I personally don't blame the defense attorney, they're just doing their job. You'd want them to do their absolute best and try every trick in the book if they were defending you. But at the same time, this light bird could have easily told their lawyer that they weren't comfortable with this defense and that the should go with something else.

Not just for that offense but EVERY offense - officers (and in some instances senior enlisted) do not get punished at the same level of accountability as enlisted. Especially junior enlisted. And not hopeful that that fact will ever change

I knew had recently taken Command and some underhanded shit at the base came to light -- coincidentally, the 'discovery' came days after the Col. stood his ground and refused BS 'orders' from HHQ. The Underhandedness [conscious mishandling / improper storage of live ordnance] had been going on for more than a decade (most likely 20+ years since the 'certified storage area' maintenance contract was in limbo and 'delayed' for over 15 years...). Some prior commanders, within the conservative '10 year' window, even eluded to the continuance of said 'practice' within their Awards as major cost savings initiatives/ accomplishments... All previous Commanders that had been, promoted and moved on, got a pass, but this TRUE & RARE Col. (character & rank) who was 'present' when outed 3 months in position, was sacrificed with everyone knowing full well why -- he was legit and did not play 'their' games so he had to go... Legit people, enlisted and officers alike, have to be 'removed' so the dirt can look better by contrast versus actual character, integrity & values.

Yup. Happened to me, even. Instead of CBD, it was that synthetic marijuana. Only bad mark on my good record and they didn't even think about helping me or figuring out why I had smoked the shit. They OTH'd me faster than they could find a drink. It was then that I realized the US Navy is a fucking joke. There was no camaraderie. Medical couldn't even diagnose why I had issues sleeping and eating. They didn't give a damn. Just tossed me aside as soon as I slipped up. Meanwhile, my captain's mast had plenty of repeat dui offenders, who got slaps on the wrist and a guy who got caught with real weed, getting a general discharge. Fuck the Navy. Glad they discharged me early, so I didn't waste too much of my life in that cesspool of freak jobs.

I think your statement is largely correct for most enlisted and junior officers. That being said, once you have been in long enough (or know the right people) to be in the good ole boys network (ESPECIALLY for officers), you flip it back to keeping everything in the military.
