The Kowalski’s - the center of popular Netflix documentary “Take Care of Maya” - claim child abuse allegations forced Maya Kowalski’s mother to take her own life. Let’s also not forget Beata was a registered nurse! Nobody gave her the respect she deserved and the tragedy that followed leaves many of us enraged, disgusted and speechless.

And it’s this experience with Beatta’s very well constructed and organised notes and records up until her death that’s provided the family and lawyers with the level of detail needed to fight this, without her record keeping unfortunately the family wouldn’t have stood a chance. RIP Beatta you were an outstanding mother

Dr. Smith, Cathy Bety, and John Hopkins really mis-DX Maya with Munchhausen by Proxy. What a terrible tragedy for this Maya, Byata, family, and friends 😢.

The fact that she was a nurse was a huge part of why they targeted this family. It checks off another box - female, strong, medical knowledge. It’s a modern day witch hunt that garners $$$$ for the hospitals, and sometimes the counties. It’s a corrupt and disgusting business

As a floor nurse, EVEN IF we suspected foul play, that little girl was allowed to have her religious items. You cannot tell me that the chaplain of that hospital couldn’t have provided holy water, and communion wafers!!! There is SO MUCH EVIDENCE in this case; I cannot believe the hospital didn’t try to settle!!!!

They couldn’t, normally the hospital settles to keep details/failings out of the press but the documentary had already started, however it was the documentaries exposure that helped the family have many experts offer their services before they received the CPS settlement ($2.4 mil) which was a blessing

I just rewatched the Netflix special because I wanted to refresh my memory. There’s an actual thing where most of the time families actually sign away any future litigation with cases like this. (Meaning hospital stays where CPS/DCFS is also involved) I can’t remember what it’s called. The reason is they get their children back quicker or whatever. But since Beata and Jack Kowalski didn’t sign this document and also Beata had extensive notes and recordings, this case was able to be tried in front of a jury. But it took years of the family and the defendants to actually go to trial because the hospital tried to prevent it, and it had something to do with punitive damages. The hospital knew it was so damaging what the plaintiffs case would be and the proof. So, they might’ve tried to settle but the Kowalskis knew their family had the most to go to trial. This same Dr. Smith along with the hospital and CPS has many cases of families going through all of this. Dr. Smiths personal malpractice suit was settled though, according to the Netflix special.

She took her life because she was told if Maya would EVER have any contact with her mom, she would never be allowed to go back home. This mother sacrificed herself so that her family could be together. It is the saddest thing ever.

My husband has CRPS. Flare up are so horrible to watch and not be able to do anything. He has been treated by hospitals as someone chasing painkillers, told he doesnt have CRPS by his non treating doctors and told by pain specialists they cant do anything do for him and to learn to live with it. So many drs have absolutely no idea and treat sufferers atrociously.

I was diagnosed in 1999 with this terribly painful syndrome.😢 I was in an accident in 1995. It took my doctors 4 1/2 years to diagnose me. I wouldn't wish this horrible condition on anyone. My heart goes out to Maya! 😢❤😢

I just watched the Netflix documentary. This is heartbreaking and so wrong! I pray this family gets every penny they’re asking for. And Dr. Smith’s medical license should be revoked! Unbelievable!

This case is beyond belief,as a Mother I cannot deal with the pain that was caused to the family by this Hospital and it’s staff, totally mind bending and an absolute tragedy that Mum felt the only way to save her child was to take her own life. Devastating,I hope they throw the book at them,sadly no amount of money will bring their precious Mum and partner back. Watching from New Zealand and shocked at the power the Hospital has. 😭

Another important point to this case is while the hospital where in denial of the condition CPS OR CRPS, accusing Maya of suffering from munchhousing for the whole stay accusing the mother etc, on the insurance claims from the hospital they wrote CRPS! Maya & your family I wish you the outcome you all deserve x

All that hospital needed to do was call the two Doctors who prescribed the ketamine therapy. They failed to do that one simple thing. Instead they demonised Beata and destroyed her.

I have crps. I woke up from my third ankle surgery and instantly realized something was terribly wrong. My tendon repair didn't hurt where it should have- yet, it was excruciating pain in my toes, heel, ankle and front shin. For 8 years I was treated with high doses of opioids. I'm now on suboxone and enduring the pain. The opioids worked until they didn't. The opioids eventually made the pain unbearable. I would totally try this ketamine therapy! Praying for justice in this case!! Praying for Maya!!❤😢

My niece has had CRPS for over 15 years. They used ketamine infusions to wean my niece off of the opiods. She still had withdrawal symptoms, but thankfully, she was able to get off them.

What blows my mind is in 2017 medical staff should be familiar with pain syndromes!! I was diagnosed in 2007 and pain conditions have become more recognised and studied. It’s crazy that they didn’t know enough about it and treatments.

You was diagnosed with CRPS? From everything I’ve gathered it’s still not a very well understood condition. It’s still so rare that most doctors never even run into it and that’s if they’re even able to diagnose it.

​@adish7275 This is a totally different hospital issue going on here for Maya's situation. This has nothing to do with anyone here needing medical attention for ourselves. We will all go to a hospital to get the right medical attention that we're in need for. But on other grounds we also don't have to put up with hospital's mis diagnosed on our conditions putting up with their rudeness towards us & anything else in between. They are all getting paid regardless. So this isn't about us! Just for one example before they finally thought of this light bulb 💡. When you needed your left leg amputated and wake up to find out that you no longer have your right leg and still have your left. Doctors make alot of mistakes too. Just now this mistake from these doctors cost this poor young lady growing up with the most important person that she needed in her life 💔 now😢😢😢 growing up.

JH poorly understood crps and yet charged the family crps... That is so insane! Mom probably thought she was being targeted instead of focusing their care to her daughter, she needs to be out of the equation hence she took her own life...mother's love is so immense..much love and respect. The hospital disagreed with the treatment Maya had received from other doctor and even spoke with other doctor. That's fine. Just say that you aren't comfortable providing same treatment, and let the family take her somewhere else. How it escalated into what it did was so beyond extreme and unnecessary. I don't know how those who were part of it sleep at night.

My son in law has a virtually unknown form of Muscular Dystrophy. And it’s killing him. It too is a neurological condition and the one thing we, as a family, have found is that when medics, health professionals etc have little or no knowledge about a condition their automatic response is to disbelieve, underestimate and blow off the condition. He’s dying and one doctors concern was that he might become addicted to mild…mild ! pain meds. He was accused of being an alcoholic, this man’s who can’t move off the bed, cannot stand or walk and he doesn’t drink…never has. His liver is damaged by the medication he takes. And on it goes. It’s almost that for some ‘experts’ their lack of knowledge is personally insulting to them and the patient is to blame.

By the looks of it, it seems as though she sacrificed herself to save her daughter. I don’t think anyone would have listened if it wasn’t for her, and most likely her daughters condition would have worsened until death. God bless her soul, and her family 🤍

They certainly don't, many will cover up their mistakes, hoping Not to get caught. I know through family members of a couple of doctors in another State, both caught over medicating their patients to the point of death. One tried to flea the Country, both now serving time behind bars. I don't trust doctor's.

I agree with you! I have read the comments posted by people who are heartless and cold, who lack empathy and compassion, understanding and kindness. They are meanspirited! Thank goodness, not everyone is like them. They have no conscious to feel what this family and other families go through, when their loved ones have the same syndrome's. When the mother lost all hope, felt helpless and accused of wrong doing, when all she did was love her daughter and the determination to get her the necessary help she needed. Being a nurse herself, she knew what she had to do for her daughter, only mistake was made, was to put her trust in JH, the doctors and social workers, they were the people who did the family wrong. I hope and pray the family wins. 🙏🏼🙏🏼

Heartbreaking is the only word that comes to mind when you think of what this family has and is going through.. They’re extremely strong and I am so happy that Beata did not sign that document that would allow the hospital to not be liable if any wrong doing..

The big key piece of evidence was the hospital was denying Maya's crps yet the entire duration of Maya being held there, they were charging the insurance company thousands of dollars for crps treatment.

its crazy in the case of Gypsy Rose nobody realized it was Muchousen by Proxi until the mother was killed, and then here they couldnt understand that it WAS NOT muchousen by Proxi and Maya actually had a dease until the mother killed herself, Its like each time they want to look to wrong perspective.

If Kowalski's attorneys digged deep enough, they'd find a very lucrative contract between the hospital and CPS. This medical kidnapping happens constantly at Phoenix Children's Hospital and yeah, there's a lucrative contract between Arizona Department of Child "Safety" and PCH. In our world it's called trafficking.

Her diagnosis of,complex regional pain syndrome useds to be called RSD Reflux Sympathetic Dystrophy. It is a real thing to. Justice was done right. was a 32 year HC worker and sad how some not all lack compassion and ego and judgement along with business attitude has ruined the spirit of health care.God Bless this family and mother.

Everything about this case is heartbreaking. The hospital claims they were “protecting a child” yet so many inflicted continuous and increased harm including denying “actual treatment”. Certain individuals seemed more interested in criminalizing the mother than treating the child. The statements in the depositions and the responses on the witness stand were so ridiculously fabricated. It’s unbelievable that in the end they still denied any wrongdoing. Egos and opinions sadly held more power than actual healthcare.

I have mild CRPS from a distal radius fracture August 2020 where the bone had to be wired to secure it. I remember the feeling on the back of my hand was being scalded when it brushed my clothing….and there was aching pain and my hand was much smaller than my other one…but thankfully it has dissipated. I have since met children who have suffered fractures and subsequent CRPS. It is real. I do hope the family win this case, however Beata was treated in the most injurious manner and the hospital staff must be held accountable. The social worker, especially, as it sounds like some staff fell down a rabbit hole believing that this was a case in Munchausen by Proxy…this is an example of tunnel vision, with such tragic consequences for Beata, Maya, and the rest of her family. 🐑🐑🇳🇿🇳🇿NZ

I wish this as well. They need aggressive lawyer's who will fight harder for the family. The attorney they have, seems weak, bored and tired. He doesn't have his work organized.

No…there were dozens of diagnosis and small percentage of CRPS which is a group of symptoms, a syndrome, not a disease.

I would think so, why bill the insurance company when they aren't using whatever medical methods they claim only to the insurance and not the patient. Maybe the insurance company will look into this matter.

@@rebeccalasiter5429 because there were many diagnosis they were billing under and CRPS was very low percentage, it’s not uncommon to bill for a diagnosis they are trying to rule out. Ketamine is not used to treat that diagnosis anyway but they were treating her with other proper meds.

Money won't bring their Mother back. Maya is heard and believed, and her Mom being vindicated from all the lies. That made their hearts relax a bit. I watched the video when the verdict was read. Their faces just warmed my heart. The money will make things a bit more comfortable. I hope they all have some relief from all of the stress and do something to decompress. Yay for them

Yes, exactly. It's completely unreasonable and that's why the hospital was found guilty of trigerring this - you have to be going creazy with pain to do it. On the other hand, it worked - Maya was home 6 days later.... It does look like the mother gave her life so that her daughter's suffering could end.

Crazy how many mistakes happened among medical staff, how many times they did not show empathy or acknowledge that beata was a nurse and her daughter had been suffering for a long time. The family was let down at every corner

I was tortured to death, twice in one day, at my local Virginia MN hospital. They did it in front of my aunt and left the ambulance waiting outside for over 4 hours to transport me to Duluth Nut hut. The ambulance gave me haladolfor the ride. I HAD A PNEMOTHORAX

We need CPS training for attorneys, so more will take these cases and win. Try calling 100 attorneys and ask if they will take a case to sue CPS. You are out of luck,nobody handles these cases, and they don't know anyone who does. There is no place to complain to that isn't government run. They won't find fault with themselves,they dont want their state sued

Heartbreaking story. And thank you for covering it. One tiny suggestion, though, you might want to change the background of the main commentator. It looks like splattered blood stains, especially on the left. I was in marketing and promotions for a long time, and I think it was worth passing along. Yes they had medical records and experts who diagnosed Maya. The nurse in court admitted she deliberately left out any information from other doctors and experts because she says she knows better. The family won their case.
