanted to fix the machine. So i went back to help him since he purposely left the table full of the product because he's upset and cant keep up despite everybody else. Including me. Can keep up with the machine and have the bundles neatly stacked and prepped
What about when your company is so worried about pleasing affirmative action?!?! And it has been proven in the 80s and 90s that they are very very concerned about this. #hdma #hondamfg honestly it feels like if you are not black, Asian, etc then you are screwed! This company is so worried about being diverse and pissing on good employees. Their values have gone right out the window and they will step on anybody's toes, retaliation and workplace disrespect. So sick of hearing about certain people getting discrimination 🙄 If you are white, then you are totally f****d!
