The plaintiff bought a truck from the defendant. She says the defendant told her he’d send her the title to the car, but he never did. The defendant repossessed the car after saying she owed him more money, so she’s suing for what she paid for the truck. The defendant argues the plaintiff hid the vehicle from him.

He reminds me of my mom's current mistake, I mean husband. You can't trust ANYTHING that comes out of his mouth. He'll say he owned a body shop and in the next breath he says he worked for the guy who owned the body shop. Same thing with this con artist, I'm going to tell you one thing to get you on the hook for something more and then forge your signature to try to get what I want. He's slimy.

Judge should have taken into consideration that the “dealer” sold the car again and got MORE MONEY FOR THE SAME CAR.

The show can only order the statutory maximum ...... meaning the maximum one can recover in small claims in the state where the plaintiff lives. Yeah it would be nice to get back all of it. Since she gave the guy 6K, with the statutory limit being 5K, it would have been more fair to give her back 5K ..... but the woman did have use of the truck for those 7 months so yeah, you don't get to rent a truck for nothing ..... guess maybe the judge tossed in a bit more for loss as a lesson for the woman to learn how to take better care of her business .... that excuse that her husband had taken care of everything when the were marriage.... that is a stupid thing for a woman to do .... ya need to know how to take care of yourself.

@@somebodywatchin The show can only award up to the statutory max allowed by the state of the plaintiff. So, if the actually amount owed is 6K, but the statutory max is 5k, that would be the most that could be awarded.

7 month use of the truck is hardly worth $2000, or in this case a whopping 33% of what she paid for it. I'd say the plaintiff got the worse end of the deal.

It costs $1000/month to rent a car. I say $285/month is a pretty fair deal.

@@jamslam5641 yea except she wasn’t renting the car. Everyone knows renting a car costs more than the ownership. So to treat the 7 months like a rental is, essentially, causing her to lose money in this transaction. The man essentially got to rent the car out and make a profit and then repossessing the car. Not to mention the judge blatantly ignored the felony of signature forgery.

The defendant, who's in the business of selling motor vehicles, somehow doesn't have the paperwork? Hmmm. Either very sloppy record-keeping or shady, and my inclination is toward the latter. I'm curious to see what he later says about the title. Edit: Sure enough, a highly suspicious signature on the lien papers. Defendant's credibility is in the toilet. And the funniest part to me is that he was fussing with his "documentation" before Douglas moved him over to be sworn in. What documentation did he have?

Each state would have firm document retention periods articulated for these documents, and dealers, for sure, must be aware of that. For bill of sale for vehicles, in my state, I think it’s 7 years.

I used to flip cars when one could buy a junker for $100, clean it (my old lady did that), tune it up and sell it the next day for $500. I had people coming back because something broke months later.

What an absolute con man he is. He conveniently has no bill of sale or title. Then there is the document with the forged signature that they brought to court while under oath. His excuse for not having the paperwork is that it was 3 years ago. So what! He should bring that to court. She was naive unfortunately. Could they not bring a charge against him for the forged signature? I think JM should have awarded her 5000, which is the maximum she can award. 2000 for 7 months use is too much. The saddest part of this is that the defendant does not make the payout. The show does. So he actually gets to keep the 6000. He is a scammer and a crook. One good thing is that they mention the name of his company so if you are in Florida looking for a vehicle just refer to this video to see where NOT to go.

Amen!!! Totally agree. Totally agree! Not sure why she didn't return that chics money. The friggin guy earned double profit, her money and more money when he sold it again! Not to mention he committed a felony with the forgery! He filed forged documents to the courts to illegally steal the truck. Then committed more forgery and fraud by continuing the felony in her court under oath! If it was me I'd file a formal complaint with attorney general, and go after his dealer lisc, and file police report for forgery and theft of vehicle. She has the proof and now vid proof too with this court case. It wouldn't be Abt the money at this point, I'd be after his livelihood. His pockets

I've bought cars but NEVER left without a bill of sale and title. I understand that the DMV would keep the title if the vehicle wasn't paid for but not having a bill of sale is just stupid. A dealer without paperwork is just wrong.

The only reason he didn't bring the paperwork was because it would have ruined his case, you don't have to be a genius to work that out. Given that, he sold it for $6k and then committed forgery, and then illegally repossessed it after trying to scam another $1400. Then the judge makes her pay $2000 for the privilege of driving it?! Another poor decision there.

Who buys a car with no title? When you finance a car you STILL get a title, but the lienholder is on title too. I can't believe she let him get away with it, with a forgery to boot. She really missed the boat on this one. So he got to sell the car twice and she put the bite on the plaintiff for 2k. That sounds like good motivation for the scammer to keep on scamming.

I have never had a title to a car as long as I'm making payments. The title comes in the mail after the last payment is made.

That’s why this situation was sad, the lady honestly didn’t know the procedure and thus got swindled. As for you, as long as your wife knows how to do those things on her own (or, knows how to find out how to do those things on her own) then it’s all good if she is choosing to let you handle it instead. 👍

The dealer was playing a scam game. He sold her a car, then just added the additional tax and other taxes, costs to the agreed $6000 total. This is a common tactic, so buyer beware. He seriously needs to loose his license until he fixes his act up! Not to mention the forged signature that the dealer probably convinced his clerk to forge before she quit.

I have a sneaky feeling that document was signed by him. The judge should've have had him sign her name in his handwriting. To see if it matched the forged signature. Because I'm thinking it was him. Because then if that was proven he did. Couldn't she sue him again for forgery? Also, this is why I never go to anyone for cars except for one guy who is my Dad's best friend. You can't trust car dealers. At least with my Dad's friend he is straight up honest. Even told me a car I was interested in wasn't worth it. And that the car had lots of issues. And there was a reason it was still on the lot 7 months later.

My only point is that if he.had signed that document and the judge asked him to make a signature for her to compare he would not be stupid enough to sign the same way as on the document. He would sign in a different style. This was in response to the original comment. I see what you mean about handwriting experts being used in larger cases. This would not warrant that.

when I bought a used car from a salesman like this we paid the first months payment to him and then he called regarding the second months payment for us to come down and pay it, yet he said we never paid the first month! he said I am positive because I have a carbon copy notebook and I never tear out the original, only the copy. and your's Is not here! we were flabbergasted as we were holding the receipt in our hands. we had to drive all the way down there to show them. I can only imagine how many people they get over like that.

I made the same mistake. I handed over a check for a car without asking for the title. I believe the dealer deliberately held the title to make sure the check cleared. After it cleared he contacted me and told me he was gonna mail me the title.

I once sold a car to a junk yard. They would come tow it for me! I asked the guy, "Don't I have to sign some paperwork?" "We'll take care of all the paperwork." Well, they didn't. I started getting bills for skipped tolls in San Francisco. I lived in L.A. They took those skipped tolls off my tax return!

@@phlushphish793 Yeah, you needed to do a title transfer. I only know this from seeing the signs in my local DMV when I go pay my property taxes. Hopefully, you've taken care of that issue.

I been a auto mechanic involved with dealerships, private owners, buy here/pay here, corporate and of course myself. I trust a politician telling the truth before a used car sales person.

I think 33% depreciation for 7 months use on a used vehicle is pretty rash... shouldn't have been more than $1,000. The plaintiff should have gotten the full $5K judgement IMHO.

She has a repo order against her now which I’m sure effects her credit and takes money to have it amended? Isn’t that worth another thousand, she was seeking 5 k yet was out 1k and a car but the judge rewarded the dealer 2k basically for fraud. She shouldn’t have been charged for the use of vehicle when she had papers showing falsified documents by dealer.

WTF!!! she has to pay the crook 2K for the time she had the car even thro the decision was that the dealer had no evidence that they had agreed on a different price of $7300: What dealer would hand over the car and not provide a written contract to the amount owning? and it's obvious the dealer forged the signature. Such a bad decision by the Judge.

Fair judgement. Terrible paper work on both sides...especially from a dealer. ALWAYS document well. I also make people sign an AS-IS document so they can't come back later. I also disclose if it had been in any accidents and again, repeat AS-IS. I let them take it to a mechanic and that is also stated in the document. I would ALWAYS win in court because I document clearly. I have never had a buyer walk away because I do my diligence. Tip: If you rent a car and definitely an apartment or house, take several clear and dated photos before you take possession. Landlords notoriously try to make people pay for previous damage. Again, it's very easy if you DOCUMENT.
