Apple River stabbing trial: Witness days Nicolae Miu defended himself [FULL] 

This trial should be called the fuck around and find out trial

All of these people mocking this witness for speaking Spanish are being azzes. I'm sure he speaks some English, but he's probably more comfortable answering questions in his native language since it's very important for him to be precise and say all the right words.

After watching the video and listening to several testimonies, I've concluded that just about everyone involved was acting like an instigator and should have just kept to themselves. A lot of people screwed up their lives in just a few moments of foolishness immature behavior.

Although it is a tragedy a young man’s life was taken, as a victim of bullying by crowds of teens myself, I find it somewhat hard to sympathize especially knowing how cruel they can be. This culture of worldstar fight videos and predator hunting for views seemed to have ultimately created this situation.

He did not tell them boys he was looking for little girls ,they made that up .If they had not been calling him names and picking on him none of this would have happen. They had no business bothering him .Teenagers have no respect for older people are themselves .

(in a public place not bothering anyone) Old man: 'I'm looking for a lost phone" (confirmed as true) Teens: "You are a pedo looking for little girls" (no evidence) Teens: Bully and torment old man relentlessly. (per video evidence) Old Man: Defends himself with pocket knife. Teens: No longer tough but crying and are now "victims" (according to them) Old Man: NOT GUILTY

The woman put her hands on Nic before he hit her, she was in his face screaming and swearing, once she placed her hands on him he had every right to put his hands on her

He was being assaulted by multiple assailants. He was within his rights to use a force multiplier like a weapon. Very sad all around.

That second group escalated the attack on that man. Self defense. If I was alone I would have been so scared too.

Self-defense law requires the response to match the threat level in question. In other words, a person can only use as much force as required to remove the threat.

Imagine if there was no camera footage. This guy would be screwed. Yes, it's a tragedy, however, if these courts and prosecutors continue criminalizing self defense we are all screwed.

after video and more videos of witness testimony and seeing the several breakdowns of the original video taken by the black guy during the initial conflict, yes, I too saw a bunch of drunken men and women make accusations about the guy trying to find the lost camera. They laughed and assaulted him and yes they even stole his mask and thew it away for bullying fun. all the while making jokes and laughing. then began the real issue, the so called kids assaulted the man, threw him down in the water several times and gathered around him overpowering him and yelling hes a pedophile and taunting him mercilessly. time and again the video shows him being pushed in the water by several men and the women were screaming foul language at him. finally, after some time of this disgusting bullying he was able to gain his footing for a moment and took to defend himself and lashed out at the ones who were surrounding him and assaulting him. I see them crying today, wailing of pity me, pity the poor children who turned out to be hooligans drunk and beating on a solitary man who had done nothing to deserve being beaten and shoved and forced underwater. he was looking for the lost camera, he was attacked by drunken crowd and he defended himself.. now they cry for pity...NO! if i were a jurist, id see it for what it was, he was attacked without cause.....he was being forced underwater by a group of hooligans and alone he defended himself. shame on those who call themselves victims now...

He is clearly not guilty, he did not chase anyone, everyone who was cut came to him to push punch kick and drown, once he got away he had no reason to defend himself as he only wanted to be left alone, that is not too much to ask, not guilty

The amount of taunting and bullying, could have led to nicks death. Self defense.

The defendant was in the River with no ill intent. Same cannot be said for cameraman & instigator 'Cockfield'.

Such a sad situation, however i could not find a guilty verdict. I have doubts and second thoughts. I could go for manslaughter maybe..but not the charges he facing. The case was not proven for me unfortunately

It doesnt really matter if this guy didnt see the knife cause the people being stabbed with it couldnt even see it and they were way closer. People overlook way more details than they think. More so when things move fast

People (teens in this case) need to stop harassing and provoking people. It could have been someone with a gun instead of a knife, and they could have all been shot.

This is self defense all the way - these kids today are too comfortable disrespecting adults. It's tragic but they caused this all.

I was there but i didn't see what happened we were leaving. I saw more cops and helicopters than i ever seen before in Somerset. All we heard was somebody was stabbed. I had no idea this trial was what happened that day.

This testimony has a ring of truth. This man did not know the defendant and had no skin in the game. This is his view from outside looking in. Also, another witness almost had the same testimony. This is such a sad situation. An old man is looking for a cell phone in a river and floats upon drunk and high people. Someone yells, "He's looking for young girls," and incites hostility. This sets the wheels in motion. So sad.

The drunk and high kids completely instigated the situation and the drunk girls weren't trying to hear anything but drama then all hell broke loose. Don't fuck with random people and laugh hysterically while doing so and act surprised when someone defends themselves from a mob of people attacking.

It does not seem like a good look, when the lawyer sits through all of this with his head and face in his hands. What was up with that behaviour? I think i would be terrified too, if that many agressive teens were all coming at me at the same time. Like a pack of drunk wolves. All that laughing, mocking and knee slapping sure came to an end quick.

Ater watching hours of testimony and reading all of the reports, I am convinced that this trial is nothing but a witch hunt. As a mother of sons, I understand the need to blame someone, but I also know what a bunch of young guys half-drunk can cause and this is it. I don't think for one minute that this man had any ill intent and genuinely feared for his life and reacted accordingly. It's sad that this man's entire life is ruined because a bunch of immature man/kids couldn't just mind their own business and instead chose to show off to each other. I wouldn't call any of the people injured "victims", and just by virtue of the fact that they are referred to as such indicates to me that this isn't going to end well for this man and his family. I also don't know why the attorney didn't ask for a change of venue. Anyway, I pray that this man is found innocent and those who were injured learn something from this..

Old man had several times he could have walked away! Old man came up and grabbed the teens tubes! The teens said mean things to old man! Old man still doesn’t walk away. The blonde women come over and tell old man to leave….he then punched her!! He was the first to be aggressive! It was then that they all jumped him! He was the only one with a weapon! He proceeded to stab a bunch of them! He killed a young teenager! He walked away as they were all bleeding to death…He walked away as if nothing had happened. He never told his friends that he feared for his life, he never screamed for help, he never called the police to report he had been threatened by a gang of young teenagers and a few people who came to help them. He lied to the police! The first thing he said to the police is “ I understand there was some stabbing and they say I look like the guy”. Does that sound like an innocent old guy fearing for his life! This man is guilty!!!

The amount of people that think this is justifiable and will hold up in court as self defense is scary. If you have any Knowledge of self defense laws it is easy to see he did every single thing wrong from the start of the encounter. He was up river when they were exchanging words and he was the one that rushed downriver away from his group to further instigate the situation. After an attack as the defender you must contact the police and surrender the weapon and give your statement. He lied and hid the weapon then tried to leave the scene. That will never hold up in court as self defense. What you do after is just as important as the encounter when it comes to the court of law

I enjoy how the language barrier sort of prevents the prosecution from asking the stupid beating around the bush type questions. He doesnt have to fumble around and get tricked into a narrative

The teenagers are also to blame for what happened. This all started when the first drunk group stopped to ask Nick “hey what are u doing?” And then started tormenting & making fun of him. This started a group frenzy which caused other groups of drunken teenagers to stop & involve themselves & then escalate. If they simply minded their own business & simply floated down the river, none of this would have happened & no one would have got injured or died. I think Nick should only get a light sentence for the death of Issac. He was provoked & scared once they started pushing & shoving him.

He has his snorkel in his hand when he charged after these kids, not wearing it snorkeling. He dropped it trying to tackle the group of tubers. You heard me, that older man. Couldn't take being teased by kids and he lost his shit. Charged after them, went hands on and that's when the girls got there and tried to tell him to go away. Then he hit one of them, that is when the boys engaged him. These attorneys are absolutely awful

All those people never should have started attacking that poor old man. What were they doing taking drugs and getting drunk by the water in the first place. The old man was the only one that was sober.

The man performed the stabbing after being brutally attacked by a crowd of teens. I don't care if he hit that girl. Nevertheless, in that moment, when he performed the stabbing, he was being attacked.

Prosecution has rested it's case? What about calling the doctors that cared for the victims? The medical examiner too? This case is a disaster. They call a hostile witness, the defendant's useless wife, but no doctors.

Not one person who has never been in this situation can honestly say how you would or wouldn't react. I believe this witness when he said he didn't remember something when it first happened because of all the stress he had just witnessed. Sometimes, your brain tries to protect you and block things out. When the police first questioned him, he hadn't had time to reflect on what just happened. It's been almost 2 years. He has had almost 2 years to think about what he saw. This whole situation could have been avoided had those kids minded their own buisness and kept their hands to themselves. I was taught that at an early age.
