The most important thing to remember when you get sued is that the collection lawyer is not your friend. His entire job is to squeeze as much money out of you as possible, while providing you with as little as possible. Way too many people think they can handle a lawsuit with a phone call to the collection lawyer, only to later find that they've allowed a default judgment to be taken against them.

You most certaintly can call the collection lawyer and work out a deal. What you have to do is get it all in writing from them before you pay them one dime!

This is true, but these lawyers are very good at overstating the strength of your case and intimidating people with phrases like "wage garnishment" and "bank levy."

@Nadia Zamora because of the time that has gone by I don't think you could ask the courts to set aside the default judgement unless you think they made an error. Since you have contacted them to try and pay off you have accepted the debt as yours and that you do indeed owe it. They have won the case basically and can garnish wages if they so choose so keep that in mind. If you cannot pull together enough money to pay them off then making payments is your best bet. Go over all finances first and see what you can pay down and what you can pay per month. Call them again and try to negotiate but when you call have your ducks in a row with what you pay out each month in expenses. That will include everything. Tell them you can send the original amount that you had to offer them plus so much per month. Try that first and if they still want documents be prepared to send them because they absolutely can garnish your account. You do have rights in the garnishment process if they choose to do that. You have to be legally notified of the garnishment, and you can file a dispute if the notice has inaccurate information. Some forms of income, such as Social Security, are exempt. You can challenge a garnishment order if your rights have been violated or if it would prevent you from affording basic necessities.

Most states let a judgment creditor question you about your property and finances, in a procedure called a "debtor's examination." Basically, they are looking for money or property that can be legally taken to pay the debt. The first thing on the list of property the creditor looks for are deposit accounts (like savings, checking, certificate of deposit, and money market), tax refunds due, and other cash. You could blot out every transaction that you do but not the deposits etc. I would write everything down that you spend per month and see if they will let you answer this by phone or send you a document with the questions on them for you to answer first. If they still want your bank statements, you can blot out what you buy but keep the deposits where they can see it because that's what they are looking for. Keep calm with them because you will get further with them that way and hopefully you're not dealing with a complete jerk. They have already won the judgement. If they are willing to settle for a certain amount or take a certain amount down and then you make payments, that will be the best way for you to try and work it out.

I give them today's date,time,and demand cease and desist. The collection company cannot do anything when I tell them I am on Social Security Disability. That is it and I also tell them I do not have a contract with them. They hang up and don't call no more.

I does one pay a debt with a debt instrument? If the debt is denominated in undefined dollars and the obligation to repay is also in undefined debt instruments called DOLLARS which don't even meet the lawful requirements of a promissory note?

I've gotten hit with a lawsuit. What i'm confused about is over a year ago I received a letter from the courts dismissing the suit for 12 months of inactivity. The lawyers had 30 days to dispute, however they responded in 4 days agreeing to the dismissal WITH prejudice. They provided the incorrect case number and their file number, however, they never corrected it withing the 30 day period. It's been 19 months now and we are headed back to court. I'm hoping when I show the judge the dismissal letter all will be over with in minutes. Or does a lawyer have a recourse due to not catching their own mistake?

So I did what you said not to do, the court rewarded them 260 more to what I owed them. So no written answer from me, I owe them more. What happens next? What if I want to settle? What next?

That depends on what the terms of your agreement were and the law of your state. If you settled with them, then if you pay the agreed amount, they should release the lawsuit. Or if a judgment has been entered, they should send you a satisfaction of judgment once you've paid the amount you agreed to.

Im in Virginia and my summons has a hearing date at a General District Court.. I dont see any paragraphs of complaints Im supposed to respond to on my papers.. also I dont see anything that says Im supposed to give a written answer to it.. It says to show up in Nov 5th "to answer the plaintiff's civil claim" ..Is this the one exception that there doesnt need to be a written answer? and if so, should I appear first on that date and negotiate settlements after, or can I start negotiating now? **the plaintiff is the original creditor, it was not sold to junk debt buyer** thank you for advice, cheers

I got sent paperwork and sent letter explaining myself I sent letter to the court downtown never heard back from them BUT I did state that I owed and why I didn’t pay 🤦🏻‍♂️ So now I just got another letter stating that I have court date in December. The letter is from lawyer on behalf of the Assignee! Not even the original debt. What should I do now? Write letter to court? ??

You need to hire a lawyer in your area. If someone in your shoes came to me, I'd file an amended answer as soon as possible to assert every possible defense, including lack of standing.

Judson E Crump Mr. Crump, the money is owed and I can’t afford a lawyer. I need to respond to the letter but then what? Go to court they say I owe it and...? What’s the best I can get out of this other than having it thrown out or dismissed?

Hi currently I have a 9000 medical bill that is in the hands of a collection lawyer I haven't been served yet but I've started retaining a lawyer for bankruptcy. If I get this right the collections lawyer has to serve me before they can garnish my wages? I'm in a constant state of fear that payday is gonna come and I won't have no paycheck because they garnished. I live paycheck to paycheck. I feel so forced to file bankruptcy and I don't want to. I was making pmts regularly and then they being fidelity collections they closed the account and sent it to a collections lawyer. My credit isn't great it was tarnished after my divorce. Any advice would be appreciated thx for the video
