I initiated a traffic stop on the vehicle on I-40 Eastbound near the 3 mile marker, made contact with the driver of the vehicle
P. Caldwell, as well as his two passengers (later identified as S and T). Upon making
contact with the subjects I identified myself as an Arkansas State Trooper and advised them why they had been stopped. I
then asked Caldwell for his driver’s license and vehicle information. Caldwell provided me with his driver’s license and stated
that the vehicle was a rental car (Caldwell provided me with a copy of the rental agreement). While speaking with Caldwell I
asked him where he was coming from and where he was traveling to. Caldwell stated that he and his passengers were coming
from Oklahoma where they had been to a casino to celebrate his wife’s 42nd birthday and were now returning home to North
Carolina. I also asked Caldwell if there was anything illegal inside of his vehicle and he stated “No”. After retrieving Caldwell’s
documents I returned to my patrol unit to conduct and NCIC/ACIC check of Caldwell’s driver’s license.
During my conversation with Caldwell I noticed that he seemed to be extremely nervous (his hands were shaking while
retrieving documents and he would not make eye contact with me). Also while conducting the check of Caldwell’s driver’s
license, I noticed that the rental car was overdue to be returned (showed to be due on 1/10/2023). I also found it to be
extremely suspicious that someone would travel from North Carolina to Oklahoma just to visit a casino, given that there were
multiple casinos closer to North Carolina. After the check was complete, I returned to Caldwell’s vehicle, and had him exit the
vehicle. After Caldwell exited the vehicle, I asked him why the rental car was overdue to be returned. Caldwell stated that he
had extended the rental but did not have the paperwork for proof. I then asked Caldwell for consent to search his vehicle and
he stated “No”. I then advised Caldwell that I had a narcotics detector canine and I was going to deploy him to conduct a free
air sniff of his vehicle.
I then had Caldwell and his two passengers exit the vehicle and stand on the shoulder of the roadway. After all three
occupants were out of the vehicle, I deployed my narcotics detector canine “Raptor” to conduct a free air sniff of the exterior of
the vehicle. During the sniff “Raptor” indicated to the odor of narcotics. After the sniff was complete, I advised Caldwell that my
canine had alerted to the odor of narcotics, and I was going to conduct a probable cause search of his vehicle. While searching
the vehicle I located a black suitcase, gray suitcase, blue duffle bag, and a white striped duffle bag in the trunk of the vehicle.
Upon opening these bags, I located numerous vacuum sealed bags containing suspected marijuana (approximately 70 pounds
in total weight) I also located a loaded Smith and Wesson .9mm pistol in a black bag in the front passenger side floorboard.
After locating the suspected marijuana, all three occupants were taken into custody, advised of their Miranda Rights, and
transported to the 12th DTF Office for interviews.
