That woman, Shawn Mullarkey, is currently in jail and is facing all the charges mentioned, plus violation of probation for DUI, hit and run that happened just before the police arrested her, a separate hearing involving her hitting her husband with her car and her children have been taken away from her.

The difference between first and second degree murder is just if you planned it, the sentencing will likely not be effected much because in the suitcase case it was such a brutal way to kill someone that she’ll likely get a harsh sentence

Depends on the state, but you can get a first degree murder charge for killing someone in a cruel or tortuous manner.

For anyone not familiar with the Sarah Boone case, they had receipts or video footage of her buying bottles of wine prior to her leaving her boyfriend in the suitcase. She was adamant with the cops about how HE had been drinking, but she wasn't drunk, yet she drunkenly recorded two separate videos (probably why she can't remember recording them) of her boyfriend in the suitcase trying to get out while she cruelly mocked him. When the interrogators asked her why she left him in the suitcase, she repeated over and over that she went upstairs to lie down and unintentionally fell asleep "thinking that he'd come up any second" and then found him the next morning, dead. They asked her why she didn't let him out before going upstairs, and she kept claiming she thought he could get out of the suitcase himself, and that there was a little bit of space near the suitcase zipper when he could've easily freed himself, but she fails to show the cops where the opening would be in the suitcase. The second video shows that the case had been flipped over, upside-down. The interrogation will more than likely give you a migraine, considering that Sarah's got a pretty grating voice and her conversation with the agents continuously goes around in circles.

I live in the US and cops do use the breathalyzer. They use them quite often when they think suspect someone might be intoxicated

Yes and no. They will use a portable breath test but because of how inaccurate they can be they're only allowed to be used to detect the presence of alcohol. If you test positive regardless of the number you're taken to the station for a visit with the intoxilyzer or to the hospital for a blood draw.

@@m2hmghb But you still have to blow above the legal limit before you are taken to the precinct. It happened to me and I got cuffed and took the test again at the precinct and I was below the limit. It was NOT fun. I don't think people realize how uncomfortable and painful being cuffed is for a long period of time.

Life in prison would mean you die there with no parole. A parole board could decide to release you, but that's hard to get them to release you. Some states and the federal government still have the death penalty.

That’s life with parole, but you have to prove you have remorse and have changed and even then it’s difficult. Life without parole means you’re going to die in prison, no chance of getting out.

Abuse by women goes WAY undereported for several reasons. In my experience I would say the number of domestic abusers for each sex is closer than most think. Just second hand knowledge from the domestic violence attorney I screw.

It's not anywhere near close - domestic abuse is underreported on both sides, but the victims are still disproportionately women. There are definitely more male victims than people think though, and the stigma is very real.

The studies I've seen have indicated that women are the majority, but not the vast majority. The problem I personally have is that there are women's shelters and domestic violence shelters but they don't take men. In my state there are no men's DV shelters.@@itsonlysound

the suitcase one was pretty dang horrible when you see the entire video about it. watched it a couple months ago. she was a horrible person and had a kid. she even called her ex-husband over to the apartment to try to get his help the next morning after leaving her boyfriend for dead in the suitcase all night where he suffocated to death. he made her call the cops. think he left and called the cops as well just in case. when the cops got there, they made her go outside. she kept trying to make excuses to have to go back in, probably because she left her phone in the house with the video she probably just remembered recording. she was saying some of the most out of place comments when the police were there at her apartment too. it was like she really didn't have any concern for the dead boyfriend. they didn't let her in and phone became evidence. She kept talking about how she was such a loving mother and a nice person.... her Ex had custody of their kid because all she did with her life was go out and drink and party.

We do breath test but sometimes that isn't an option. So they will get a warrant and do a blood draw to get an alcohol level.

There's a video called something like.... when the detective realizes the suspect was a gunshot victim or something like that was really interesting... spoilers.... the cops go to a house because no one had heard from a couple.... a confused man opens the door... it's the boyfriend... the girlfriend is dead on the couch with a bullet wound... the cops interrogate the bf for 10 hours and he seems drunk the whole time.... the cop tells him "look at me"..... realizes the guy was shot in the face too and that's why he was so confused. Now he has bad brains and a million dollars

You get breathalyzed in the US...where I'm from if you get pulled over for suspected DUI you can refuse it but you automatically lose your license for 6 months. I was at court and a 60 something year old man showed up for surprise surprise his DUI charge...well we he came into court to go through the metal dectectors and empty your pockets and what not the officers smelled booze on him..they waited till after his court date for him to leave the courthouse and get back into his car drove off...they arrested him again in front of the court house for another DUI. I just asked for anxiety medicine and my GP just wrote me a prescription.

Not long after 9/11, I had to make a 15 hour flight. My doctor prescribed me valium to take during the flight for nerves, but luckily, I knew not to mix alcohol with a benzo like valium.

We definitely have breathalyzers. Ones that just check for presence of alcohol or drugs as a presence/absence and one's that give a readout of alcohol level. Then there's accurately calibrated ones that can have the level used as evidence in court. They arent handheld and are larger so they are kept at police stations.

Also in some states you can refuse field sobriety tests as it actually is pretty bullshit and unreliable. Even sober people sometimes fail it. I got pulled over in Wisconsin where I live and I did the stupid thing of doing field sobriety tests and failed supposedly even though it was like 20 degrees Fahrenheit outside and I had only a t-shirt on. I got cuffed and taken to the police station and I blew a .001 on the machine which is like the negligible amount that mouthwash would trigger and I knew that so I kept telling them that. They still initially gave me the ticket for OWI which I found out I separate from being over the actual limit and is based off of officer discretion. They cited me and released me, but there was no way that would stick in court. They tried calling me but I had no idea who was calling so I didn't answer. Later they both actually showed up at my house and said they dropped the ticket. The initial stop was for a burnt out taillight I had on my car, so it was pretextual, but they did end up making the right call in the end.

Depending on the charge and the state, as Dave mentioned life in prison could vary. All states do have a life in prison without parole, but considering they only charged her with second degree murder (intentional but no premeditated or pre-planned), she’ll have a minimum sentence before she can attempt parole (probably 25-40 years). It’s hard to get parole though, so there’s a strong chance it’s “life” life. Death penalties only come from first degree (intentional and pre-planned) and even so they vary amongst states as well.

The difference between first and second degree is premeditation. 2nd degree doesn't have much of a difference in sentencing. As for pepper spraying someone like the woman? Nope. Uhh uh. You don't want to be stuck in a car with that crap on her AND it will get over everyone who handles her. For that situation it's the worst option. I've never had to deal with it - but I've heard enough complaining from my dad and cousins about it. Best way to use pepper spray is to disperse a hostile crowd - you don't have to go hands on and it makes them bugger off.

We usually do the breathalyzer after they’ve failed the standard field sobriety tests…. And then officially do the test again in intake.

“Give them more rope”?! Cops are specifically trained to keep people talking so they incriminate themselves. The hardest thing is convincing citizens to shut there mouths and invoke their 5th Amendment rights. If cops are talking to you it’s because they’re building a case against you. Law Enforcement 101.

I follow True Crime and Law and Crime Network. I have been following Sarah Boone case for a long time now. We are awaiting her trial that keeps getting pushed back, but as it stands right now is meant to happen in September this year I believe.

A life sentence in the United States can only be shorter if the individual meets the criteria for parole at some point or they die in their cell. A life sentence without the possibility of parole means you’re going to be facing your final breaths in the jail.

I refuse to fly without diazepam. I am terrified of flying, my doctor issued it for me no problem when I went to France. I fell asleep right before take off but woke up right before landing, they really did help though

See you next Tuesday, Mrs. Mularky… US Police absolutely do have breathalyzers, but Americans have the right to refuse to take them. IIRC, if a cop has suspicion someone is under the influence, they can ‘offer’ the breathalyzer option, and if you pass they can’t detain you on suspicion of intoxication. However, if you refuse, they can arrest you for suspected intoxication on the spot.

This isn't baseball. Three DUIs with a child passenger is almost as crazy as the other two. And the way it was worded makes me wonder if she had more than three DUIs in total. I'm all for rehabilitation and paying your dues but that one seemed like it could have been somewhat avoided. A licence isn't a right, it is a privilege.

They do the breathalyzer here. Most states have a legal limit of 0.08. This would be near 80mg/100mL.

The one where the cops drag their mother out of the car in front of them goes both ways!! The cops were obviously working well within the law & what they were supposed to be doing…, but I can tell ya if I was one of those kids I’d hate cops for a very long time afterwards… it would be scary as a child seeing your mother dragged off by the cops possibly not understanding the full scope of the situation.. Also who was going to look after the kids once the mother was arrested???? I’m sure as a mother part of her reaction to the cops was ‘cause she was concerned for her kids safety & welfare as well! I really think they could have delt with this situation differently!! But I am open to being wrong!!! 🤷‍♂️

We do use the breathalyzer. If you refuse your license will be suspended for a year. There are ways to work around that whether it's a work permit or getting one of those devices you blow into so you can start your car. Malarkey sure fits that little boys name of Malarkey

in US even if you offer no physical resistance whatsoever they can charge you with "verbally abusing a police officer" just for yelling bad stuff at them on other hand courts have ruled you can give them the finger without fear of arrest if that's all you do but I haven't tested that out yet⚛

So her name is Sarah but you will call her a Karen. I am a Karen and frankly am getting tired of people assuming that Karen's act in certain ways. I for one love my name, my wonderful parents gave me that name. I have always had respect for all people. I have never killed, wounded or screamed at someone or acted crazy in public. Why can't folks just call all of the nuts by their real name. I have several friends named Karen and none of them have acted in some crazy, moronic way. All of us sweet, wonderful Karen's would appreciate if the narrative could change!! Thank you!

The problem with American cops is that they have to be careful about “excessive force” lawsuits because unfortunately criminals get extra rights while the police get their hands tied, and that’s all thanks to politicians. For example, in my home state of Washington the state government passed a law banning pursuits unless they present an immediate danger to the public (which as anyone with a brain cell would know, all pursuits present dangers to the public) so now criminals here feel emboldened to commit crimes and if the police do their jobs they get reprimanded, fired, and/or sued. I often ask how these bills ever passed and how people can be that ignorant of the consequences.

Too much rights given to people is subject to abuse like this by bad people…threatening to sue and human rights abuse claims are prevalent because of a broken system…i don’t see this happening to other countries…try to act like this in other countries and see what happens….

You seriously don't think it happens or is worse in most other countries? The reason there's so much true crime stuff based in the U.S is because of how open to the public it is, other countries dont even accurately have reports on crime.
