CLARIFICATION: The First Amendment standards described in this video only apply to public colleges and universities. Private institutions have more power to restrict speech.
Are the Palestine protests happening on public college campuses protected speech?
Encampments prevent other students from using the space, cause disruptions to campus activities and create a public safety risk. So no, they aren’t protected speech. You also don’t have a First Amendment right to protest wherever, whenever, or as loud as you want. You do have a right to share controversial statements and signs. #FirstAmendment #freespeech #college #palestine #protest

it's so fucking ironic to say that when they are just a minor inconvenience for others rights while they protest in order to put a stop to human rights violations with numerous war crimes, which, if you ask anyone who isn't brainwashed, is more important than your right to have clean walls/floor or a place to sit on grass

@izumi2165 they're not really protesting to stop the war though, even though that's the position of their chants/slogans, they have concrete demands for their institutions to stop partnering with and investing in the arms industry. A few schools have acceded to student demands and the protests stopped overnight.

The government can’t restrict your speech. That’s why even though I thought social media companies were making a mistake in suppressing certain posts, I also thought they were within their rights as the service providers. That changed when it came to light that the government was directing the whole thing.

Well, they moved from being a platform to a publisher when they start removing posts based on their advertisers whims. They just need to start being treated as publishers and sued for libel like the NYT and washington post would be if they published untrue statements.

@@Fodkdj the speech in freedom of speech is any communication of thoughts and ideas within you property rights. If laws protect or violate freedom of speech is another question. Freedom of speech is essentially a property right.

Not everything is. Defamation isn't, personal threats isn't, and shouting fire in a crowded theatre isn't. Protected speech is an appropriate term

Dwight Eisenhower had something relevant to say about universities with ties to the defense industry: “In the same fashion, the free university, historically the fountainhead of free ideas and scientific discovery, has experienced a revolution in the conduct of research. Partly because of the huge costs involved, a government contract becomes virtually a substitute for intellectual curiosity.”

The protest itself is constitutional. The other things that they are doing such as the danger to public space getting other peoples way no those are charges that should be filed, and these people should be jailed, but the speech itself is protected.

The second amendment is regulated but it is still a fundamental right of all Americans to own the weapons of their choice. If you want to put limits on it okay but they need to be reasonable and based on each individuals actions.

Paying tuition doesn't mean I have a right to disrupt the universities activities. That would mean any student could with enough other like minded people cudgel the university into supporting any idea regardless of whether it was actually valid.

1. Paying tuition does not give you full reign on a campus. Paying tuition gives you access to classes and other services provided by the college. 2. These protesters are disrupting access to classes and services for other students who are also paying tuition. You are allowed to say what you want, but once you begin taking something from others, you are no longer participating in protected speech.

Do you think women in the civil rights movement created encampments on public property and then blocked men from entering a public space? No. They protested during daylight hours in public areas peacefully, then dispersed after. Big difference between that and these terrorists you call protesters.

Civil disobedience is not protected free speech. It can be a useful tool for change, but it's not protected. Being arrested for it is kind of part of civil disobedience.

WRONG! it is protected. protesting is a natural, and constitutional right, covered by both freedom of speech, and the right to assemble. Indeed you can "protest whenever, wherever, and as loud as you want" protesting is specifically supposed to be disruptive, unpleasant, inconvenient, and yes, even unsafe... if people dont like it, they can change their ways so there is nothing to protest against. You have a right to free speech but other people also have rights such as peacefully attending a school that they pay large amounts to attend. You do not have a right to interfer with others rights and nobody has any obligation to either listen to or care about your protest.

I don’t like the argumentation here. The only property which can be protected by freedom of association is a private one. If the college is public, I’m not sure I can find reasons to defend government repressions. And I know for sure that about 5 years ago they used the same argument to forbid protests in Russia, saying you have a right to protest but not everywhere. All the city squares are occupied with public festivals and people walking, so the protests will disturb them.
