No, credit card companies need to stop giving large loans with no collateral to people who don’t have any money. This is the risk of the business and they have gotten their money back in interest already. This is as much the credit card company’s fault as it is hers.

I don't like credit card companies anymore than the next person BUT I don't have consumer credit card debt!! Many on here are knocking credit card companies rightfully so, BUT here a novel blanking approach, DO NOT GO INTO CONSUMER DEBT!! Wow that was so blanking hard, lol!! The people I feel for are those that accumulate medical debt because NO ONE asks to be sick, diseased or injured!!
That happened to me. Medical debt for one long hospitalization wiped me out in spite of my very good and expensive health insurance. I paid it all off, every cent, but it left me without savings as an old lady. Here’s the thing though, I had zero debt ala Dave Ramsey’s Financial Peace when I got sick and that saved me.
I agree with you @GAFB112 Most of the time, they caused it, they should pay it. A medical emergency where the person did everything right and still got in a jam, that person has my genuine compassion. The good news is I personally know a person whose child spent over a month in a hospital NICU unit and had the entire seven figure debt forgiven via a program that exists in Michigan. Had that debt forgiveness not happened, the mom and child would have been in financial destitute for life. Thats the type of situation where exceptions need to be made, and I’m so glad thats what happened. Today that child is in elementary school, growing, learning, happy, the mom is not rich but works hard, lives a simple life, and loves her child.

He is, but he’s also realistic. This debt is beyond the “just pay what you owe” phase. It’s going to cost more in lawyer fees and headaches for capital one to get their money back than the debt is worth. If they’ll take a settlement then it’s worth it for both parties to just take it and move on.
Because Dave knows that student loan debt is not negotiable. Your only option is to pay them off. But if there is another option or way out, he does encourage his callers to take it.

Dave Impressed me here.. Calling it for what it is..a game. Debt, credit cards, civil Court.. It's all a game.. You want to take about morals? Keep in mind that in cases like these where people have been struggling for years to pay off credit card debt, what they owe is sometimes 2 or 3 times what they actually spent due to interest.

There are a lot of things already set in motion that can't be stopped. She has to offer a lump sum at this point. She put herself in a hole. Dave can't advise her on how to undo what's already done. He's advising her on what her options are right now going forward

It all depends. If you speak with an active voice and tell them I'd like to settle and negotiate when you seriously have nothing and cannot pay while at the same time telling them if they dont take it I will declare bankrupcy and you will get zero then they will take it. If you are lying and you have money (can afford it) and they see you do with assets and paychecks it wont work. They will because the avg person in that case does file if they get a judgement.
So with student loan debt, Ramsey says pay it off even if you might get some sort of forgiveness, but with CC debt, he says screw them, don't pay them. Ok, got it.
He’s speaking in reality not opinions/feelings. The fact is there are a lot of people who are not getting their loans forgiven, even the people that were promised they would be. So as a safety net it isn’t finically smart to count on something that has proven isn’t successful. Meanwhile with cc debt as he mentioned, they almost never collect and will gladly settle and get what they can. So if the borrower is willing to let you off the hook, that’s on them.
Student loan debt is essentially secured debt from a legal standpoint. You either have to be permanently physically disabled or dead to have the debt discharged through the normal legal process. Or I suppose you can hope that a politician that can't even figure out how to put his pants on in the morning will waive a magic wand and forgive the debt! Even though that's Congress's job to make fiscal decisions and is illegal for the President to do without Congressional authorization. Credit card debt is UNSECURED DEBT, meaning that the lender doesn't have a claim to anything from the borrower if they fail to pay unless they get a judgement from the courts. Even with a judgement, good luck getting the money. There is a legal process for discharging liability for that kind of debt through bankruptcy. After 7 years the credit card debt gets wiped off your record. Student loans are NEVER wiped from your record unless you're disabled, pay it back in full or die. Apples and oranges difference. Dave is CORRECT, you are not.

If you have a $7k debt that is in collections and they are taking you to court and potentially garnishing your wages for this and you have no realistic way to pay that debt, go see a bankruptcy attorney. This could be your best play to knock out this credit card debt along with other credit card debt you already have. In this situation, bankruptcy is the best path forward. It’s what it’s there for.
They've already sold your debt to a bond manager a long time ago. They are just making a show getting the balance just to be able to say they tried. Even if they get nothing out of you they will issue you another credit card in 6 months. Same thing happened to my grandmother, only the credit card company didn't even show up for the debt restructuring. She still got the new card within a year.
Chapter 7 in most cases is less than 2 grand and if thats your only entry on your credit report you can recover 24 months post discharge. so that is a viable option provided you dont plan to buy a house or car in the next 24-36 months. You can only pull that trigger once every 10 years so use it with caution.
You forgot - get it in writing first that they are taking X sum and clearing the debt. AND, never give them access to your account information or other CC info no matter what
Here's an honest young lady ready to stand up to her responsibilities and -- WHAT? My chum's stepkids max out cc, get collection ltrs, get new cc and start all over again. They own nothing attachable - she doesn't 'care' for them and every time one of the sons (or SILs) drops by, their dad is missing tools. Prayers for the best to this young woman.

Wow - my husband and I followed your principles 20 years ago, ate the beans and rice and worked a plan for 5 years. My son, who was financially inspired by our progress did the same. Why would you encourage this young lady to NOT pay debt she owes? Nobody is morally right a hundred percent of the time. You're talking about Dave Ramsey here. This is the guy who fired a woman who got pregnant without being married, but when it was discovered that another one of his employees had an affair, he let him stay employed as long as it was convenient for him. There's another video where Dave Ramsey encourages a young man to lie to a dealership to settle a car debt. It's not surprising that business men aren't honest 100 percent of the time. Look at the business people who don't pay taxes. If you could find a way to make or save money by doing something not morally right, there's a very good chance you would do it.
I love how everyone on this thread seems to be morally outraged by Dave's advice. This is supposed to be a PERSONAL FINANCE show, not "Mr. Rogers." Dave gave some good financial advice here---namely, do anything within your power, as long as it's LEGAL, to avoid paying off debt collectors. Simple, really. And that's how the game is played!

Gosh- I understand some of the reasons people go into credit card debt- but when will everyone learn not to do this? I mean, you have to pay for what you buy. It’s not free. If you want free- go to a soup kitchen. Ask your utility company to put you in the plan for people who do not have the means to pay their electric bill - and have an energy audit done to help save money/ etc…
A lot of you commenting missed Dave's point. Hes not advising people to take out debt and not pay their bills. The caller was at the end of her rope and the debt collector was punching above his pay grade to scare her. The fact is when someone is in serious financial trouble there is a way out and the fact is the dummy was saying pay everything in full now when she was ready to file bankrupcy and instead of him getting nothing which is what happens often in this case he has the option to get a decent percentage rather then get nothing. The truth is what Dave said is standard collections practice 101 that when a debtor cannot pay they will settle for usually pennies on the dollar rather then ZERO. Then afterword stop using debt period.
I need your advice! Im in the same situation except i haven't been to court cause I subscribed to a payment plan. My debt is $10k im making $200 a month payments, the account is charged off so no more fees or interest. Now, i know my credit score is screwed and making the payments will not have any positive effect on it but i don't think i'd be able to sleep at night knowing i owe this money and i don't at least try to pay it back. Listening to Dave's advice here is making me doubt my decision especially cause he specifically told her not to do what i'm doing! 😅 What do you all think? Should i continue with the plan or stop paying and hope i can settle for less?? 🤔

The thing is ensure you set some money aside for taxes. Dave fails to mention this. If you get more than $600 forgiven, the credit card company sends you a 1099C at tax time. That money forgiven goes on taxes,as income and you probably will owe some money ....yea you get a break to not pay it but not really...

She ran up the bill so just pay it. Why a company to take a loss because she is a deadbeat, who doesn't pay her bills. She made a choice to charge up her credit card and not expecting to pay it. My guess is that she has the money to pay her credit card bill and they know it.
Dave is wrong here, this company has already taken her to court. Not doing the agreed upon payment plan is going to be called contempt of court, AND they aren’t going to take a settlement. She should be talking to a bankruptcy attorney.

If you only borrow what you can pay back and pay off your card each month - you will have zero problem and probably earn a little cash back. I personally don’t put a charge on a credit card unless I know I have cash sitting in my bank account already to pay it off.
I wish they'd asked about her situation. If she's truly been through something horrible in life That destroyed her financially, I get it. But if she's making good money and she's just not paying her bills, I'm not sure why she's the victim. This lady didn't have any hardship while spending their money. Basically, she stole money and is claiming hardship? Sue her and prosecute to the full extent of the law.
It's not a criminal offense, but the lender willingly gave money to someone they knew would not pay it back and they also need to deal with those consequences
For the Newbie if you are actually trading in the crypto space and you don't have a sound mentor. Then you are certainly going to get liquidated in 90% of your trades. Yeah that's sad truth.
