I am not clear on what happened. In the videos I have seen the man comes up to them starting a problem. I heard him being asked to leave. He got physical with a female which pissed off the males. All the old man had to do was leave. He could walked away like he did BEFORE he stabbed people. They were typical drunk young folks tubing on the river and this old man walks up. I knew some guys that loved tubing down the river and that old man probably wouldn't have made it here in Texas especially with knife.

I think stabbing 4 people is not self defense.if he only stabbed AJ then it would be self-defense because AJ assaulted the man But either way he stabbed four people three of which were not committing a crime at the time so he could be liable for three counts of attempted murder. Those other three stabs unjustifiable especially for Tony, because Tony was trying to break it up and the attacker stabbed him. While I do think the teenagers were in the wrong to start a verbal confrontation to the man I think they really could’ve handled the situation differently, and there would be a different outcome for the choices of both parties.

Inebriated or not, eye witness testimony of things that happen in high stress or adrenaline situations is pretty much worthless. They tend to get all kinds of things wrong, bc that’s just how the brain and memory work. You may think you have a 100% accurate memory of something big that happened to you, but if other witnesses were asked they would have a different version than you, and if there was video that would be another version likely different from BOTH witnesses recollection of the events. It has been proven in a study that someone picking a random person out of a group of pictures of ppl they’ve never seen would be more likely to pick the correct offender of a crime than an eye witness would , especially if the witness and the offender are not the same ethnicity.

If you read accounts of War. This injury can be caused rather easily. Apparently if that center artery isn't cut, most people survive being disemboweled. Or at least it takes a long time to die from having your guts exposed. Heart Wounds, it's just over within seconds.

There was never a time when his life looked to be threatened. Explain when there was a time where there was imminent and immediate threat to his life? He never even received what could reasonably be considered a minor injury. There were a lot of mistakes made by all parties physically involved, but the defendant made the most serious and the initiating mistakes, and he escalated things to the level of extreme injury and death with no reasonable excuse for such acts.

It was also much different circumstances since it was at night and Acre-Kendall claimed to have been pulled from their car as they were leaving and put into a headlock or choke. As he was passing out he swung the knife which took the guy's life. Where was the choke here? Where was the fear for his life when he ran up on a group of teens & started touching them? Nicolae Miu would be considered part of the group where the guy died in the Acre-Kendall trial. Had the kids known he had a knife and killed him it wouldn't have even went to trial. If the kids took Nicolae out immediately after the stabbing started then I would argue at the point they would be protected under self-defense laws. In the other guy's testimony in that trial he claimed when they walked up on Acre-Kendall, they saw he flashed a knife, warned them yet still chose to engage. Sounds like they found out the hard way. He also admitted to intentionally parking far away from Acre-Kendall's camp so they wouldn't see them coming (a.k.a. an ambush.) The kids in this trial were unaware of any weapons especially since no one expects weapons during what is the equivalent of a pool party. Miu was simply never in any life threatening danger and therefore never had a reason to use lethal force.

I keep writing all of these overly passionate comments about this case (it's been really disturbing to watch), so I'm trying to police myself a little, but I will say that I'm not loving the prosecutor either. You're right, he's all over the place. Having said that, I feel like he could still win. Almost the entire thing was filmed, which is very rare for a murder trial, and I think the jury is mainly going to make their decision based on what they saw. IMO, a strong defense or strong prosecution isn't quite as important in this case because there is actual documentation of the crime. The lawyers can say whatever they want, question whoever they want, show whatever they want, but at the end of the day, the jury will have to decide if they think that what occurred in the video was an act of self defense.

In his defense, when you know your witnesses story’s have all changed and don’t match the video evidence , you have to walk a narrow line to try and avoid discrediting your own witnesses. What they feel are well intended lies, along with their actions prior to the stabbings are making the prosecutor jobs very hard.
