I get it. We've all had to endure some BS training or tasking after a commanding officer, NCO, or supervisor told us "it was mandatory" or it was to "complete the mission." We've all had to roll up out sleeves and do something we didn't find comfortable. I feel like this is different. With the politicization of the Covid 19 Vaccine, the treatment to those abstaining it would be borderline abuse. here we have (in my opinion) a clear case of backlash directly from refusing the vaccine, even after the mandate was lifted. If you disagree I'd love to hear your viewpoint

You're wrong. When courts overturn laws they almost always overturn them going forward so as to not overturn convictions of those not before the court. The Supreme court ruled on this to never make them retroactive because they don't want the govt writing big fat checks.

And this is just a big one that made it to the news, sadly there’s similar occurrences of unfair leadership decisions where lower enlisted gets shafted because of rank difference that gets swept under the rug because it tends to be on a “within command” scale. We’re lucky to hear about this example because the officer made such a big deal about it to get her sent to the brig. I don’t believe joining itself is a bad thing, but with how toxic leadership tends to be (and don’t believe the “one team, one fight” within whatever branch, it’s more like a pack mentality between others, at least in my command) now isn’t a good time to join unless something changes on the upper side, which is detrimental considering Russia and China being our main threats and low recruitment/retention hurting manning.

That was my thought exactly when I hit my 4th year of service in 2001. Before then, I scored “true blue” for expert infantryman badge, had 4 AAMs… and was slotted to go to PLDC that November and take my promotion afterwards We were on division ready brigade 1 and 9 for the past 9 months and weee finally getting off it it one Friday in late September. The next day, we were heading out to spend the next 2 weeks as the OPFOR for SFQC Robin Sage. It’s basically a 2 week camping trip So, a few of us went to Sparkey’s… this strip joint on Bragg Boulevard. Long story short, the dude driving who was a E-5 and new to the division… he got pulled over for hanging a headlight burned out They took him to the station to breathalyze him and all of that. He was sober, zero percent registered. We didn’t know that at the time, as we were taking a taxi back to the bricks. We figured he must have had some drinks and got a DUI We did exactly what we were told to do by our piece of shit 1SG and CO. We were technically still on DRB-1 until noon the next day, which was Friday. We were to do just a battalion run, then released the rest of the day to get ready for Robin Sage the next day We told the 1SG what had happened… and he… blew the fuck up, and mostly on ME, who was 23 years old at the time. The other 2 guys were 20, and the driver was 24 I was the only one out of the group who got demoted. I was busted from being a team leader E-4P to a E-3. I was so fucking PISSED… but really let down more than anything The fact that we did exactly what we were told to do if ever in a jam, and then to see it was a lie… a lie used to brainwash us just to make things easier on the 1SG so he could put the fucking to us.

I had the pleasure of sitting down with Lance Corporal Arnett for an interview before she was incarcerated. It's quite an unfortunate that all the retaliatory actions were taken against her - she was an exemplary example of a Marine. She was my assistant soccer coach during one of numerous seasons she volunteered as a coach and mentor. Keep in mind, while volunteering as a Youth Sports Coach, individuals are often required to interact, lead and mentor children of Senior Enlisted and Commissioned Officers. The parents, of some of these children, were the ones seeking to punish LCpl Arnett. One punishment they were able to levy on her: they contacted the Youth Sports Program director and informed them that [she] was not allowed to Coach any team(s) or individuals due to legal actions. Imagine being someone so determined and invested in the youth mentorship program(s) that anywhere you went, you were immediately recognized by the children of these senior service members. Imagine them taking all of that away. I remember during our interview she choked up and broke down a little while describing this. Thanks for covering this, AC. I personally apologized to Kat for not being able to provide a strong enough platform for her story to be heard but I'm glad it's out there. That is very solid advice. Unfortunately, I think the ones who will stick their necks out have been hunted out of existence through the day to day bullshit until either they saying "Fuck it, I'm done" and getting out, or by getting forced out. We used to say "Shit floats to the top" and I think that military proverb is spot on. You don't really see an officer make it past O2 or O3 if he is competent and not a "Yes-man". As for enlisted, the VAST majority get burnt out before their 4 year contract is up. Guys who make it past E5 and then decide to stick around for 20 are a VERY rare breed if they are truly good at what they do. Most of them become Officer pets and fuck with their subordinates because a lot of them aren't really intelligent and so they know the power of rank is all they have in life. I say this all the time, but many Senior Enlisted are like Samuel L Jackson in Django. They'll never be "Masta", but they have a little authority over the rest of the slaves and so that tiny bit of power goes strait to their high and tights

feel for her, been in a similar situation back when i was in the army, so here's sort of a short version. sometimes doing the right thing and standing up for yourself is no easy thing. when everything was over my commander came into the mess hall were i was eating, noticed me, and asked to sit with me, you pretty much can't say no so. he told me he knew the whole time i was innocent and he did it just to make an example of me so everyone else wouldn't question him. one good thing came out of my court martial, everyone got to watch the trial at my request and all the seasoned people who were considering reenlisting had changed their minds. many came up to me when the trial was over, shook my hand, and told me they wouldn't re-up seeing what the new army was becoming and they were not happy with it, so the commander pretty much after all had made part of my case for me for what that's worth.

Yep. I've had officers try to pull that, "You _will_ respect me," instead of paying attention to the fact it is, "you will respect my _rank,"_ and then conducting themselves responsibly. I was very lucky in that while I've had a really mixed bag of Captains, and about half the Majors were just crap, about the same for Colonels, I was always able to not only get along with but respect the Generals whom I came in direct contact with, and even those Generals I only heard about through requests I made through the Chain. Sometimes, those Generals did things because of policy set by higher that I was eventually able to overturn; a couple of Generals made my list of people I respect by picking up and doing the right thing, damn the consequence. But God, I acknowledge that I was a *hard* soldier to have under the responsibilities of direct Officer authority! Post Commanding General calling my Captain in to explain very loudly that he is to, "Get your house in order, because your PFC is [miss-] leading a Master Gunnery Sergeant into behavior and ways of thinking that the Corps no longer condones." Yes, I was Army, and yes, it was a Marine General yelling at my CO so loudly people could hear it outside the building--I heard about it from _drivers_ waiting outside! My unit said, screw the policy and those in charge, we're going to be more restrictive and never allow anyone their gold card. After I was there a year and a half without issues, the commanding general of 3rd Marine Division said: hey people in charge of this unit not following my standing orders, get your sh*t together and issue the deserving marines their gold cards like everyone else or you'll be back to being a butter-bar... They finally gave in kicking and screaming that they couldn't just punish our unit because they felt like it anymore. She was unceremoniously discharged from the USMC with a General under Honerable Conditions. They took her off post and kicked her out of the car at a gas station with nothing but the uniform on her back. Her property and the rest of her uniforms were not taken with her to California. Nor was her cell phone, her car, her driver's license, her wallet, debit card/atm card....in city where she had no friends or family and with not even a dime in money to sustain her life. Though she was in confinement, she was never given a court martial nor a Page 11 or whatever the USMC equivalent of an Article 15 is. So, she had to have been accruing pay the entire time as the only way to forfiet anyone's pay is through some sort of official proceedings and judgment. If her commander had given her a field grade judgment she could only have 1/2 pay forfieted for up to two months and be given extra duty for up to three months. But would not have been arrested. Upon her aquiring money enough to purchase her own ticket back to Japan, she flew from the US and upon landing at the airport, made her way back to the naval airbase she had worked at...at 0230...and walked right up to the front gate and requested admission on to the base so she could return to work. She was arrested again and handed over to the Japanese police who put her in pretrial confinement while she awaited the Japanese prosecution team's decision on what to do about the situation. On the 27th of December the Japanese authorities released her and she left Japan. I am only guessing that the Japanese authorities told her they would not press charges if she agreed to leave Japan and not return to the naval air station. Though, again, that is what I infer from the release. The biggest issue I see is what she did to the station commander. She publicly called him out several times for not standing with her and others seeking religious exemptions as he was known to espouse his Roman Catholicism as she is a devout catholic herself. He is in big trouble as are those who classified her as level 4 + or whatever the military uses as classification scale to denote a special management inmate due to them being violent towards staff or an extreme escape risk. It appears that this was done to take away her religious practice as she had, when possible, received mass daily until her first incarnation in Japan and she had made many complaints about the fact that her commander had ordered her not be allowed any religious freedom while in custody. What a dick move. The fact that they kept her personal property and ensured nothing she would need to transition from the Marines once the situation was concluded is beyond acceptable behavior. But, then again, brandon did this so he will do nothing to make this right.

People were losing their minds and saying you should DIE if you didn't get the pokey poke. I hate she's the one carrying the punishment for this madness but we can only hope what she's going through will make serious changes. Our military and civilian justice systems have been sinking lower and lower into deplorable levels and this sort of immoral hoop jumping to get someone charged and punished has left logic and the Constitution in the mud. I got out in 2016. When I heard that the marines had a 98 or 99% vaccination rate I knew this was exactly what had happened. Bullshit hazing and charges applied under the guise of good order and discipline. Obviously they didn't need to kick people out for not being vaccinated, they could just be toxic assholes to anyone who didn't fall in line until they had enough to kick them out for other reasons.

I was in from '92-'98, checked into my first unit in Nov, then 29 days later being shot at in Somalia. That made up my mind to get out once I had kids, but as early as 94, I could see the change. That's when Clinton took office, stress cards at boot camp, almost brought up on "hazing" charges when a PFC told a Cpl he wasn't going to do something I had ordered, so I made him do push ups and side straddle hops while the Cpl and other PFC did the job. It was 94/95 I heard a LOT of senior staff NCO telling me not to make a career out of the Corps. Even my company 1st Sgt said it wasn't a good career choice any more. Made Sgt in 3 years, SSgt in 6, and I was field radio, not a quick promotion field (meritorious promotions, time in rank to SSgt). The military has been pushing good men and women out for 3 decades now. Now I am a homeless disabled vet, getting under-rated by the VA, getting denied treatments by VA medical. Anyone thinking of joining in 2023 - don't. They will use your blood for cheap oil, and IF you make it back, will crap all over you and deny you the care and respect you earned.

A dropped charge is not the same as something being found unconstitutional or having been against the law. When the court said that the blanket denial is unconstitutional, then everything that came from that is no longer valid. Essentially, as you explained, "Fruit from the Poisonous Tree". Something being against the law would like an officer searching your home without a warrant and having no justification for a warrantless search or exigent circumstances. However, she was charged with forgery, when she decided to say no and I'm not going anywhere, they charged her with missing movement and failure to obey a lawful order (the UCMJ article is does state direct order as some might think). Because they didn't have enough to charge her for the forgery, because of the evidence, they dropped the forgery charge. The fruit of the poisonous tree does not apply. As the other charges were made within the scope of the law, and the previous charge wasn't considered unconstitutional. Meaning, that does NOT stop or drop any other charges, just means that they believe they have enough evidence to continue. With that, this sounds kind of like another story. Navy Seal Chief Petty Officer Eddie Gallagher. Did they need to put her in the brig? No. Does Navy regulations allow it? Yes. Shit, had she been on a ship, they could've put her on a bread and water diet. With all that, I am excited to hear about an actual troop standing up for orders that are wrong and/or immoral.

How is the document a forgery? One, it's the same document used last time, with an updated date. Two, LCpls don't just walk into their Commander's office and say "What is is, Sir? Sign this for me." Things requiring the Commander's signature are sent through the chain, and there are a lot of stops between a LCpl, and a Commander, any one of which could have kicked it back and said "No, this is no good, here's why, fix it." But they didn't, they forwarded it to the Commander, who then approved it. That's not a forgery, that's a document sent through the chain, and approved by the Commander. Something that happens every day. You're absolutely right, Drill, this whole thing was nothing more than her command saying "You have the rights we SAY you have, peasant. And don't any of the rest of you EVER forget that!"

Toxic leadership has progressively gotten worse over the past roughly 23 years in the Army, Marine Corps and Navy. The Air Force seems to been affected less than the other three but hasn’t been completely immune from it. I’ve served in both the Army and USMC since 9/11, but have worked with all in a joint environment. The military needs to change their paradigm and re-educate leaders on their responsibilities and legal authority.

Refused the jab, got a target on my back, command was watering at the mouth to separate me. Once they were told they couldn't all of the sudden charges of bullying a subordinate that I have never met popped up.... and after the first IO wrote up a drafted F&R saying I didn't bully the soldier.... she was replaced with a second IO that wrote a F&R that said I did... all of this approved with 0 evidence (a preponderance is needed) and signed with approval from the CG. Same CG who tried everything to kick me out for the jab. Whats funny is that all of this has put my REFRAD on hold and is actually keeping me in the Army longer! Justice?
